IK THE dispatches have correctly re ported Mr. Kustgard. his action in making charges against citizens of - Southeastern Aluska at Ketchikan.; without either offering proof to sub stantiate them or without retraction and apology, is enexcusable. It is all the more reprehensible because it fol lows so mauy similar outbreaks and a long series of insinuations and inucn do that have involved the reputatlous of scores of people of Southeastern Al aska who have uot been given oppor tunity to defend themselves. The highest conception of the duties?, of a prosecuting officer requires that ( he exercise the same character of zeal in protecting the good names of citi- ] zens from wrongful attack as he dis- ; plays in the prosecution of those whom < he believes have violated the law of i . the land. No prosecuting attorney has < the right to make charges against men < that amount to accusation of crime un- | less he is ready to proceed against those accused. A prosecuting attorney who is so anxious to secure convictions that he charges other officials and citizens with stacking the cards on him in an unlawful manner every time he is de feated is a menace to a community. The Empire has said not a little about i the looseness of the manner in which ( newspapers and individuals sometimes | accuse people of faithlessness. It is even more abhorrent for a public offi- ( ciai?particularly for the legal adviser j of other officers and a prosecutor?to make such charges unless he is pre- i i pared with the proof to substantiate them. The law makes it libel for a news paper to say that a man has committed crime in the absence of his conviction. While it may not be libel or slander for a prosecuting attorney to attack men. in the course of court proceed ings. to the point of charging crime, the same moral principle which caused the people to make it unlawful for newspapers to do it is involved. EXPOSING A CONSPIRACY. I I SENATOR JOHN W. KERN, of In diana. the Democratic leader in the United States Senate, is credited with exposing the newspaper conspiracy at the head of which is William R. Hearst and John R. Mc Lean. to discredit President Wilson ind his Cabinet. Among other things, he read to the Senate this telegram from the Cincinnati Enquirer that was sent to newspapers in Indiana, the awners of which were personally friendly to John R. McLean: * "Please file early Friday eve ning 300 words showing unfavor able sentiment your section to ward President Wilson's stand on the Panama Canal tolls. In terview big business men and get them to say something hot." Senator Kern said that similar tel egrams were sent by Hearst newspap ers to editors and publishers that Hearst and his editors knew. The fa vorable answers received were ex changed and published simultaneously In the eleven daily newspapers the two men control, and in other papers that they could induce to handle them. ? *; CHURCH NOTES *- *| Trinity Episcopal Church.
