Facts Regarding the Distribution and Condition of Fund Arising from Albuquerque National Bank Dividends Opinion of the Solicitor General. For the information of the Albuquer que Citizen, which is indulging in a good deal of talking through its hat these days, the New Mexican has taken the trouble to ascertain from Auditor Garcia the ex act oondition of the speoial oonrt fund derived from dividends declared by the receiver of the Albuquerque National bank. The total amount of money so far placed to the oredit of this fund is $15, 451.72, against which warrants have been drawn and paid to the amount of $14, 108.59, leaving a cash balance ou hand of $1,343.13. Under the law eaoh' of the judicial districts of the territory .is en titled to draw $6,175 against this fund, no provision being made for distributing the actual cash as paid in prorata among the different districts, and it has hence happened that the money has been drawn out on the principle of first come first served as follows: First judicial district, $6,067.26; 2nd distriot, $2,100.48; 3d district, $2,000; 5th district, $3,940.75. It will be perceived that the 4th or Chief Justice Smith's dis triot has not drawn a cent of the money, while, owing to extraordinarily long and costly terms of court, Judge Langhlin's district lacks $107.74 of having drawn its entire share of the fund. Unquestionably future dividends will so increase the fund that all the other districts will get their full share, and the fact that some of the distnats may have to wait a few months for the actual cash is the only possible cause of complaint in the premises. In view of the faot that his distriot had not drawn a dollar of the fund, Chief Jus tice Smith notified the auditor of hie in tention to draw $2,000 for holding court in Mora county, and at the request of Judge Collier, of the 2d district, the mat ter was referred by the auditor to the ohief law office of the territory with the following result: OPINION OT THE SOLICITOR OENKBAL. In response to an inquiry, Solicitor General Victory haB transmitted the fol lowing written opinion to Auditor Mar- oelino Garcia: Referring to the matter of the distribu tion of the Albuquerque Natonal bank funds for court purposes, as to which you have requested my official opinion, I beg to say: Under the provisions of ohapter 22 of the laws of 1895, it is the duty of the olerk of the district court to issue cer tificates of indebtedness against the fund for "suoh expenses an shall be approved by an order of the court in whioh such expenses shall be incurred." The clerk is required thereupon to transmit to the territorial auditor a list of such certificates, and the auditor issues warrants for the original certificates when presented, cheoking the Bame off from the list furnished him by the clerk. There is nothing in the act that would justify the issuance of such certificates by the olerk in anticipation ithat such ex penses shall be incurred and thus in ad vanoe of a term of court actually held. Neither does the law contemplate that suoh funds shall be drawn out by an omnibus certificate in favor of the clerk and subsequently disbursed by means of warrants drawn by him on the county treasurer with whom the proceeds of the certificate ehall have been deposited. Under the law the fund is to meet ex penses aotually inourred, not those the making of which may be simply a mat ter of contemplation", the certificates are to be drawn, not in favor of the olerk by the olerk, but in favor of the several jurors, witnesses, etc., by the clerk; the disbursement of the fund is not put in the hands of the olerk but is to be by war rants issued by the auditor of public ao oounts; and, finally, payments are to be made not by the connty treasurer, but by the territorial treasurer. I believe this statement covers the inquiries you have made on this subject. HOUND ABOUT TOWN. The penitentiary board of commis sioners will meet on Wednesday next. Down at Lamy the railroad boys call it the "Japan limited" and Bmile over the fact that even President D. B. Robinson conldn't ride on that train without paying his fare. Judge Laughlin has appointed Messrs. J. H. Gardes, J. R. Hudson and Chas. W. Dudrow as appraisers to determine the value of the property proposed to be oondemned for the opening of a street north of the capitol grounds. Or. Sloan, H. B. Hersey and other chicken fanoiers of the city havearrangad to give a free show of thoroughbred poultry in a room on the east Bide of the plaza, between 9 and 5 o'clock, on Tues day. It will be a show worth looking at and happily will oome within the means of the poorest. , " The capitol rebuilding committee de serves to be commended for its aotion