THE LYON OOONTY TIMES Liability of Express Compa nies.—Judge Ballard, of tho I nited States Circuit Court at Louisville, Kentucky, has recently decided a case involving the liability of ex press companies for money lost in transportation. The case is substan tially as follows: A package of $13,528 was intrusted to Adams ex press company at New Orleans, to be delivered to the Hank of Ken tucky, at Louisville. On its transit tht express-car tell through the bridge at Buddo creek, and the con tents was destroyed by tire. Under the ordinary contract the expresss company stipulates that it will not be responsible for loss by fire, but the bank claimed its liabilities tin der the law governing common car riers. The court in substance says: “ Now, upon these principles no one is responsible for the damage occasioned by neglect of himself or his servants or agents. But the facts stated show that neither the compa ny nor its servant was guilty of any neglect. It follows that the defend ant cannot be charged on this ac count. Though the defendant used the Louisville and Nashville railroad to transport its messenger and the package tho railroad company was not, in any legal sense, the servant of the defendant. The defendant has no control over the railroad compa ny or over its servants. The rail road company was no more tho ser vant of the defendant than it is of anv passenger whom it transports. It was no more tho servant of the defendant than is the hack or cab the servant of him who hires it to transport him from one part of the city to another.” To Eureka.—Hon. J. C. Har.lett and Hon. ffm. Woodburn lelt for Eureka on this morning's stage. We are glad to know that the distin guished gentlemen were favorably impressed with our little town, and that they express themselves as much gratified with the hospitable reception accorded them. A stranger entering Austin in the gray of the morning, tired from an all-night ride, is not apt to form a very ex alted idea of the town, but first im pressions are removed when the stranger gets a chance to stretch his legs and perambulate around. Of course, Austin would not make a ramrod for Virginia, but as a steady’ little camp it will compare favorably with any in Nevada. Wo are pleased to note that both gentlemen made many friends during their stay. Dr. Hazlett Is a man who, by his genial manner and kindly way's, must make friends wherever he goes. A Smart Man.—He never gets drunk. That’s the kind of man ho is. He says so, and he ought to know. He was seen, however, the otner evening, in close conversation with a lamp-post. He informed the lamp-post that he was an ill-used man. All his friends had proven untrue, his love had deserted him, his washerwoman had refused to trust him, and he had nothing moro to live for. Wasn’t he right? The lamp-post did not say anything; but just then it got slippery, and ho couldn't hold it any longer, and he reclined in the gutter. As he pil lowed his head on the curbstone ho said: “Can’t fool me. Not much. I’m smart enough, I guess. Ain’t I right?" And he slept the sleep of innocence, and sweet forgetfulness, and bad whisky. Accident.—Friday, while an Ital ian vogetable man was in the act of driving up a steep hill on one of tho back Htroets of I.ower Gold Hill with a heavy load of vegetables, his horses got tuckered out to such an extent that they could not hold the load. The outfit went down the hill again, upsetting the wagon and pre cipitating au avalanche of turnips, potatoes anc^ cabbages, upon the affrighted people residing in the ravine below. Messrs. E. L. Pierce, William Claflln and Estei Howe, having been appointed to appraise tho estate of the late Charles Sumner, report the amount of real estate at $40,500, and the personal estate $94,258 89. His library, containing about 8,000 vol umes, including rare books with autographs, specifically bequeathed to Harvard College, is valued at $12,340 96.
