8ec. a. That the locator of all mining loca
tions heretofore made, or which shall hereafter
be made, on any mineral vein, lode, or ledge, sit
uated on the public domain, their heirs and as
signs, where ho adverse claim exists at the pas
sage of this act, so long as they comply with the
laws of the United Mtates, aud the State, Terrl.
torial and local regulations not in conflict with
said laws of the t nited btatc governing their
posHcawiry titlo, shall have the exclusive right of
possession and enjoyment of all the surfuce in
cluded mtbin the lines of their location and of
all veins, lodes, and ledges throughout the entire
depth, the top or apex of which lies innide of
such surface-lines extended Qownwsrd Vertical
ly, although auch veins, lodes or ledges may so
far depart from a perpendicular in their cotire
downward as to extend outside the vertical side

and canal owner over the public lands, and for

huudn-daiid seventy, shall be and remain in
full force, except as to the proceedings to obtain
a patent which thall 1 similsr to the proceed
ings prescnlietl by sections six and seven of this
s t for obtaining patents to vein or lode claims;
but where said placer-claims shall be upon sur
veyed lands, and conform to legal subdivisions,
no further survey or plat shall be required, and
all placer mining claims hereafter legated shall
conform as near as practicable with the I'nited
states, svhy, m of public land surveys and the
rectanpular suUiivislons of such surveys, and
no such location tbiill include more than twenty
acres for each individual claimant, but, where
placer-claim cannot be conformed to legal sub
division, survey and plat shall be made as on
uuKiirveytd lauds: Provided, That proceeding
now pending may be prosecuted to their final
determination under existing laws; but the pro
vision of this act, when not in conflict wilb ex
isting liiws, shall apply to such cases: And pro
vided also, That whereby the segregation of
mineral land in any legal subdivision a quantity
of agricultural land lts than forty acres re
mains, said fractional portion of agricultural
land may be entered by any party qualified by
law. for homestead or pre-emption purposes.
Sep. 11. That where the same person, associa
tion or corporation iu possession of a placer
claim, and slso a vein or lode included within
the boundaries thereof, application shsll be
made fi-r a patent for the placer-claim, with the

in such ease (subject to the provisions uf this
act snd the act entitled "An act to amend an act

extent as if discovered from the surface; and I
locations on the line of such tunnel of veins or
lodes not apiwaring on the surface, made by
other parties after the commencement of the
tunnel, and while the same is being prosecuted
with reasonable diligence, shall lie invalid; but
failure to prosecute the work on the tunnel for
ix monthB shall be considered as an alumdou
ment of the right to all undiscovered veins on
the line of said tunnel.
Hkc. 6. Tlut the miners of each mining dis
trict maymake rules and regulations not in con
flirt with the laws of the I'niUd States, or with
the laws of the Htate, or Territory in which the
district is situated, governing the location, man- '
ner of recording, amount d work necessary to
hold possession of a mining claim, subject to
the following requirements: Location niiist li
distinctly marked on the ground so that its
boundaries can le readily traced. All records of
mining claims hen-alter made shall contain the
name or names of the locators, date of the loca
tion, and such a description of the claim or
claims located by reiereiienoe to some natural
object or permanent monument as will identity
the claim. On each claim located ufUT the pas
sage or this act, anil until a patent shall have
been issued therefor, no less than one hundred
dollars worth of labor shall be performed or im
provements made during each year. Uu all
claims located prior to the passage of this
act, ten dollars' worth of Inbor shall
be performed or improvements made
each year for each one hundred lent
iu length along the vein until a patent shall
have been issued therefor; but where such claims
are held in common, such expenditure may be
made upon any one claim; and upon a failure to

That the original locators, their heirs,
assigns, or leRul representatives, have not re

the co-owners who have performed the labor or
made the improvements may, at the expiration
of the year, give such delinquent co-owner jier

Hec. 0. That a patent lor any land claimed
and located for valuable deposits may be ob
tained In the following manner: Any peiwm,
association, or corporation authorized to locale a
elaiui under this act, having claimed and located
a piece of land for such purposes, who has, or
have, compiled with the terms of this act, may
file in the proper laud-office an application for a
patent, under oath, showing Bitch compliance,
together with a plat and nVld-note of the claim
or claims in common, made by or under the di
rection of the I'nited Mates Surveyor General,
showing accurately the boundaries of the claim
or claims, which shall bo distinctly marked by
monuments on the ground, and Bhall post a copy
of such plat, together with a notice of such
application for a patent, in a conspicu
ous place on the land embraced in such plat pre
vious to the filing of the application for a pat
ent, and shall file an affidavit of at least two
persona that such notice has been duly posted as
aforesaid, and Bhall file a copy of said notice in
such land-office, and shall thereupon be entitled
to a patent for said land, in the manner follow
ing: The register of the land-orhce, upon the
filing of such application, plat, field-notes, no
tices and affidavit, shall publish a notice that
uch application has been made, for tho period
of aixtv davs. in a newspaper t je by him desig
nated as published nearest to said chum; aud he
iikii also nost such notice in his office for the

