The last railroad decision of the
Supreme Court the one of the Town
of Durham vs. the Railroad, involv

brief notice given at the tune the
wiine was rendered. '
It is a case of vast importance to
our citizens. "., ;
ITndor the decision in Chatham,
the Richmond & , Danville Railroad
Company were at liberty to com
wletely obstruct Poabody street, and
if there was occasion for it, ruin the
improvements put upon it. '
On the trial in Chatham, the Judge
allowed jthe Railroad Company to
"read and comment to the jury the
charter of the North Carolina road
. without introducing it in evidence.
This gave to the Railroad Company
the last speech to the jury, and they
fully availed themselves of it by a
fierce and violent assault upon the
Town of Durham and every one con
nected with it. The verdict of the
jury can only be accounted for on
the ground that they were carried
away by this unprovoked and unau
thorized assault unon the cood char
acter of the town. The counsel for
the Riiilrond Company would not
have Indulged in this gross abuso of
t1 tw:i if counsel for the town
cn.ill have replied. TJio decision of
the Supremo Court puts tne case dock
just where it was before the last trial
in Chatham, and we'now confidently
expect that the town will be success
ful, -v ".' v
We shall always be thankful that
our case was tried before uh up
right, able and impartial Judges as
now compose our Supreme Court, for
a decision adverse to the town would
have been disastrous to the entire
community and ruinous to some of
our best citiiens. The Town of Dur
ham is not alone interested in this
suit, for almost every town built on
a line of a railroad has street in the
same condition as lVabody street.

The colored excursionists that went
to HuHownye station yesterday had
quite an exciting day of it. Sme of
the crowd from here started a game
' of ball with nine of the country ar
kira, and they had not been flaying
long before smte dispute arns about
the gnme. , Fwtohs knives, raxors,
base ball bate and other things were
used and there was a general row.
One of the fellows from Durham,

through the shoulder and one of the

There were several fusses during

hair and threw rocks and screamed

of Christ Church In that city, has
not yet awpfc-d the coll to Ibdeigh.

At a meeting of the. churchmen pf
St. Philips' Parish, held last evening,
the following vestrymen were elected
for the ensuing year;
W. L. Wall, W. E. Foster, W. A.
Guthrie, W. J. Griswold, J. R. Renn,
W.'B. McGary, T. H. Martin, E. G.
Lineberry and L. W. Wise. ,
Mr. Wall was elected Senior War-
dan and Mr. Foster Junior Warden,
and also Secretary and Treasurer.
