It shall be unlawful to erect or maintain any stake net of greater length than one thousand feet, or constructed in any other manner than ( by stakes driven in substantially a _ straight line: Privided, That the re I strictiou as to distance intervals be tween stake nets shall not be con I strued to apply to the use by the na tive Indians of stake nets not over ? fifty yards in length to take salmon for their own domestic consumption and not for sale. it shall be unlawful to take any sal mon by means of a spear or gaff ex j cept for personal, domestic, or family consumption; and it shall be unlawful to purchase any salmon taken by the means of a spear or gaff for use in k canning, salting or otherwise preserv * ing for sale. \ | Sec. 5. That for the purposes of < ? this Act, the width of a creek, stream, < i river, lagoon, estuary, or other waters \ J shall be determined by measurements < ? at right angles to the thread of the < > stream of said waters as determined by a line connecting the points mid ? way between the opposite margins or o shores at mean high water; and at o sucli places where the margins or shores are broken by branches, or by well-defiued bays, or by entering 0 streams said margins or shores shall f be understood to be represented by ? the straight line connecting the oppo site headlands across the mouth of 1 such branch, bay. or stream. Where i waters are divided by islands, each channel shall be measured independ ; ently and not as a part of the great er body of water. That it shall be unlawful I I to put or place in any of the waters | ; of Alaska any explosive or poisonous ? ? substance whatsoever for the purpose i ! of catching, taking, killing, or injur* ; ; ing fish: or to place or deposit there ? ? in, or discharge or pass into, or cause ! ! or suffer to be placed or deposited in J | or discharged or passed into, or to _ place or cause to be placed where it ? may pass into any stream, creek, riv ? er, lake, lagoon, estuary, or immediate ? approaches therto. auy lime or other ? caustics, gas tar. petroleum, asphalt, ? bitumen, or other carbonaceous ma ? terials, oils, acids, or sulphates, or ? compounds therof, sawdust, shavings, T tanbark. slabs, edgings, mill or fac X tory refuse, slag, sluicings, tailings, J smelter or mine refuse, or any other ? substance destructive to fish, fish fry, ' ! or the food of fish fry, or which is or " may be injurious to the spawn or j spawning beds of fishes; and in the case of substances known to be dele j terious to fish or fish foods or j spawn it shall not be necessary to ! prove that the pollution of the waters | by these substances in the particu j lar case in question has actually caus | ed the death of any particular fish. iisn iry, or spawn; rroviueu, iuui nothing in this section shall be con strued to prohibit the use of explos ive or stupefying agents by properly authorized agents in scientific inves tigations under the direction or by the permission of the Secretary of Com merce and Labor, or the use of ex plosives in the connection with the construction of buildings or improve ments under official authority; and, Provided Further, That the dumping of fish offal and gurry into the wa ters shall not be deemed a violation of this Act. Sec. 7. That is shall be unlawful for any person wantonly to waste or destroy salmon or other food fishes taken or caught in any of the wa ters of Alaska, and the utilization of any part of food fishes, other than the offal and waste thereof from es tablishments preparing fish-food pro ducts, in the manufacture of fertiliz ; er or fish oil, shall, after ten years - from the date of passage of this 9ct ~ i be regarded as such wanton waste. Sec. 8. That It shall be unlawful to fish for, take, or kill any salmon of any species in any manner, or by any means except by hook or line, spear, or gaff in any of the waters of Alaska except Bering Sea and the waters tri butary therto, Cook Inlet, and the Copper River Delta, from six o'clock postmeridian of Saturday of each week until six o'clock antemeridian on the Monday following; or to fish for, or catch or kill in any manner by any appliance except by hook and line * spear, or Raff, any salmon in any I stream of less than one hundred yards 1 in width between the hours of six i o'clock in the evening and six o'clock 1 In the morning of the following day of < each and every day in the week: Pro- I vided. That the weekly close season < shall not be construed to extend to i the herring and halibut fisheries: And i provided further, That it shall be un- i lawful at all times and by any means ' to catch and kill the rish commonly i known as the Dolly Varden trout or ' salmon trout (Salvelinus malum), and 1 to transport and sell them within the Territorial limits of Alaska. It shall be unlawful to fish for sal mon or commercial purposes