The said action is brought to recover Judg ment against you the said defendant, for the possession, restitution and recovery of that certain premises and mining ground known as the Enterprise mine or mining claim, situated on the east side of Prospect Mountain, in Eureka Mining District, Eureka County, Nevada, from the possession whereof plaintiffs allege you have unlawfully and wrongfully ejected them ; and also, for the sum of one thousand dollars ($1,000) damages for the withholding of said premises, and for costs of suit.
