The colored people were thus put npon
an equably before the law with the white
population, so far as their civil and po
litical rifihis come in question. Now,
what were the civil rights which the
plaintiff acquired by the purchase of her

acquires under the same circumstances;

right to refuse, but in the discharge of
his duty to the other passengers, ho is

cer is a matter which may depend large
ly on the regulations of tho carrier.
When a person stops at a public inn it ia
the duty of the inn keeper to furnish
him with accommodations; but it is not
the right of the traveler to Ray that be
will have this room or that, or will sit at
this table or that, but he must take the
room or place which is assigned to him
by the iuu keeper in consonance with
the rfgnlutiona of the iuu or the exigen
cies of the occasion, ns may be reasona
ble. The tegulations of common carri
ers as to the separation of the sexes, the
separation of the smoking from the non
smoking portion of the passengers, rest
npon precisely the same grounds. In
deed, to use the language of Chief Jus
tice Dily, in a similar case, wherever
there is a feeling from some cause,
though it arise entirely from the mis
conception and prejudice of man, so
that one class will not travel with the
other on terms of equality, and that
cause is so general lit character us to
affect the business of the carrier, the hit
ter will be held justified in making such
n arrangement aa, though it may in
volve separation and distinction, will
nnt imply inferiority, but will equally
accomplish in both cases the purposes of
transportation. Whether au arrange
ment thus made is just and reasonable
depends upon the circumstances of each
ease, and is a question of fact for the
jury. This has always been the law as
regards white passengers, and conse
quently colored p isseugers can claim no
exemption from it.

the subject is that the clergy of the
Church of England are all going over to
Ritualism so fast that it ia hardly worth
while to spend muoh money in hastening

Thk Stuabts. Another of the family
which olaiins to be tha representative of
the Stuarts in this generation has just
died in London. Count Ferdinand de
Laucastio et d'Albauie, who succumbed
to an attack of congestion of tha lungs,
was a nephew of the late Von Sobieski
Smart, Count d'Albauie, and was a
young man of high attainments and
much promise. Though only twenty
nine years at the time of his death, he
had seen a large amount of military ssr
viop. During the Italian campaign of
1859, he was engaged as a cavalry officer
in the Austrian service. He was also
one of that band of personal friends of
the late Emperor Maximilian, who at
tempted to establish that unfortunate
sovereign ou the throne of Mexico. He
sustained many privations in that coun
try; and notwithstanding his health, he
volunteered into the service of the Prus
sian army during the recent Franco-German
war. He was engaged at the battle
of Oravelotte, where his bcrse was tfhot
and himself severely wonnded. lte'wus

mittee, and recently went to Spain with
his relative, Colonel Stuart of ths Deer
hound, hut returned to Loudon shortly
before his death.

vention has done a service to mankind
by denning a new crime, to wit, "bor
ing." Henceforth we have the satisfac
tion to know that there will probably be
one State in the Union, at least, where
the "bore" will be looked upon ns n
criminal. The following is the proposi
tion which has been approved in Com
mittee of the Whole in Convention:
"The practice of boring shall be defined
and punished by law, and shall iuclude
any corrupt solicitation of members of
the General Assembly, or of public offic
ers of the State, or of any municipal di
vision thereof, nd any occupation or
practice as a common borer for or against
the passage or approval of laws." The
punishment for the offense shall lie by
fine and imprisonment.
