The New Mixioan's announcement Inst evening of the killing of Marshal C. L. Cantley, of Silver City, by James S. Fielder, a prominent young attorney of the same place, oansed qmte a sensation in official and legal circles, both men be ing well known to many people now in Santa Fe. It appears, however, that the report, which was sent over the wires yesterday, was essentially incorrect, Riv ing an entirely erroneous coloring to the unfortunate affair. 8T0BY OI AM BYE WITNESS. Mr. S. P. Carpenter, a well known cattle man of Grant couuty, who came np on the train from the south this morning, was seen this forenoon by a New Mexican representative. He related the story as given to him by an eye witness, Mr. Tony Clark, a merchant of Deming and a trnstworthy and unprejudiced man, who had no reason to tell anything bnt the truth.' IN THE WHITE BOUBB SALOON. Mr. Clark told Mr. Carpenter that the shooting occurred at the White House saloon, in Silver City, about 10:15, on Tuesdat night. Cantley and Fielder, who were supposed to be personal friends, had been shaking dice at the bar. Finally Cantley, who had been drinking heavily and was somewhat intoxicated, abruptly accused Fielder of Baying something against him. Fielder replied that if he had had any thing to say against Cantley he would have said it to him personally. CANTLEY DBEW HIS OCN. Cantley then asked Fielder if he was armed, and Fielder answered by saying that he did not think it was proper for Cantley to ask him such a question. Then Cantley drew his revolver and fired three shots at Fielder in rapid suc cession, but missed his intended victim each time. After Cantley had fired two shots, Fielder drew his revolver and began fir ing. He fired five shots. The first missed Cantley, but three of the other shots struck the marshal in the left side IN THE BEOION Or THE HEABT, and either one of the wounds thna in flicted would probably have proved fatal. The men were standing about fifteen feet apart when the shooting began, Cantley being at the end of the bar and Fielder leaning against a railing near the desk. Cant ley's intoxicated oondition possibly acoounts for bis poor shooting. According to Mr. Clark, Fielder was sober, and used his weapon with remarkable coolness, holding it up with both hands and taking deliberate aim. FIELDHH ACTED IN SELF-DEFENSE. Mr. Carpenter adds that before leaving he saw a telegram from Mr. W.B. Walton, clerk of the oourt at Silver City, to the manager of his paper at Deming, in which Mr. Walton said that Cantley was wholly to blame for the shooting and fully exon erating Mr. Fielder. As soon as an inkling of the tragedy reached Santa Fe yesterday morning, the New Mexican ordered foil details by wire, but np to the Hour or going to press it was only able to procure the meager and (as it now appears) untruthful dispatch printed last evening. For the purpose of showing that someone at Silver City must have deliberately misrepresented the facts, the following dispatches sent out from there yesterday are reproduced: The Associated Press aooount of the affair says: "Lawyer James Fielder shot and 'killed City Marshal Cantley this morning. Fielder was drinking in a b loon and made considerable noise. Cant ley requested him to keep quiet, when Fielder replied acrimoniously and pulled his gnn and shot the marshal dead. Fielder was arrested and is in jail." The United Press report to the Optic was in these words: "Silver City, N. M., Oct. 9. James S. Fielder, an attorney of this city, shot and killed Marshal C. L. Cantley, this morning. The attorney was drunk and noisy npon the streets, and the marshal attempted to quiet him. Words ensued and the attorney pulled a revolver and shot the marshal dead in his tracks. Exoitement is said to be running high over the fatal shooting of an officer in the disoharge of his duty." The Denver Times of yesterday also printed a speoial from Silver City to about the same effect as the dispatches quoted, OEN8UHE MERITED. The Press associations certainly merit severe censure for spreading broad-cast such untruthful and mischievous report and the person at Silver City who origi nated them should be smoked out and taught a wholesome lesson. MB. f I ELDER DISOHABOED. A telegram to Judge Bantz, received to-day, announces that the preliminary hearing before Justice Uivens, In Silver City yesterday, resulted in the disoharge of Mr. Fielder. Prof. Perez has not yet deoided whether his band will accept the offer to take part in the Denver festivity, though he ad mits the proposition to pay him $100 and transportation is very tempting. The rempins of Mrs. De Leon, a native of France, who has long been a patient at St. Vincent hospital, were buried yes terday, the French colony turning ont en masse to attend the obsequies. The de ceased leaves a hnsband and one child, a daughter, 4 years old. The latter is now under the care of the Sisters at the terri torial orphan school. Mr. Wm. Crook, of Pueblo, the well known railroad contractor, is a visitor in Santa Fe to-day. There are few better men on 'earth to-day than plain Wm. Crook. He and his former associate in business, Hon. J. B. Orman, have bnilt more miles of railroad in Colorado than any other two men. The New Mexican hopes Mr. Crook will ere long have a chance to try his hand at railway con struction in New Mexico. His visit at this time is significant. Coming Convicts. Sheriff Ascarate, of Dona Ana county, will arrive in Santa Fe on Wednesday next bringing the following convicts to the penitentiary: Jose Campbell, ninety-nine years, for murder; Ancelmo Cormona, one year, for killing