NOTHING DISCOURAGING YET HOSE Alaskans who are getting anxiuos over the delay in the announcement of appointments at Washington should not get discouraged. The President has not announced any appointments at all since the convening of Congress in special ses sion. White House interest evidently is now centered upon the tariff bill and other matters than the consideration of appoint ments. It is fair to assume, however, that Cabinet officers have been giving a good deal of attention to the question of appoint ments. and that one of these days the President will send in a big list of names to the Senate for its action, and it is not unlikely that there will be some Alaskans among those in the list. The suggestion of President John Reck of the Commercial Club that the business men of Juneau should take more interest in public matters than to permit the Commercial Club to hold a meet ing with a bare quorum should be taken to heart. There is too much work to do if this city is to live up to its opportunities for men to neglect this matter. i A SATISFACTORY APPOINTMENT * . | HE news from Washington that Mrs. Alfred P. Swineford will; be appointed postmistress at Ketchikan will cause pleasure all over Alaska. It will be a fitting thing for a Democratic President to honor the widow of the first Democratic governor of the Territory of Alaska, and particularly so when that gover nor was a man so thoroughly identified with the real work of lay ing the foundations of the coming commonwealth of the North as was Alfred P. Swineford, of revered memory. No name in Alas ka is more highly regarded than that of this grand, old man who battled so valiantly for so many years for the establishment of an American system of government in the Territory Those of our citizsns that have taken up the matter of pro viding Juneau with a good baseball team and with an opportunity to see and enjoy the national game for the coming summer are public benefactors. They deserve the encouragement of every body. Let us all help them to raise the money necessary to accom plish their undertaking, and then let us all help to boost the Ju neau team to victory. Urges Legislature to Pass Jones Bill (Continued from Page 1.) water, rectangular in form; the size (to be determined by the locator) shall not be more thau one thousand two hundred feet one way nor more than four thousand feet the other way A trap may be built anywhere with in the limits of such reserved area; the general course of the trap shall be lengthwise of the trap site; no more than one trap or other fishing appliance may be constructed or oper ated at the same time within the lim its of any such reserved area; there shall be clear wide spaces or pass ageways of not less than one thou sand eight hundred feet laterally, and clear eud spaces or passageways of not less than three hundred feet end wise. between all fish trap sites and between all constructed traps; and it shall be unlawful for any person to fish by any means whatsoever in any of such passageways between con structed traps. Fish trap sites shall be located by placing two substantial piles, posts, or monuments on the proximate shore at or near the line of high tide, in such position as to indicate the lat eral extremities or boundaries running offshore of the trap site to be occu pied. one of said piles or markers to be placed on each of said lateral boun dary lines produced inshore, the two piles or markers forming a base line from which the trap site may be lo cated: Provided. That if it is not feasible on account of local condi tions or for any other cause to place the markers at or near the line of high tide so as to mark the location in the manner above indicated, 3uch markers may be placed In any other position, on or within reasonable prox imity to the trap sit. so as to form a base line from which the trap site may be located. There shall be placed on such piles or markers a location notice contain ing the name of the locator, the date of location, and a reasonable descrip tion of the trap site appropriated showing the approximate distances and directions of the lines bounding the same: said notice shall be not less than twelve by eighteen inches in height, on a white background. But the location piles or markers, or notice, shall not be effective to hold any trap site beyond the thirty-first day of December of the next succeed ing calendar year following the date of location, unless a survey shall be made and a may thereof be filed with fish trap is built upon the trap site the Secretary of Commerce and La bor. as herein directed, and unless a within such period of time. Every person who, at the time this Act takes effect shall be occupying or claiming one or more fish trap sites in the waters of Alaska, or who has occupied and used any fish trap location or locations during the pre ceding fishing season under then ex isting law or custom, or who may thereafter desire to occupy any un-oc cupied fish trap site or sites, when ever it may be lawful to operate fish traps in said waters, shall, before the thirty-first day of December of the next succeeding calendar year follow ing the date of the passage of tins Act. in the case of existing locations und before the thirty-first day of De cember next succeeding calendar year from the time they are sought to be located In the case of new locations, cause each trap site to be surveye by a competent surveyor, unless a survey of any such trap site shall have been previously made, in whit case such existing survey may be used the occupant or claimant shall cause to be made from the actual survey ot each trap site a location map. drawn to a scale of one inch to four hun dred feet, and containing a plat and description of said trap site sufficient for its ascertainment and identifica tion on the premises; and shall also cause to be prepared a vicinity map drawn to an appropriate scale sketch ed upon or copied from a United States Coast and Geodetic Survey chart (giving the number thereof), showing the approximate location ot the proposed trap site with relation to the general locality, and showing the location of all adjacent fish traps, trap sites, and location monuments, or markers. Such vicinity map may be shown upon the same sheet as the location map. or upon a separate sheet to accompany the same. Such Laps must be certified by the sur veyor who made the survey to be {true and correct maps of the trap sites and premises as shown. The lo cation map shall also contain a cer tificate of the claimant of said trap site, stating that he claims the trap