The said bridge shall be construct ed on piles and piers, with an extent of water way not less than thrco thousand feet in the ji(tnre.ito on the surface,. md said bridge shall LeTit ieast forty foot wide. And the said com pany shall came to bo built and kept, and maintained in jjood repair, a convenient nnd millicicnt draw or passage way, at least seven ty lect wide in the clear, in said bridge, over tlio deepest channel of the waters of said lake, for the passing and repassing of all Vessels ami wi'cr crift, by day and by night ; and two competent agenta, at lcasl, s'tall be kepi at a I times at said dtaw, by said railroad company, tilend the same and to assist all vessels and water cralt in passing said draw, without charge; and the said company shall, at their own cost and without toll or charge, cause the said draw or passage-way lo bo hoisted or re moved, for the passage of all vc-sels and wi ter craft that are nimble, to pass under the same; and the same draw or passage way shall be kept open at all times except when it become.! necessary to clo-n tlio same in order to the passage of cars or trains, but in no case shall any vessel or craft bo detained or kept waiting for the passage of any cars or trains more than thirty minutes: anil all vessels and cralt shall pass through said draw as speedily as practicable, and in no case remain unneces sarily in said draw, thoiehy obi-tructing the passage of cars or trains over said bridge ; nnd the said conif any shall cause the 'aid draw or passage way to be constantly furnished with four good and suitable light, to be lighted in good season, and kept, burning through the night. Tho Itutland nnd llnrlington Kail Rnul Company may, within three years from the passage ol this "act, extend anil construct their road from their present terminus in H ir linglon, northwardly near the head of Mallet's tny nnd eros-ing the liamoille rivcrat, or near Mthlcy's falls, to any point or points in the town ol Svantnn, in" the county of Franklin, there lo connect with the road nl the Vermont and Cadadi It till tia.il Company ; and said Rut. land ami Iliiiliugton Riilroad Company, in the construction of said road, shall have all the right and privileges, and bo sulijrct to all the hub. lilies contaii ed in their nrigiual charter, and the acts in addition thereto ; and the act in addition to an act incorporating the Rutland and Rurlinglon Roalroad Company, npproved November U, 181!), is hereby repealed, Sec.!). The Rutland and llnrlington Rail road Company shall notify the Vermont and Canada Raihoad Compiny of their point or points of connection provided h.r in tho prece ding seclion; and if tho Vtrmont and Canada Railroad company shall decline to widen their road bed and bridges and lay another track thereon, fioin such punt or points of connec tion to the western terminus of thoir road, for the benefit of both companies, then llio Rutland ami llnrlington Railroad Company may, at their own e.pen-e, so widen such road bed, anil bridges and 1 -ty another track thereon, to said western terminus, for tho convenience and lienelit of both Companies. And if said com panies cannot agree as to the amount of com pensation to be paid by the Rutland and l!ur lington Riilroad Company to the Vermont and Cinada Ra lroad Company for the privileges of so widening said :o.id bed and bridges and lay. ing said track, then the commissioners provided lor in section seventh, shall determine the hame, and the manner nnd time of its payment. Sec. 10. When the said tracks shall bo com pleted, if tlio paities in interest cannot agree, the commis-ioucrs provided for in section seventh, shall establish the rules and regula tions, orders, and rates of toll nnd compensa tion for running tin same, and may appoint a competent disinterested superintendent to exiv cute the saipo for tho host interest of both com panies, wdiose salary shall bj equally paid by both companies. Sec. 11. All railroad companies which may be chartered by the legislature to connect with the Vermont and Canada Railroad Company at Swanton, shall ha'-o the right li ua the aforeaid track", under such rules, lobulation;, orders, rates of toll and compensation as the commissioners provided for in section seventh shall establish. Sec. V2, Tho owners of land and property laying upon the Landers of Lake Chimplain, may, in any action on the case, recover of the Vermont and Canada Rail runt! Ho came hero when our now great city was but a collection of huts, and has perhaps contributed more than any other ono individual, by his cut rgy and enterprise, to her present greatness. lie was always, too, among the first in whatever was calculated to advance her interest'.