cattle; Chianka, an Indian, three years, for murder, and Pedro Velarde, one year, for appropriating other peo pie's horses. hoTforjemezi The Coehiti Cut-off to Be Completed on Saturday Through Staffo from Thornton. Mr. John Oarrison, who has spent some weeks securing bonds on valuable mining claims in the Coehiti district, tells the New Mexican that the new wagou road from Bland to Jemez hot springs will be completed on Saturday. An excellent road has been built up the main Coehiti canon and over the divide to the Jemez valley. "You can, even to-day," said he, "drive a side-bar buggy from Santa Fe to the hot springs without fear of n break down or accident, and make the trip in fifty-nine miles." The opening of this road is an event of moment for Bland and Santa Fe. It will ont down the demand for grain, hay and farm products from Sauta Fe, the Jemez valley settlers hereafter supplying those articles to Coehiti, but in other respects an increased merchandise trade will flow into both the Coehiti and Santa Fe from that rich and fertile over-the-range conn' try. The stage line now being operated be tween Thornton station and Bland by Perley Wason is shortly to be extended to the Jemez hot springs. A press dispatch of the 8th inst. from Fort Leavenworth brings the following information touohing a oase which has excited much local interest in Santa Fe and throughout this territory: "The oourt martial of Capt. J. T. Kirk man that has been in progress at Fort Leavenworth for the last two weeks, and has caused a big stir in army oiroles, was given another sensational turn to-day. uenerai Merntt telegraphed here dissolv ing the oourt for permitting irregularities during the trial, and ordered all the em oers in the oourt to their respective sta tions. .. "The irregularities ' consisted in the oourt permitting the wife, son aud daugh ter of Capt. Eirkman to be present and bear all the testimony during the trial. At the same time the court exoluded news paper representatives and Capt. Barrett, who preferred the charges against Capt. Eirkman. "By allowing the Eirkmans in, nearly all the testimony leaked out in one way or another and caused muoh feeling among the famines interested, lien. Merritt ordered the trial to be oondncted seoretly. "A oourt martial with new officials has been ordered, and the trial is to com mence again Thursday at Fort Kiley." It Pays to Advertise. IN THE SUPREME COURT. Important Opinions Handed Down An Order Concerning Charles A. Spiess Cases Argued and Submitted. In the supreme oourt, yesterday after noon, the oase of A. M. Gentile, appellee, vs. Charles W, Kennedy, et al, appellants, was argued and submitted. Messrs. Cat ron & Spiess appeared for the appellee and Messrs. Childers and Rody represen ted the appellants. The following opinions were handed down this forenoon: In the United States of Amerioa vs. Alberto Vienn, appellant, selling liquor to Indians, the judgment of the lower court was affirmed and the appellant goes to the penitentiary for one year. The opinion was by Justice Laughlin, Chief Justice Smith and Justice Bantz concur ring. In the Territory of New Mexioo vs. Brigida Sisneros de Uutman, the judg ment of the lower oourt was affirmed and the appellant was sent to the penitentiary for two years. 1 he opinion was prepared by Justice Bantz, Justices Laughlin and Hamilton concurring. In Addison M. Janes et al. vs. Marcus Brunswiok et al., appellants, the judg ment of the lower oourt was affirmed as modified. The opinion was prepared by Justice Laughlin, all the other members of the oourt concurring. Chief Justice Smith read the following order of the oourt: Territory of New Mexioo,") Appellee, vs. Manuel Oregorio Vigil, I Appellant. J This cause having been heretofore ar gued and submitted to the oourt, on the briefs filed by the appellant and appellee herein, and it appearing from the reoord and brief filed by appellant that Charles A. Spiess was acting district attorney for the county of Taos, and as such district at torney drew, signed and had presented and filed the indictment in said cause. And it also appearing from the reoord that Charles A. Spiess, after the presentation of said indiotment, and the trial and con viotion of the defendant thereunder, was retained by and has appeared for the de fendant as his attorney in this court in said cause, and as snob attorney aoting for and on behalf of said defendant was erroneously : by this oourt permitted to appear, after having prepared and filed a brief forand on behalf of the defendantand and appellant herein, in which said brief so filed by said Spiess, among other grounds for reversal, attacks the indictment, so prepared, signed and filed by him while acting as such speoiit district attorney in said cause; and the oourt being fully ad vised therein, doth adjudge the conduct of said Spiess as highly reprensible and unbecoming his obligations as an attor ney and officer of this court. It is there fore ordered by the oourt that the brief, so filed by the said Charles A. Spiess as attorney for defendant and appellant herein, be stricken from the files, and that the name of Charles A. Spiess be stricken from the docket as attorney for the defendant and appellant herein. It is further ordered that the submission of said cause, as heretofore made, be set aside, and that the appellant be given six days from this date in which to retain oounsel and prepare and file brief in his behalf in this cause. Just before the court adjourned for dinner, Mr. Spiess filed a petition netting forth reasons why the above order should be set aside. September Tax Collections. Sol.
