The commissioners appointed by virtue of this act, shall have the same power to abate auy tax in the hands of the collector, in the county in which he resides, for collection, as the civil au thority have in towns to abate taxes, and to issue a certificate of such abatement, to the Auditor of Accounts, who thall draw orders on the State Treasurer for the amount of such abatements, which or der shall be receivable by the Treasurer from the collector for the amount of such tuxes. Sec. 5. The commissioners appointed by virtue of this chapter c shall receive for their services, two dollars and fifty cents per day and the collector shall re ceive five per ccut for the collection of State taxes, and the Auditor of Accounts is hereby authorized to draw orders on the treasurer to pay the same. Approved, Deceiuler 1, 1862. No. 19. AN ACT to appoint a collct or of taxes against the inhabitants of the old town of Sterling. It is liereby enacted fyc: Sec. 1. Orren Lyman, of Morristown, is hereby authorized and directed to levy and collect any and all taxes that may be assessed on the Urand List of the inhab itants and tciitory which would now be the town of Sterling, if the same had not been annexed to the towns of Johnson, Morristown, and Stowc, said assessments being ru:ide by virtue of an act approved November twenty first eighteen hundred fifty uine, and the said Lyman shall pay the amount collected to the treasurer of the town of Morristown on or before the first day of June, A. 1). eighteen hundred sixty-three, who shall pay the same upon the debts due from the said town of Ster ling in accordance with the aforesaid act, and the act to which that is an amend ment, and the said Lyman shall have 11 the powers iu collecting said tax, aud be subject to .the same liabilities that he would if said towu bad never been annex ed as aforesaid, and he was the legally elected first constable thereof. And said , collector shall be eutitlcd to five per cent for colleting suid tax. Sko. 2. All acts and parts of acts in consistent with the provisions of this act .are hereby repealed. Sec. 3. Bates, on bis official bonds, are hereby discharged from all liability on . said bonds, or any of them, on condition of payment to the Treasurer of the State . . the sums annexed to their names respect ively, to wit: . , Kiverius Camp, Jr., fifty dollars; ' Edward A. Webb, fifty dollars j Geo. Robinson, two hundred dollars ; J. 0. Only, three hundred dolUrt ; J. C. B. Thayer, sixty-four dollars ; Leander Foster, fifty dollars; Charles H. Any sums heretofore p:iid by auy of said persons on account of such li ability, are to be applied as payment of the sums set to their names respectively, in the first section of this act. Sec. 3. This act shall not bo constru ed to discharge any of the signers of said bonds, other than tnose named in the first sectiou of this act, and who avail themselves of the benefit thereof. Sec. 4. Any persou named m the first section of this act, paying the sum there in set to bis name, shall be, and is here by indemnified, from all and any contri butions to any other signer of said bonds, by reason of said damages or costs that may be recovered of any ot such other signers thereof. Sec. 5. None of the above named per sons, who shall take the benefit of this act, shall have any lieu or claim, in law or in equity, to any securities turned out by said Bates to any of said sureties in said bonds, now iu the hands of a receiver, whatever may be the result of the suits now pending against the signers of said bonds, or any of them. Sec. 6. The Hon. Levi Underwood, of Burlington, is hereby appointed an agent of the State to execute aud deliver in due form of law any proper deed or other iustrumtnt in writing of any land or interest therein, which has, or shall come to the State from the lato Treasurer, H. M. Bates, or any of his sureties, or upon any debt or chose in action, now in the hands of the receiver in the matter. Sec. 7. This act shall take effect from its passage. Approved, Dec. 1, 1862. No. 25. AN ACT altering the time of holding the December term of Windsor County Court ft is hereby enacted, Sfc: Sec. 1. The December term of the County Court of the county of Windsor, shall be held on the second Tuesday of December, instead of the time now pro vided by law. Seo. 2. All writs and processes made returnable to said court on the first Tues day of December, shall be returnable to and entered in suid Court on the second Tuesday of December. Sec. 3. This act shall take effect from its passage. Approved, Nov. 26, 1862. No. 26. AN ACT laying a tax on the Couuty of Chitteuden. It is hereby enacted, $c.: Seo. 1. There is hereby assessed a tax of one and three fourths per cent on the list of polls aud ratable CBtute in the suV- eral towns in tho County of Chittenden, for the year A. D. 1862, for the purpose of meeting tho deficiency in the Treasury of said County, and paying the current 'expenses of the same. I Seo. 2. The Treasurer of said County ' is directed, on or before the first day of January A. D. 1863, to issue his war rants to the first constables of the several towns in said Connty, for the collection of said tax in the same manner, as by law, State taxes are required to be collect ed, except as is herein otherwise provided. Sec. 8 The selectmen in the several towns in said County shall make out and deliver to the first constables of their res pective towns, in the month of March A. D. 