site shown on the map and specif) ing the date under which the trap site was located under this Act; the last mentioned certificate may be signed I by the occupant or claimant, or b\ his agent or attorney in his behalf, and shall contain the post office ad dress of the claimant. Such maps, with the certificates thereon, shall be filed with the Secretary of Commerce and I-abor. and shall, from the date of filing, constitute full'and complete notice that the trap site shown upon the location map has been appropriat ed and is held, occupied, and claimed by the party designated thereon as claimant. A duplicate copy of each of such maps shall also be filed (for information only) in the office of the clerk of the United States District Court for the judicial division within which such fishing location is situ ate. And it shall be the duty of the public officials in whose office any such maps may be offered for filing, to receive and safely keep the same on file in their respective offices, I they shall also keep a proper and con <1111 irH-vrrrrT^^ . ....... venient index of all such maps so ulod. showing the time and date of filing, and the names of the occu pants or claimants on whose behalf the maps are filed; all of such data must be indorsed on the respective maps when filed; but no informality or omission on the part of any such public officer shall impair or preju dice the rights of any occupant or claimant of or to any such fishing 3ite. From and after the location of any such trap site the claimant thereof and his heirs, executors, administra tors, successors, and assigns shall have the exclusive right to occupy, maintain, and fish the same; to re new the license therefor year by year until abandoned or forfeited; to mort gage, sell, and transfer such rights during such time as he or they shall comply with the laws of the United States pertaining therto. Every person being the prior occu pant of in lawful possession of one or more fish trap sites or fishing lo cations when this Act takes effect shall ha\e the preference right until ihe thirty-first day of December of the next succeeding calendar year fol lowing the date of the passage of this act within which to perfect possess ory rights to such location or locations under the provisions of this Act by marking, surveying, and filing the maps with the Secretary of Commerce and Labor as herein provided. Where surveys show adjacent fish traps which have been operated in the last preceding calendar year to have been within the prohibited distances of one thousand eight hundred feet laterally and three hundred feet endwise from each other, as prescribed by this Act that location which has had the long est continuous period of occupation for fishing from season to season shall have precedence, and the junior location must give way. No trap site shall be located so as to encroach up on the prohibited distances from any existing trap or occupied trap site then lawfully held by another. Loca tions of fishing sites hitherto un claimed or abandoned or forfeited shall prevail in the order of location. All conflicting claims to trap sites shall be determined by the Secretary of Commerce and Labor. Provided, That the time for filing the map of any contested trap site with the Sec retary of Commerce and Labor and in any other public office where the same may be required to be filed shall be extended equal to the per iod of time ebtween the date of commencement of any contest and the date of final decision therein. Failure for a continuous period of two consecutive years to construct and operate a bona fide fish trap upon any located trap site, or failure to apply for a renewal of the license therefor, either before or within three months after the expiration of any ex isting license therefor, shall work an abandonment and forfeiture of such trap site, and shall preclude the de faulting claimant from relocating the same within a period of two years. It shall be unlawful to locate any trap site except for the bona fide pur pose of constructing an effective fish trap thereon. No bent or recurved end. commonly called a "jigger", directed or turned toward the opening of the trap, of more than one hundred and ruty ieet 4 in length, shall be attached to any * trap in Alaska. 4 No false or ficticious fish trap or J other fishing appliance not intended < as an effective device for catching < fish shall be maintained in any of 4 the waters of Alaska. < During the fishing season each fish < trap sh?ll have affixed therto a con- < spicuous notice bearing the license 4 number and the name of the licensee. < Nothing herein contained shall be < deemed or constructed to give to the 4 locator or holder of any fish trap < site any title other than a possessory < ribht of occupation or easement for J fishing purposes, subject to termina- < tion by forfeiture, abandonment, or < operation of law. { Sec. 3. That it shall be unlawful 4 to erect or maintain any dam, barri- < cade, fence, fish trap, net, or other < fixed or stationary obstruction, ex- 4 cept for the purposes of fish culture < or scientific investigation, under the < direction or with the approval of J the Secretaary of Commerce and La- 4 bor in any of the waters of Alaska < at any point where the distance from < shore to shore is less than five hun- 4 dred feet, or within any salmon < stream at or above any point where < the same is less than five hundred 4 feet in width, or within six hundred < yards of the mouth of any red-salmon < stream, or within one hundred yards < of the mouth of any other salmon \ stream where the same is less than 4 five hundred feet in width. The Sec- < retary of Commerce and Labor Is ^ | hereby authorized and directed to have any and all unlawful obstruc tions removed or destroyed. Sec. 4. That it shall be unlawful to, cast, lay, or set, place, drive, con struct, or maintain any drift net, seine set net. stake net, trap or maintain any drift net. seine, set net, stake net, trap or any other fishing appl auce for any purpose except for pur poses of fish culture or authorized scientific investigation across or above the tidewaters, of any creek, stream, river, lagoon, estuary, chan nel, or other waters for a distance greater than one-third the width thereof. It shall he unlawful to lay or cast any seine or net of any kind within one hundred yards, or to cast or set any purse seine within six hundred yards, outside the mouth of any red salmon stream, or within one hundred yards outside the mouth of any other salmon stream, when the same is less than five hundred feet in width.
