The constitution, in providing for the election of Justices to nil vacancies, it quite blind, come good lawyers interpreting that the Justice in elected to serve ten years, whether his predecessor had served hie fall term or not, and others hold that a Judge who is sleotsd to fill a vaoanoy, occasioned by death, only serves out the unexpired term of his predecessor. At about 9 o'clock lust night, says the Eureka Sentinel, of the 29th, a man named O. Peterson died suddenly in Pete Esterley's dunce-house on Korth Buel street. He entered the house apparent ly in good health and spiritB, conversed freely with those present, and, we be lieve, invited all hands np to take a drink. Shortly after the drinks bad been served, he called to the manager to have the musicians play a schottische, which request was about being complied with, when be threw up bis bunds as K to sig nal the musicians to discontinue playing. He tnen moved rapidly to tne sidewalk. but soon returned and asked Mr. Ester Icy to get him some salt. At this time some of the bystanders observed blood issuing from his mouth. Esterley has tened to get him a handful ot salt. which the afflicted man proceeded to swallow, in tbe mean time calling for more, which was promptly furnished. He then made another eflort to Rum the sidewalk, but just as ha had passed out of doors be sank, and would have fallen to the ground, had he not been caught and supported back into the building. He was placed in a sitting pontnre against tbe wall, in wbicb position be remained until after the arrival of Dr. Callahan, who bad been sent for. Deceased was a large and apparently stout man, though we are informed that he was greatly troubled at times with his lungs. He He was unmarried, and probably abont 40 years of age. We did not learn his nativity. Deceased was an Odd Fellow, under the auspicies of which organiza tion be is to be buried. William Stcthidoe, who, it will be remembered, accidentally shot his little son on the 3d instant, thereby causing his death, died himself last Saturday evening, says the Gold Hill News of Monday, of a broken heart. Ever since the sad accident occurred, tbe father, constantly tormented with grief and re morse, has been slowly pining away with beart sickness, lypboid lever seized upon his system, worn out by nervous excitement, and completed tbe work of destruction. Let it be boped that be bas been permitted to join his idolized child in tbe spirit-land, with full assurance from the all-wise Father, of pardon, peace and final reconciliation. The de ceased was a native of Cornwall, England, and at the time of bis deatb was twenty three years of age. He leaves a wife in destitute circuuiatnue.es. The family emigrated to the United States eleven months ago. Mr. Stntnclge c parents are still living. Two sisters of the de ceased reside in California. The funeral took place from bis late residence this af ternoon. We are informed, says the Virginia Chronicle of Monday, that the trial ot Oeorge W. Hutchinson, for rape on the person ot Miss Ada Weaver, at Silver City, some weeks ago, will be commenced in the Third District Court, at Dayton, to-day. Hutchinson was a conductor on tbe Central Pacifio Railroad in tbe east ern part of tbe State, and became ac quainted with Miss Weaver on the road. we understand tnat ne came to Oliver City at her written solicitation, and was tbere two or three days before the com plaint was made. Miss V eaver, wbo is 27 years of age, was aent ont by her father from Michigan in company with a vouncer-brother, in tbe hope that in our dry and ozoniferous atmosphere she would recover from a severe case of ca tarrh in the head, with which she has been troubled for years. She bas grown worse, however, and it is doubtful if sb will be able to appear in Court to-day Hutchinson has been acquitted. J A San Fbakcisuo exchange publishes the following report of the condition of the Eureka Consolidated, as ascertained through a letter from the Superintend' ent to the Directors of the Company The mines are looking quite well to-duy, returning home from Virginia City, in company with two other ladies, the niah wheels of the wstfon in which they were seated dropped into a rut in the vicinity of the Sutro ofnoe, on Washington street, precipitating Mrs. Welsh to the ground and breaking her left arm at tha elbow. Tbe lady was conveyed to the residence of a friend on O street, and the neces sary snrgicsl aasistanees was rendered by Drs. Heath and McMeans. For come time past at Derby k Oar hart's stables, in Virginia City, a novel invention has been made nee of in clip ping horses. By tbe new process a horse can be entirely shorn of superfluous hair in two hours' time. Tbe machine is com posed of a set of knives whieh are made to revolve rapidly by means of a crank turned by a man stationed some 10 or 12 feet from the horse, the revolving mo tion being transmitted to the knives by meana oi a neit. Tub News ssys: P. M. Holmes, a man very highly esteemed in this community, died at C o'clock this morning of billious fever, after but brief illness. The de ceased was a native of Ireland, aged 39 years. He leaves a wife and two young children to monrn his loss. He waa a ember of the ((old Hill Miners' Union. His funeral will take place to-morrow ( Tuesday ) afternoon at ay, o'clock. under the auspices of the above named society. Fnox Mr. Oberfelder, lately in from Robinson district, tbe Sentinel learns that matters over that way are fearfully dull. He is of tbe opinion that the Hayes mill could be made to psy hand somely if the parties who have control of it had the capital to keep it in opera tion in the proper style. It is now idle. owever, and will remain so until Super- tendent Ellmore rturns from San Francisco. Tim Gold Hill News of Monday says Johnson, convicted of assault with a adly weapon with intent to do great bodily harm, will be sontenced to-mor row morning at 10 o clock. The trial of Nagle, indicted for assault with a deadly weapon with intent to commit murder, is set for Wednesday next. We regret to leaan that Chief Jones' recovery was not entirely effected by hie visit to ths Warm Springs. For some me past be bas been confined to his room, and was only able to be oat for the first time to-day. So says the Gold Hill .News. W. L. Pbitchabd shipped from Han' ka, on Tuesday, for the Richmond 60, 000 of bullion, and for the Euby Consol luaiea ou,uuu pouuus. AOiai, uu,uuu pounds. A Mint for Utah. The Utah Mining Gazetto discusses the question in a very candid manner, and concluding an arti cle ou the subject, says: A branch mint here would have to rely solely on the buiilon product of our own territory, as tbe bullion of Idaho, Mon tana and Pioche is shipped to New York, and there drawn against, and it is ex tremely doubtful whether our own un ited productions, witbont the erection of additional refining works, would be Biifhcient to keep a mint running. Unless these ideas are erroneous and proved to be so, we shall incline to the opinion tbat a or line ti mint is not so desirable as some plan by which our miners and min ing companies can speedily dispose of ore aud bullion at fair prices, for cash on de livery. In the Lawton the improvement is in the promise of a winze we are sinking from near the east end ot an east drift, that has been run in rich ore. It has been sunk 20 feet, and has carried excel lent ore its full size all the way. In the Winnsau the ore body near tbe surface is increasing in size as we work east upon it. The new find, mentioned ft few days ago, is at present about one and a half feet wide. Mb. Reishabt, of Elko, was in town few days since, says the Eureka Sentinel, He still has hope that the Elko and Ham ilton Narrow-Gauge will be built. Salis burv's excuse for non-action now is that tbe great financial panio at the East knocked all of his negotiations square in the head. He was in Elko Monday, and telegraphed Mr. Keinbart to meet him at Paisade yesterday.
