Loonej vs. O. K. Nesbitt. The State of Nevada sends greeting to O. K. Nesbitt. You are hereby required to appear in an ac tion commenced against you as defendant, by John E. Jonea, J. D. Sullivan, J. H. Sullivan and Ed. Looney as plaintiffs, in the District Court of the Sixth Judicial District, in and for the county of Eureka, State of Nevada, at the town of Eureka, and answer the complaint therein, which is on file with the Clerk of said Court, within ten days after the service on you of this Summons (exclusive of the day of ser vice), if served in said county, or twenty days if served out of said county but within this district, and in all other cases forty days; or judgment by default will be taken against you. according to the prayer of said complaint. The said action is brought to recover judg ment against you the said defendant, for the possession, restitution and recovery of that certain premises and mining ground known as the Enterprise mine or mining claim, situated on the east side of Prospect Mountain, in Eureka Mining District, Eureka County, Nevada, from the possession whereof plaintiffs allege you have unlawfully and wrongfully ejected them ; and also, for the sum of one thousand dollars ($1,000) damages for the withholding of said premises, and for costs of suit. All of which will more fully appear by reference to the com plaint on file in this action, to which refer ence is hereby made. And you are hereby notified, that if you fail to appear and answer the said complaint as above required, the said plaintiff will pray the Court for the relief demanded in said complaint.