1803, a tax bill for the collection of said tax in the same manner as is requir ed by law for the collection of State taxes. Sko. 4. Instead of the credit men tioned in section fifty seven, of chapter eighty-one, of the Compiled Statutes, the treasurer of the County shall credit the several constables one fort'eth part of the whole Sim contained in the warants by him issued for the collection of this tax to tob onstable, who shall be aawunts- ble to their respective towns for so much of said fortieth part so credited, as is not allowed by wav of abatement. Sue. 5. The first constable shall col lect and pay into the treasury of the said County, the said tax, by the first day of June A. D. 1863. S.nc. 6. This act s J all take effect from and after its passage. Approved, Nov. 25, 1862. No. 27. AN ACT iu addition to an act, approved November twenty seventh, eighteen hundred sixty, entitled "an act laying a tax on the County of Addison." It is hereby enacted, Sfc: Sec. 1. The committee constituted by section five of the act to which this is in addition, are hereby authorized to expend for the purpose contemplated in said sec tion five, and additional sum, not exceed ing two hundred dollars and tlje County Clerk of the County of Addison, maun der the direction of said committee, draw orders on the Treasurer of said County, to an amount not exceeding said sum of two hundred dollars, and said Treasurer is directed to accept and pay the same. Sec. 2. This act shall take effect from its passage. Approved, Nov. 29, 1862. No. 36. AN ACT authorizing tho Gov ernor to loan arms, &c. to Norwich Uuiversity. It is hereby enacted, fyc: Sec. 1. The Governor is authorized to loan to Norwich University such arms and equipments of all kinds, the property of the State, as said University shall need for the purposo of instructing its students in military tactics. Sec. 2. The Governor is further au thorized to make requisition upon the United States Government, for eighty ca det muskets as a part of tho quota of arms apportioned to this State under the act of Congress, and loan to said Norwich University as provided in this act : pro vided, That before said muskets Bhall be delivered to the University, the President or Treasurer thereof shall execute to the Governor a certificate, acknowledging the receipt of the same and conditioned for the safe keeping, and return thereof to the Governor when by him ordered. Sec. 3. This act shall take effect from its passage. Approved, Nov. 26, 1862. No. 37. AN ACT in amendment of au act to appoint Commissioners, to adjust and settle certain claims, and accounts, and expenditures for military purposes. It is hereby enacted, tyc: Sec. 1. The Auditor of Accounts is hereby authorized and directed to audit, adjust and allow such claims as are men tioned in the first section of the act to which this is an amendment, as were not allowed by the commissioners appointed under said act: Provided, The Auditor of Accounts shall find that the claimant was deprived of a propper hearing before said commissioners by accident, mistake or want of notice. Sec 2. The Auditor of Accounts is also authorized and directed to audit, ad just and allow the claims cf such volun- tccrs as all have been mustered out of service for disability accruing after their eulistmcnt, and such as shall have died before being mustered into the service. Seo. 3. The Auditor of Accounts shall draw his order on the Treasurer for such sums ashe shall allow, and the Treas urer is hereby directcted to pay the same. Sec. 4. This act shall take effect from its passage. Approved, Nov. 26, 1862. No. 38. AN ACT to authorize towns to raise money to pay volunteers. It is liereby enacted, Sfc: Sko. 1, Any town at a town meeting legally warned and holdcn, may grant and vote such sums of money as they may judge best, to bo paid to the persons who have or may hereafter voluuteer from s:iid town to serve in the volunteer or militia regiments or companies of this State in the service of the United States ; or for the purpose of paying ony debts, con tracted by the selectmen of each town to pay any bounty to such volunteers, agree ably to any previous vote of suwh town i or for the purpose of defraying the ex pense and amount of bounties to such volunteers, which bounties may have been paid to such volunteers by private sub scription or from private means. Sec. 2. No money payable or received under the provisions of this act shall be subject to the trustee process. Sec. 3. This act shall take effect from its passage. Approved Oct. 29,' 1 862. No. 39. AN ACT to authorize the Gov ernor to furnish Tournequcta for the use of the Soldiers. It is hereby enacted, Sfc: Sec 1. The Governor of the State is hereby authorized to procure and furnish to the Vermont Troops now in the United I States service or which may hereafter be called into the United States service, such a number of Tourniquets for the use of the soldiers as he may deem proper. Sec. 2. The TtufpequctS thus fur nished shall not be deemed private prop erty, but shall be accounted for to the Quartermasters of the regiments to which said troops belong for the use of tho gov ernment. Sec. 3. This act shall take effect from its passage. Approved November 5, 1862. , No. 40. AN ACT providing for tho pay ment of troops. It is liereby enacted, tyc: Seo. 1. Tho non-commissioned officers, musicians and privates of the 12th, 13th, 1 4th, 15th and 16th Itcgiments, who have becu or may hereafter