A r. r\t-% i uA3 STATE NZWS Claim a Cortina of the Town of tiarriinn. An important ejectment suit has been filed in the Boone county cir cuit court. It is for the possession of a large tract of land on which the town of Harrison is situated. Including the west side of the public square •ad a large number of residence*. The claim ants are the children of the lately deceased Lo renzo D. Kush and Capt. W. F. Pace. Pace having purchased the Interest of some of the heirs. L. D. Rush received a patent on June STT. 1863. from the government for the prop srty in question. January 27. 1809, Lorenzo D. Rash, being a widower, made a deed to his son. Lorenzo D. Hush. Jr., conveying him this land. Lorenzo D. Hush. Jr., died March 19. 1870. un married. and without* issue. March 30, 1870, Lorenzo D. Rush. Sr., executed a deed convey ing said land to another son. John H. Rush, and the citizens of Harrison now hold their lands under deeds from John H. Rush. AL.I,E'iEI> MERITS OF THE CASE. Under the laws of Arkansas, when Lorenzo V. Rush. Jr., died without children, the land would go back to his father. Lorenzo I> Rush. Sr. The question now Is what kind of an estate did his father take, whether an estate for life nr in fee simple. That depends upon whether the t-ansfer of the kind from Lorenzo D. Rush. Sr., to Lorenzo D. Rush. Jr., was a transfer of the property upon a consideration or whether it was a gift. If he transferred it to his aon, and the son paid him a consideration for It, it would be anew acquisition under the law. and at the death of the son a life estate would revert to tile father, and after his death then go to the brothers and sisters of the said Lorenzo D. Rush. Jr.; but if the father made a gift to the non, then at the death of the son the title would revert to him in fee simple. THE M A IN CONTENTION. So the main contention in the case Is as to the character of the transfer. If it wn* a gift by the father to the son. then he had a right to transfer it to John Kush, his son. and John Busn would have a right to transfer it to any one. and the citizens would, therefore, be se cure in their titles. The property involved is estimated at £500.000. It is claimed by the citi zens of Harrison that the transfer was a gift. Drowned by Men of Ills Own Race. Says a dispatch sent from Little Rock: Barnet Brown, colored, was lynched by a crowd of seven or eight negroes near Wrightsville in a very un usual manner. Brown had been living with another man's wife, the husband having left her. The husband returned a few days ago. and got some of his neighbors to help him avenge himself on Brown. They took Brown into the woods, stripped him. and, after whip ping him. took a rope and tied iron tastings to him. after which he was thrown into a mill pond and drowned. Awful Domestic Tragedy. A double tragedy was enacted in Shaw township, near Benton. Saline county, the other night. A farmer named Smith, white, about 40 years of age, and wife had decided to separate. They had five or six children, and when they came to divide their offspring they quarreled. The quarrel resulted in Smith butchering his wife. When he thought she was dead he shot himself in the head with a pistol, dying in stantly. Mrs. Smith was alive at last accounts, but she can not recover. Total I.oh*. Two frame business houses and their contents were destroyed by tire at Jonesboro. The building were owned by A. S. Nash and I)r. W. I,. McCool, and were worth $1,000. They were oc cupied by Miller <fc Son. meat market; 1*. A. Matcher, confectioner and fruit dealer, and II. D. Miller, clothing, whose stock was valued at 81.500. Three Persons Drowned. Two women and an infant were drowned near Rismarck, in the western part of Hot Spring county. Mack Hardage and his sisters attempted to cross a small creek, which was swollen by heavy rains. They were in a wagon, and when they got into the stream the team became unmanageable, and the wagon was overturned. In Favor of a St. Louis Bank. Judge Joseph W. Martin, ir the sec ond division of the l’ulaski circuit court, awarded the Boatmen's bank of St. Louis a judgment for 8S3.957.56 against Receiver Cockrill of the defunct First national bank of Little. Rock. David A. Prior. David A. Prior, an old citizen of Mal vern. and for many years the leading undertaker and contractor of the place, died at Dalark of heart failure. Mr. I rior was 65, and leaves a willow and five daughters. The Stanley* Acquitted. I- rank and Tom Stanley, who were arrested and placed in jail at Pine Bluff, charged with firing their prem ises to obtain St’,700 insurance, were released, the state being unable tc make a case. Fireman Die* from Hi* Injuries. Leorge Wunderlich, the fireman in jured at the First Methodist church fire in Little Rock, died from his in juries.
