PEOULIAB CONDUCT 01 MB. SPIESS. The New Mexican yesterday printed the full text of the order of the supreme oourt in the matter of the peculiar con nection of Attorney Charles A. Spiess with the case of the Territory of New Mexioo, appellee, vs. Mannel Oregorio Vigil, appellant. This oase originated in Taos county. Vigil was tried for murder in the district court for that oounty and convicted. He then took an appeal. This appeal was argued and taken under advisement at the regular July meeting of the supreme court. Mr. Spiess ap peared as attorney for the appellant, and as suoh attorney, among other grounds for reversal of the judgment against his client, attacked the suffloieaoy and validity of the indictment upon wbioh the convic tion was found. B A, of acting district attorney for Taos ooun ty, drew and signed the indictment that he assailed, after the conviction of the defendaut thereunder and his being re tained as counsel for said defendant in the supreme oourt. Mr. Spiess' double connection with the case, first as publij prosecutor and second as attorney for the defendant after conviction, was pro nonnoed by the conrt "highly reprehen sible and unbecoming his obligations as an attorney and an offioer of this oourt," the brief signed by him as attorney for the defendant and appellant was ordered striken from the files, his name was or dered stricken from the docket as such attorney for the defendant, and the case was ordered reargued. This morning Judge Freeman, after reading the explanatory petition of Mr. Spiess together with a certificate as to oertain facts signed by Mr. W. H. Pope, asked the conrt so far to modify its order as to remove the stigma oast upon Spiess, The petition set forth that Mr. Spiess' connection with the oase as assistant dis trict attorney was oummnnicated to the court at the time he made the argument for the appellant, and expressly dis claimed any responsibility for the attaok on the indictment, as that was insisted upon by Mr. Catron contrary to the views of Mr. Spiess, and that in that part of the argument the latter merely acted as the "phonograph" for the former, who was unable to present the argument in per son. After brief explanatory remarks by Messrs. Field, Catron, Crist, Pope and Spiess, the matter was taken nnder ad visement. The case of Adolph Strauss, plaintiff in error, vs. Herbert H. Smith, defendant in error, was argued and submitted this forenoon. Mr. E. E. Veeder appeared for appellant and Mr. W. B. Bunker for appellee. ATTACHMENTS OBDEBED. At the incoming of oonrt at 3 p. m., the olerk was ordered to issue attachments addressed to the U. S. marshal fdr Thomas Hughes, editor, and W. T. McCreight, business manager of the Albuuquerque Citizen, returnable to-morroW morning at 10 o'clock. In this connection District Attorney Jones, of Las Vegas, a member of the oommittee aBking for the attachments, informed the court that, at the confer ence of the oommittee, Mr. Rody had agreed with the other members present as to the propriety of the course pursued, but that he had telegraped from Albu querque to-dav requesting that his name be stricken from the recommendation of the commitee. The name of Mr. Rody was according ly ordered stricken from the document in question. ROUND ABOUT TOWN. The first oar load of anthracite coal re ceived from Cerrillos this fall reaohed here last night. There will be a meeting of Aztlan lodge, No. 3, 1. 0. 0. F., this evening at 7:30 at their hall on lower 'Frisco street. Santa Feans should strive to secure a mail route direct with Bland and Jemez hot springs, now that the road to Jemez valley has been opened via the Coohiti district. Frank C. Corbin died of consumption at his home in Iowa on the 7th inst. He and his wife were health-seekers here last year and made friends who will read this announcement with regret. In anticipation of a orowd of visitors next week the Diocesan association has appealed to the citizens to throw open their homes for the entertainment of our guests. The response has been most gen eral, hundreds of residents having report ed to the oommittee their facilities for caring for the strangers. Likely to Become a Question of Inter national Moment Peralta Reavis Explains the Situation. 