in holding the proposed plans of the new capitol for publio inspection. In this way they may be enabled to avail them selves of valuable suggestions before the planB are definitely adopted. Albuquer que Democrat. The frost last night cot off the rasp berry orop. Santa Fe gardeners have enjoyed this delicious fruit continuously since July 1. It is the monthly variety, which was originally imported by the lamented Archbishop Lamy from Franoe. Extensive plantings of this berry would doubtless yield big profits here, for dur ing four months in the year it is a per manent produoer. The Woman's Board of Trade gave a Holloween hop at Fireman's hall last night that proved fully up to the stand ard of delightful events given under the auspices of this popular organization. For a time it looked as if the hall wouldn't hold the comers. The refresh ments were of superior quality; every body danced till midnight and a goodly sum was realized for carrying on the philanthropic work of the W. B. T. Santa Fe didn't hold a meeting last night, as many cities did, to express sym pathy for the Cuban patriots, but a peti tion has been signed to be sent to Wash ington when congress meets. It is unique for the many nationalities represented thereon. It was headed by Ireland A. C, and among the 15C signatures are resi dents of Santa Fe representing France, China, Italy, Spain, Egypt, Japan, Mex ico, England, Scotland and Germany, while America is represented by the orig inal inhabitant, the Indian, whose signa ture, by the way, is the best on the list. Santa Fe orohardists are shipping ap ples by the car load to Las Vegas and Al buquerque merohants. The crop is very fine. Local merchants are paying from lj.4 to cents for them and are storing great quantities. Also tons of winter pears have been boused and will be placed on the wholesale market about Christ mas. New Mexioo towns will have no need of importing such fruit from Cali fornia this year. Santa Fe can supply every community in the territory. Citizens are reminded that the New Mexican has the best of facilities for turning out quickly and at a small mar gin of profit all styles of job work, let ter heads, business cards, bill heads, etc. Support your home paper by patronizing its job department. This journal is ever at work for the advancement of the inter ests of the city and territory and it counts on, and should have, the support of the business oommnnity. Agent Lutz some days ago took up with Snpt. Hurley the question of a doa ble forenoon train servioe on the Lamy branch, but as yet has had no response. People of Santa Fe protest against the holding of passengers and mail from the east at Lamy junction for two and a half hours, when a run of eighteen miles would land them promptly at Santa Fe. Henry Wilson, a colored boy, walking from New York to San Francisco on a wager, passed through town this morn ing tramping westward. He is to do the trip in thirteen months and has been out three months, having averaged, he olaims, thirty-five miles daily since he left New York. District Court in Rio Arriba County New Corporations Official Notes. Hon. N. B. Laughlin, district judge; George L. Wyllys, clerk; J. H. Crist, dis trict attorney; A. B. Renehan, official stenographer; Rafael Romero, interpreter, and Messrs. Catron, Pope and Twitchell, attorneys, left for Tierra Amarilla this morning, where the Rio Arriba term of the distriot court opens on Monday. The governor has appointed W. M. Drisooll, of Socorro, and Herbert O. Willis, of Chania, as notaries public. He has also designated Edwin F. Carey, of New York, as commissioner of deeds for New Mexico. NEW 008P0BATI0N8. PERSONAL. The People of Southeastern New Mex ico Greatly Aroused Lest Fort Stanton Be Abandoned. Speaking of the receipt of an order at military department headquarters for the abandonment of Fort Stanton, Lincoln county, the Denver Republican says: At the time Fort Stanton was first es tablished it was one of the very impor tant frontier posts of sonthern New Mex ico. Indians were continually harassing emigrants, and in 1856 the Mesoaleros be came so bad that the government was obliged to make a permanent post there, which was named Fort Stanton. Upon the occupation of New Mexico by the Texas troops the post was fired and abandoned, fire consuming everything but the walls. In 1862 volunteers reoo cupied it, putting planks and earth roofs on the buildings and so making them at most tenantable, but not at all a desir able place for a residence in a hot olimate. In 1868 the government saw that it would be necessary to keep troops in that vi cinity for a long time and set about re building the entire post, but early the following year, before