in any of the streams tributary to Cook In let Throughout the weekly close sea son herein prescribed the gates, mouths, or tunnels of all fish traps shall be closed by hauling the tunnel to one side ugainst the entrance or j tunnel wall of the "pot", and twenty-1 five feet of webbing or net of the "heart" of such traps on each side of [ the "heart" of such trapjs on each1 side next to the "pot" shall be lower- \ ed or opened in such manner as to permit free passage of salmon and j other fishes at all stages of the tide. The use of "aprons" in connection j with the fish traps during the weekly i close season is prohibited. Sec. !). That it shall be unlawful! for any person canninf, salting, or cur- J ing fish of any species in Alaska to use any label, brand, or trade-mark thereon which shall tend to misrepre sent the contents of any package of fish offered for sale: Provided, That j the use of the terms "red" "medium red," pink", "chum", and similar well- j established trms as applied to the various species of Pacific salmon un |der trade usages shall not be deemed! in conflict with the provisions of this Act when used to designate salmon; of those known species. Sec, lb. That all citizens of the; United States and all persons who j have declared their intentions to be come citizens, and all natives of Al aska and all corporations organized under the laws of any State, Terri tory, or District thereof, shall be en titled to the benefits and privileges of this Act. It shall be unlawful fur any alien who has not declared his intention to become a citizen of the United States to take fish or other aquatic animals or algae from any of the waters of Alaska except for his domestic use, and it shall be unlawful to purchase any fish or aquatic animals or algae from any such alien. Sec. 11. That the Secretary of Commerce and Labor may, in his dis cretion, set aside any streams or lakes including the waters of the approaches {therto, for o distance of six hundred yards from the mouths thereof, as ! preserves for spawning grounds, in which fishing may be limited or en tirely prohibited, but such power shall be exercised only after all persons in terested shall be given a hearing, of which due notice must be given by publication; and where the interested parties are known to the department, they shall be personally notified by notice mailed not less than sixty days previous to such hearing. No order made under this section shall be ef- ' fective before the next calendar year after the same is made. Sec. 12. That the exemption from license fees and taxation in favor of the owners of private salmon hatch eries in Alaska, as provided by sec tion two of the Act of Congress en titled "An Act for the protection and ( regulation of the fisheries of Alaska" ^ approved June twenty-sixth, nineteen hundred and six, shall hereafter be computed and allowed in accordance with the provisions of said Act, at the rate of 40 cents per bushel for all red and king salmon fry hatched and liberated. No additional private hatcheries shall hereafter be approved: Provid ed, That the removal of any private 1 hatchery that has heretofore been ap- ( proved by the Secretary of Commerce 5 and Labor to any new location shall ' be permitted, and the original approv- * al thereaof shall continue at such new location if such new site be duly ap- ' proved by the Secretary of Commerce 1 and Labor, Whenever the efficiency ' and productiveness of any hatchery which has been approved shall be 1 found upon examination and invest!- ( gation to have ceased to merit approv al, the approval may be revoked, and i notice of such revokatlon shall be fil- * ed in the office of the clerk or deputy I clerk of the United States District I Court of the division of the District f of Alaska wherein the said hatchery c is located, but no approval shall be a revoked until afted a reasonable no- l tice to the hatchery owner and a hearing shall have been had to de- t termine the efficiency and productive- a ness of the hatchery. No hatchery rebate certificate shall c be issued on account of any fry liber- c ated from any private hatchery after revocation of the approval thereof. f The Secretary of Commerce and Labor Is hereby authorized, in his dis cretion, to purchase any or all of the J private salmon hatcheries in Alaska c which have hertofore been approved t under said Act of Congress of June c twenty-sixth, nineteen hundred and six the same to be paid for out of the fund ( to be created under the provisions of t section one of this Act, Provided, e That if said fund is then insufficient t o cover the purchase price of such . intcherles so purchased and also to meet the other current expenses to be met therefrom, The Secretary of Commerce and Labor shall issue to the sellers of such hatcheries so pur chased certificates of purchase