Whereas, the South West Improvement Company, a corporation organized and ex isting under, and by virtue of, the laws ol the Territory of Arizona, is about to con struct an irrigating canal for the irrigation 01 lanus in anu adjacent to the Village of Yuma, which said construction of said canal will be .of material beneiit to said Village, and, whereas, the said South West improvement Company has agreed with tiie Village of Yuma to commence eon- onuniuii ui sum canai within one vear from the 30th day of December, A. D. 181)5, and to do and perform twelve per cent, of the total work necessary for the con struction of said canal on or before the 30th day of December. A. D. 1307, and to do and perform twelve per cent, of the total work necessary on each succeeding year after the said 30th day of December, A. D. 1S07, until completed. Now, therefore, be it or dained by the Mayor and Common Council of the Village of Yuma, Territory of Arizona. Section 1. Should the said South West Im provement Company, its successors or as signs, fail to commence the construction ol said canal within one year from the 30th day of December, A. D. 1895, or fail to do and per form twelve per cent, of the total work necessary for the construction of said canal on or before the 30th day of December, A. D. 18D7, or shall fail to do and perforin twelve per cent, of the total work necessary on each succeeding year after the said 30th day of December, A. D. 1397, until com pleted, or shall fail to do and perform any and all of said obligation?, then the lands embraced within the right of way acquired by said South West improvement Com pany by the disposal of said lots and blocks as set out in this Ordinance shall revert to said Village of Yuma absolutely. Sec. 5. Upon the procurement of a com plete right of way for said irrigating eanal alleys, vacant Jots, or in sheds, wagons, or empty railroad cars, or who s.hall be found trespassing upon private premises, without being able to give satisfactory account of themselves; or who shall go from house to house, or upon streets, or any other place in said village, begging for themselves; or who habitually loiters and hangs around saloons, bar rooms, bawdy houses, and live without emploj'mcnt, and without visible means of support, shall be deemed guilt' of a misdemeanor, and upon convic tion thereof shall be punished by a fine of not less ihan $10 nor more than $50,togcther with the cost of prosecuting, "and upon failure to pay the same, shall be committed to the custody of the village Marshal, who shall cause such person to work upon the public streets, buildings, or public works of said village until such tine and costs shall be paid at the rate of $t for each day, for each dollar of said tine and costs. Sec. 2. That in Case any person or per sons, so convicted and sentenced, ?.nd who shall refuse to work on said public works, buildings or streets, except on Sundays, or other public holidays, to so pay the tine and cost imposed upon them, shall be placed in the village jail and there held in confinement, and on bread and water alone for double the number of days he may re fuse to work to so pay his fine and costs, or until he shall so work on said works, streets, or bublic buildings. Sec. 3. Any person who shall attempt to escape from the custody of said village Marshal, while at labor, and under his superintendence to discharge any fine and cost imposeed upon him. shall be deemed guilty of a misdemeanor, and on conviction shall be fined not exceeding .?50. Set. 4. It shall be the duty of said village Marshal to see that any and all persons committed to his charge and custody for labor on the public works, of said village, or on the streets to pay any tine and cost imposed on him or them, shall be kept at labor for eight hours per da', Sundays and public holidays excepted, until such fine and cost shall be paid, and during such time he shall use alt such precaution as may be necessary to keep such persons from escape and at work until lawfully re leased; Sec. 5. Ah Ordinances and parts of Ordi nances in conflict with this Ordinance be and the same arc hereby repealed. Sec. G. Be it ordained by the JIayor and Common Coun cil of the Village of Yuma, Territory of Arizona: Section- 1. The right of way for ah Irrigating Canal to be constructed by the Sor tli Weit Improve ment Company, a corporation organised and exist ing under and by virtue of the laws of the Terri tory of Arizona, i3 hereby granted to said Company, its successors or assigns, across the streets -nd alleys of the Village of Yuma, and acrass blocks, 128, 127, 128 129, 13 i:0, 151, 132, 1G3, ICt ami 153, of said Village as per the oiruial map thereof, in accordance with tne present existing survey of said Canal said right of way to be one hundred feet wide on each side of the center line of the permanent location of said Irrigating Canal, as how or hereafter to be made, together with all necessary width of em bankments, excivation and waste, slopes and banks. The Tunnel line, as show n in the survey of said Canal, shall be at least 120'J (twelve hundred) feet, lung and shall extend 603 (six hundred) feel on each side of Orange Avenue in said Village of Yuma. Said right of way being granted siibject to the conditions hereinafter expressed, and provided thh ordinance does not convey or purport to convey any surface right of way, along said tunnel line above set out. Section- 2. In the construction of said Canal, said South West Improvement Company, its successors or asiigns, shall keep free from dirt or other ob structions, arising from the construction of said Canal, all streets ever which said Canal ma3- be constructed, retaining the then existing grades of said streets, and shall, when so required by the Village Common Council of said Village of Yuma, construct, as part of the roadway of any street over which wid Canal crosses, a bridge of the maximum width of 20 twenty feet, substantial for all purposes of foot and team traffic, and conforming with the then existing grades, Section-3 The said South West Improvement Company, its successors or assigns, on the penaTty of forfeiture of all rights under this ordinanoc, shr.ll commence the construction of said Canal within one year from the date hereof, and shall construct at least live miles of said Canal every year there after.