In the sixty days of publication, shall file with
the register a certificate of the United State
Surveyor Oeneral that five hundred dollars
worth of labor has oeen expended or lmprove

ters; that the plat is correct, with such further
description by such reierence to natural oojeciB
or permanent monuments as shall identify the
eiaim. and furnish an accurate description, to be
incorporated in the patent. At the expiration of
fth sixty days of publication the claimant shall
.! his affidavit, showing that the plat and no
t.ea have been posted in a conspicuous place on
the claim during aaid period of publication. If
no adverse claim shall have been filed with the
regieter and the receiver of the proper land-offioe
at the expiration of the sixty days of publication
It ahall be assumed that the applicant is entitled
to a patent, upon the payment to the proper of
ficer of five dollars per acre, and that no adverse
etalm exists; and thereafter no objection from
third parties to the imnance of a patent ahall be
heard, except it be shown that the applicant baa
failed to comply wun mis ace.
Sec. 7. That where an adverse claim shall be
filed during the period of publication, it shall be
noon oath of the person or persons making the
same, and thai! show the nature, boundaries,
and extent of such adverse claim, and all pro
ceedings, except the publication of notice and
making and filing of the affidavit thereof, shall
be stayed until the controversy ahall have been
settled or decided by a court of competent juris
diction, or the adverse claim waived. It shall
be the duty of the adverse claimant, within
thirty days after filing his claim, to commence
proceedings in a cmirt of competent lurisdiction
to determine the question of the right of posses
sion, and prosecute the same with reasonable
diligence, to final judgment; and a failures" to
do ahall be a waiver of his adverse claim. After
such judgment shall have been rendered, the
party entitled to the possession of the claim, or
any portion thereof, may, without giving fur
ther notice, file a certified copy of the judgment
roll with the register of the land office, together
with ths certificate of the Surveyor-General that
the requisite amount of lator has been expen
ded, or Improvements made thereon, and the
description required In other cases, and shall
pay to ths receiver five dollars per acre for his
claim, together with the pi oner fees, whereupon
the whole proceedings and the judgment-roll
shall be certified by the register to the Commis
sioner of the Osseinl Land-Office, and a patent
shall lssuw thereon for ths claim, or such por-
vein or lode claim, shall be puid for at the rute j
of two dollHrh and fifty rents per acre, together I
with all costs of proceedings; and whereavefn or !
lode, such as descrilied in the second Bection of :
lhit act, is known to exist within the boundaries
of a plLcer-claim, an application for a patent for
such placer-claim, which does not include an ap
plication for the vein or lode claim, shall be
coniitnif-d an a conclusive declaration that the
cla mailt of th: placer-daim has no right of pos-Kt-Kfiion
of the vein or lode claim; but where the
existence oi a vein or lode in a placer-claim is not
known, a patent for the placer-claim shall convey
all valuable mineral mid other deposits within
th- boundaries thereof.

The Commissioner of the General Laud-Office
shall also have power to establish the maximum
charges for surveys and publication of notices
under this wet; and, in case of excessive charges
for publication, he may designate any newspaper
published in a land district where mines are
situated, for the publication of mining notlcce
in such district, and fix the rates to be charged
by such pup r; and, to the end that the (kuuiuis
sionemiiiy le fully informed on the subject,
each auniicaiit shall file with the Register a
sworn statement of all charges and fees paid by
said applicant tor puuiicauon ana surveys, io
gether with nil fees and money paid the Resister
and lieceivt r of the land-office, which statement
shall be transmitted, with the papers in the
case, to the Commissioner of the General Land
OiuYe. The leefl of the Register and the Re-
ce Wer shall be five dollars each for filing and
acting upon each application for patent or ad- j
verse claim filed, and they shall be allowed tho !
amount fixed by law for reducing testi
moiiy to writing, when done in Land Office, such ,

to A. Sutru the right of way and other pnvtlrges
to aid in the construction ot a draining and ex
ploring tunnel to the Comstock Lode, In the
State of Nevada," approved July 2olh, 1H66.
Sr.r. 13. That all affidavits required to be
made under this act, or the act to which it is
sniendutory, may be verified before any officer
authorized to administer oaths within the laud
district where the claims may lie aitusted, and
all testimony and proofs may be taken before
any such otlicer, snd, when duly certified by ths
officer tskiug the same, shall have the same force
and effect lis if taken lielbre the Register and
Receiver ol the Land Ouice. In cases of conteat
ss to the mineral or sgricultural character of
land, the testimony and proofs may be taken aa
here in provided, on personsl notice of at least
ten days to the opgiosing party; or if said party
cannot be found, then by publication of at least
once a week for thirty days in a newspaper, to be
designated by the Register of the Land Office aa
published nearest the location of such land; and
the BeQistcr shsll require proof that sued notice
haa been given.
Sec. 14. That where two or more veins Inter
sect or cross each ether, priority of title shall
govern, and such prior location shall be entitled
to all ore or mineral contained within the space
of intersection: Provided, however, That the
subsequent location Bhall have the rielit of way
through said space of Intersection for the pur
poseses ot the convenient working of the aaid
mine: And provided also. That where two or
more veins unite, the oldest or prior location
Bhall take the vein below the point of union, in
cluding all the space of intersection.
Bkc. 15. Tost where non-mineral land not
contiguous to the vein or lode is used or occu
pied by tlte proprietor of such vein or lode for
mining or mtlliug purposes, such non-adjacent
surface ground msy be embraced and included
in an application for a patent for such vein or
lode, and the same may be patented therewith,
subject to the same preliminary requirements
sa to survey and notice as are applicable under
thia act to veinfl or lodee: Provided, That no
location hereafter made of Biich non-adjacent
land ahall exceed five acrea, and payment for
the same must be made at the same rate aa fixed
by thia act for the auperncies of the lode. The
owner of a quartz mill or reduction works, not
owning a mine in connection therewith, may
also receive a patent for hla mill-site, as provi
ded in this section.

sistent herewith are hereby repealed : Provided,
That nothing contained in thia act ahall be con
strued to Impair, In any way, righta or Interests
In raining property acquired under existing lawa.