almost anything had been done except to tear down some of the quarters, this work wbb ordered stopped and since that time no improve ments have been made at all. Long ago the Indians oeased to be troublesome for the reason, as an army offioer said yesterday, "that there was no longer anything for them to be trouble some over," and merely because the post was already established and troops sta tioned there, Fort. Stanton has continued on the map. It is 130 miles from a rail road bat has a poetoffioe and telegraph depot. A daily mail runs between the post and the nearest railroad point, Carthage station. Three successive com manders of this department and that of Arizona have urged the abandonment of the poBt. A OBKAT 8DBFBISE. While the above is in the main oorreot, from a historical point of view, it is not aoourate as to there being no further need of maintaining a post at Fort Stanton. On the contrary, the post has always been and is to-day an important ad jnnot to the preservation of law and order in that re gion. The order for its abandonment was issued at Washington several days ago, without the knowledge of anyone in offi cial circles here, or any resident of the territory, so far as the New Mexican can learn, had been consulted, on the subjeot, therefore muoh surprise was expressed here when it beoame known. Indeed, lit tle oredecoe was given the report that snoh an order had been issued until the publication of a . dispatch yesterday on the subject. Naturally the citizens of Lincoln, Dona Ana, Chaves and Eddy counties are muoh exercised about the matter and they rely on their frienda, both in poblio and pri vate life, throughout the territory, to oome to their rescue. At the exeoutive office this morning several letters oame to hand from Lincoln county setting forth the real facta in the case and re questing the governor to do his utmost to prevent the carrying out of the war de partment's order. Gov. Thornton is now absent in Sierra county, but upon his re turn in a few days he will no doubt wire the department and ask that" -the order be held up at least until the citizens of southeastern New Mexioo have opportun ity to be heard. . CITIZENS ABOUSED. As indicating the views of oitizens on the subject this extract from a letter re ceived at the governor's office to-day from a prominent citizen down that way is given,: , .. "People in all this seotion, in Eddy, Chaves, Lincoln and eastern Dona Ana counties, are greatly exercised over the reported abandonment by the war depart ment of Fort Stanton, as they well know that the civil authorities oould not pre serve order. This whole seotion would be over-run by outlaws from Texas and Mexioo ware this order carried into effect, and the rough element would create dis turbances among the Indians on the reservation and be a constant source of annoyance. "Petitions from these counties will be sent direct to the war department, and we ask yon to do your utmost to prevent the abandonment of the post." Another letter, from Hon. James J. Dolan, says word has reaohed Linooln that the delivery of post supplies bad been stopped and that the oitizens were very fearful that the post would be abandoned. "Should such a thing happen," oon tinues the letter, "we would have 600 In dians to contend with, and it would be bnt a short time before this region would be over-run with lawless characters. Our oivil authorities would be almost helpless to render relief to settlers and protect property. Nothing so distressing as a haoking oough. Nothing so foolish as to suffer from it. Woods and Green from Ban Mar' 00s, Texas, who have been in the northern part of the territory seeking for a placer property on whioh to operate their large dry washer, arrived here last Sunday and have made arrangements to test their ma' chine on the placer grounds owned by James A. Woods and associates near here, The machine was invented by the Mr, Woods first named, and was manufac tured by Frasier & Chalmers, of Chicago. It arrived here last Tussday, having been hauled from Cerrillos by 3. F. Williams' four-horse team, its weight being 1,000 pounds. It was immediately put in plaoe on the placer grounds and operations will commence at once. It appears to be very complete and we trust it will prove to be a suooess. The machine is run by horse power. I will report progress. The mill run test of the ore from the "Cnllen" group of mines, on whioh Mr, G. Y. Anderson holds a bond, was com pleted last Saturday, bnt as yet the re sult is unknown, except to those direotly interested. We sinoerely trust that it was satisfactory and that the deal will be closed on this property and aotive opera tions commenced at an early day. Mr. J. N.