lor any unpaid balances due them in such de nominations as may be desired by the sellers and such certificates may be i used at any time for the payment pro tanto of any license fees or taxes up on or against or on account of the catch of puck of any salmon in Alas ka. Sec. 13. That every person engaged ; in catching, curing, or in any manner - utilizing fishery products or in oper-' ! utiug fish hatcheries in Alaska shallj | make detailed annual reports thereof ? to the Secretary of Commerce and La- . || bor, on blanks furnished by him, cov-p ering all such facts as may be requir- ! ed with respect therto for the infor- | mation and use of the department and , ? Congress. Such reports shall be ! sworn to by the superintendent, man ager, or other person having knowl- * edge of the facts, a separate blank be- . ing used for each establishment, and | the same shall be forwarded to the ' department at the close of the fishing. season and not later than December I fifteenth of each year. Sec. 14. That any person violating any provision of this Act or any regu lation established in pursuance there of shall be deemed guilty of a misde meanor, and upon conviction thereof, shall be punished by a fine of not less than $100 nor more than $1,000, or by imprisonment for a term of not more than ninety days, or by both such fine and imprisonment, ut the discretion of the court; and in case the violation of any provisions of section three of this ' Act, and conviction therof, a further fine of not more than $250 per diem may, at the discretion of the court, be imposed for each day such obstruction is maintained. And every vessel or other apparatus or equipment used or employed in violation of any provis ions of this Act, or of any regulation made thereunder, may be seized by j order of tho Secretary of Commerce and Labor and turned over to the United States marshal and by him held subject to the payment of such j fine or fines as may be imposed. Sec. 15. That the violation of any J of the provisions of this Act may he j prosecuted in any District Court of Al-I aska or in any District Court of the United States in the Suites of Califor nia, Oregon, or Washington. And it shall be the duty of the Secretary oi Commerce and Labor to enforce the | provisions of this Act and the ruloB and regulations made thereunder. And . it shall be the duty of the district ) attorney to whom any violation is re- < ported by any agent or representative ! of the Department of Commerce and j Labor, to institute proceedings neces-j1 sary to carry out the provisions of ! this Act. . ) Sec. 16. That to enforce the provis- J ions of this Act the Secretary of Com- j ? merco and Labor is hereby authorized ? and directed to make and establish | such rules and regulations not incon- | sistent with law as may be necessary j for the proper investigation, inspec tion and regulation of the Alaska fish- , cries and hatcheries and the invest!- . gation and protection of marine algae, ) shellfish, and all other aquatic aui-'1 mals not otherwise provided for by . law; and to depute, in addition to the 1 employees of the Alaska fisheries ser- * vice, from thee officers and employees ? af the Department of Commerce and " Labor, a force adequate to the per- j formance of the duties required by j this Act; and he shall annually sub mit to Congress estimates to cover :he cost of the establishment and' maintenance of fish hatcheries in AI iska, the salaries and actual traveling ?xpenses of such officials, and for! tecessary to carry out the provisions J rnch other expenditures as may be )f this Act. Sec. 17. That the catching or kill ng of any fish or other aquatic animal )f any kind or species whatsoever in my of the waters of Alaska, unless )therwise provided by law. shall be1 subject to the provisions of this Act. Sec. 18. That for the purpose of his Act the following definitions are idopted to apply to the words in ques ion wherever the same shall be used. "Person," any person, persons, firm lartnership, corporation, association, jr society. "Fish trap" any pound net, fish vheel, or fixed or floating trap, vhether constructed of piles and web >ing and driven or constructed in the dace operated or whether construct ?d elsewhere and held in place by an- j :hors or moorings, but excluding imall dykes or native traps which may >e transported in toto by one man. "Stake net" a net, as a gill net, at ached to or fixed to stakes or piles io that it will fish. "Case" forty-eight one-pound cans, " ?r the equivalent weight in cans of >ther sizes. "Barrel" two hundred pounds of ish, or fifty gallons of oil. "Ton" two thousand pounds. Sec. 19. That all Acts or parts of Vets Inconsltent with the provisions >f this Act, are, so far as inconsist- :: >nt, hereby repealed, said repeal to be !j ?ffective when this Act takes effect. | 3 Sec. 20.
