The Cask of Lambert. The third
trial of the case of the State against Geo.
Lambert on a chargo of grand larceny
was closed about 10 o'clock Friday night
by a failure of th jury to agree upon a
verdict. The indictment was found in
July last, and charged Lambert with
stealiug two horses from It. A. Bridges.
The result of the third trial has been an
nounced. The jury in the last trial was
sworn in on Thursday morning, and by
uoon on Friday tbe testimony was all in.
The casa was opened by Mr. Handy for
the prosecution; Judge Pitzer and J. C.
Foster spoke in the order named for the
defense and District Attorney Goldth"
waito closed the argument. After re
ceiving instructions from the Court, the
case was submitted to tbe jury about 5
o'clock. After 5 hours deliberation and
being unable to agree, and with no pros
pect of nn agreement, and this state of
facts being made known to the Court by
the foreman, Bis Honor ordered that
the jury be discharged. Yesterday morn
ing a nolle prosequi wn entered in the
case, but another complaint was filed
aeninst Lambert, and he ia held in cus
tody. A preliminary examination in
this last named case waR begun yester-
aay atternoon before Justice Van ilagen
District Attornev Ooldthwaite and Mr.
Handy prosecuting, and Judge Pitzer
and J. C Foster defending. Defendant
Lambert was also present in person. The
testimony of James Pierann (tbe com-
plainine witness) and Oscar Butler was
heard, after which the further hearing
was deferred until Mondav. at b d. m
The question to be determined in tbe
Justice' Court is whether Lambert shall
be discharged or held to answer before
the Grand Jury
The dismal cloudy weather, together
with the horrible mud, renders the sea
son anything but agreeable, and if sta
tistical are not at fault we are having
in Pioche now just such v eather aa con.
tributes to increase the number of sui
cides. Viewing this state of things whol
ly in reference to the present and with
out regard to the future, it would eem
indeed that hope had bidden tbe world
farewell for a season. But, in the very
nature of things, the pelting storms
which now prevail give guarantee of a
fruitful harvest in the coming Summer.
They assure good crops of cereals and
fins pasturage for flocks and beards; and
encourage the seeker after the precious
metals, affording him the assurance that
the staff of life will be in abundance.
Reprehensible.--It has been prac
tice with many of those occupying seats
outside the bar in th Court-house, to
jump up to leave at a most unpropitious
time. A loon as it agreed to take a
recess, and while th Court is admonish
ing the jury; th crowd begin to move
out. and thereby interrupt the proceed
ings at Terr important juncture. We
are sure that no harm is meant by per
son leaving while the Court is charging
th jury, yet it is wrong, and should be
discontinued,

Foo. London is a much larger town