'A press dispatoh from Washington of reoent date announced that the heirs of Juan Peralta, of Barcelona, Spain,' to whom was granted large tracts of land in Arizona before the ceding of that terri tory to the United States, will soon tile suit against the government in the United States oourt of claims for reoovery of their property, the claimants being well known New Orleans people, who are represented by W. R. Stringfellow, of New Orleans. Appended was a paragraph dealing with the history of the oase, aud whioh set forth the following facts: THE ABIZONA CLAIM. "Juan Peralta, who was an officer in the Spanish army, was granted 600 arpents of land in Louisiana on December 27, 1798, by De Lomos, the then the Spanish governor of the territory of Louisiana. This gift was supplemented by another grant of land made February 9, 1799, by the Madrid government. The grant em braced 12,000,000, of acres in Arizona in the northwest portion of the state, east of the Gila river. The claimants allege that Juan Peralta was married to Marie De Los Delos, of Farmosa, in Havana, Cuba, after which marriage be came to New Orleans, where he resided up to a short time before his death, which took place in Baroelona. They further claim that the territory of Louisiana aud Ari zona acquired by the United States was after the date of the Spanish grant to Peralta, and hence that no title to the United States oonld be given for the property in the grant to Peralta, except by him or his heirs, which has not been done." To-day a New Mexican representative oalled at the U. S. prison and laid the above before J. A. Feralta-Reavis, whose olaiui for the same property was lately deolared fraudulent by the U. S. land court, with the request that he shed some light on this neweBt phase of the cele brated oase. PIHALTA-BEAVI9' STATEMENT. Mr. Reavis Baid: "The claimants referred to in the dis patch are what have been known as the Cuban branch of the Aragonian Peraltas, which may be said to be the mother-Beat, a little place known as Peralta, in Aragon, where first lived the Carrillos, who were the original Peraltas. In the branch representing the true title of the Barony of Arizona the name Peralta is only claimed and held as a title or nom de plume. This Cuban branch, domiciled partly in New Orleans, first set np claim adverse to the Willing title, whioh I rep resent, in the early '80s, immediately upon the discovery that the author of the Pe-ralta-Willing deed was too young to pos sibly represent that title in fee, and in 1885, one of that family visited Arizona while Surveyor General Johnson was in office and committed suoh information to the surveyor general for the privilege of a review of the papers, then on file, as en abled that illustrious offioial to form what I have always characterized as 'the sur veyor general's syndicate of Arizona,' and from wbioh radiated in every direc tion the wonderful discovery of EBAUDS IN THE SEAL TITLE of the Barony of Arizona. It will be re membered that Johnson had sent photo graphic copies of the originals as they were claimed to Spain early in 1884. Nothing more was heard of this branoh of the family until ia 1886 it was learned in Seville that Manuel Peralta, of Costa Rica, had represented this interest there and had been engaged during the pre vious two years in compiling a history of Costa Rica, and incidentally looking np the Peralta family and their interests. "No additions were : made to this branch of claimants until it was learned by the attorneys, oom posing this 'surveyor-general's syndicate,' that Doctor Jaun Peralta, grand son of old Don Luis Per alta, with other relatives, intended to tes tify in behalf of the present claimants, but upon investigation it was discovered or determined that the lineal desoent could not be traoed to an affinity; there fore their evidenoe was not considered paramount, and W. And from this view there can be found obvious reasons for falsifying our title, and by (he manipula tion of a few dates Spain oan consist ently certify to the title, and claim that we have been the forgers npon an abso lute and valid title although in a some what different name. They have the ad vantage of all the traditional elements that have been developed and set np a complete geographical description of the property with boundaries, an accurate description as well as photographs of the monumental stone, the details of juridical possession, the grand old ruins, and in deed every possible thing of advantage that a diligent search for thirty-five years has developed in this proseontion, and they have the evidence that is of record. Then, as I said, by a few altered dates, skillfully manipulated, the govern ment of Spain oan consistently certify to the title, and, to a degree whioh is monu mental, OFV-SET THE MOBA CLAIM that has been successfully oarried through by the diplomats, and the result will be that an internal olaim will be transformed and transferred into an international olaim, with suoh fictitious values as the press have gratuitously given to the Peralta grant. The entire property will have been appropriated to a pnblio use by the judioial decree of the oourt of private land claims and suit will be in stituted, if not already, for such flotitious value and pnblio estimate of the press carefully compiled and deposited with the Spanish diplomat who will, in lien of $1,500,000 on account of the Mora claim, set up a oounter olaim against the United States for $65,000,000 on aoconnt of the Peralta grant."
