withdrawn pending a suit in oourt com
menced by the adverse claimant.
An application for patent will be rejected
when the surrey does not aocurately de
fine the boundaries of the claim.

Publication of notice must be made In
only one uewspaper for the period of *isty

Where the Register designates the daily
i**uu of a newspaper for publication of
notice* of a mining application for paUut,
it la not» compliance with law to change
to the weekly edition of the aame paper
without autboiity of the Register.
The existence of a salt spring on a traet
of land withdraw* it from th* operation of
the homestead and pre-emption laws. A
bearing for the purpose of proving the
agricultural character of such land i* not
allowed. Land containing valuable de

mining Act*.

cannot be withdrawn, but become a part of
the record.

larger portion of the premise* than that

claim and in regard to expenditures, and
shall file a copy of the original notic* of

Where valuable depoeita of mineral are
discovered upon a tract after the aame haa
been entered aa agricultural, but before
patent has been issued. the parties claim
ing the mine may make application for
patent for same, aud the agricultural entry
will be canceled to tbat portion of the land
embraced by said mining claim.
Where mineral deposits arc discovered
on agricultural lands after the patent haa
been issued to an agricultural claimant,
they paaa with the patent.