be mustered into the service of the United States for the term of nine months, from this State, shall be entitled to seven dollars per mouth from the State of Vermont, in addi tion to their pay from the United States, to be paid to them in the same manner as is now provided for the payment of seven dollars per month to the non-commissioned officers, musicians, and privates of the Volunteer Militia now in the ser vice of the Uuited States. The members of the said Regiments and their families shall be eutitlcd to all the rights and gratuities that are now provided by the law for the members of tho Voluuteer Militia of Vermont, now in the service of the United States. Sec. 2. This act shall take effect from its passage. Approved Oct. 10, 1862, No. 41. AN ACT to provide for the Payment to Widows of deceased Sol diers. It is liereby enacted, fyc: Sec. 1. In case of tho decease of any non-commissioned officer, musician or private which is in the service of the Uni ted States, who, at the time of his decease was entitled to any pay from this State, and who was at the time of his decease married, leaving a widow residing within this state, said widow shall be deemed to be the legal representative of her husband, so far as relates to such amount due, as aforesaid, and shall be entitled to receive the same, and the State Treasurer is here by directed to pay the same to said wid ow, upou order, drawn by her, accompa nied by a certificate of the Selectmen of the town where she resides, setting forth that the person drawing such order, is the widow of the .deceased, aud entitled to re ceive the amount agreeably in this set. Sec. 2. This act shall take effect from its passage. Approved, October 29, 1802. No. 42. AN ACT relating to tho pay due deceased soldiers. It is heredy enacted, Sjc: Seo. 1. The seven dollars per month pay, mentioned in section 1 1 of an act entitled " an act to provide for raising 6 regiments for immediate service for pro tccting and defending the Constitution and Union," opproved April 10th, 1801 and in all subsequent acts relating thereto, shall not bo considered assets in the hands of the administrator of such as may have died, or shall hereafter die in the service, but shall be paid as follows s IF the deceased was married, to his widow ; second if no widow, to his child dollars is appropriated for paying the de or children: If he died unmarried and beuturcs of the Lieutenant Governor, the ; without ohiklrod, to his fathor; second, if the father is dead, to the moth er ; third, if both parents are dead, to the brothers and sisters, collectively ; lastly, to the heirs generally. Sec. 2. This act shall take effect from its passage. Approved, November 28, 1862. No. 43. AN ACT explanatory of certain acts providing for the support of fam- ilies of soldiers. It is hereby enacted, tyc: Seo. 1. An act entitled "An act to ! provido for the families of citizens of Ver- J raont, mustered into the service of the United States," approved April 26, 1861, ! also au act entitled ' An act providing pay for certain soldiers, and in relation to tho support of families of volunteers," approved November 20, 1861, shall be construed so that, First, the families of commissioned officers shall not be entitled to the benefit of said act. Second, the family of no person shall be entitled to the benefit of said acts until all that is due such persons from this State shall have been expended and such further pro visions shall have been made by said persons for the support of his family as should reasonably be required of him. Third, the family of no persons shall be entitled to the benefits of said acts after such person has deceased, or been dis charged, or may in any way left the ser vice ; Provided, that iu cases of extreme necessity, assistance may be continued to such family for a period not exceeding three months after such decease or dis charge. Sec. I. The several towns are empow ered to pay the agents, appointed for said towns by the Governor, such sums as shall be agreed upon between said towns and said agents, for past and future services, under said acts ; and such agents shall not be entitled to any pay for such ser vices, except from their respective towns. Sec. 3. This act shall tako effect from its passage. Approved, Nov. 14th, 1862. No. 44. AN ACT making provisions for military expenses. It is hereby enacted Sfc: Sko. 1. The sum of seven hundred and fifty thousand dollars is appropriated to pay the military expenses of the State. Sio 2. The Treasurer of the State is hereby authorized under the direction of the Governor and Lieutenant Goveruor, to borrow on the credit of the State, such sums as he from time to time shall find necessary for the purposes named in the first section of this act, not exceeding in the whole the sum of seven hundred and fifty thousand dollars. Sec. 3. For the money so borrowed said Treasurer shall issue the bonds of this State for such sum, payable on such time, not exceeding twenty years from the date thereof, at such bank in the city of Boston, Mass. as the Governor, Lieut. Governor and Treasurer shall direct. Sec. 4. Each of said bonds shall be made negotiable ; shall bear interest at a rate not exceeding six per cent per anum shall have semiannual coupons signed by the Treasurer, attatched thereto ; Bhall be signed by the Governor and Lieut. Gov ernor, and shall be countersigned by the Treasurer, and a copy of this act certified ty the Secretary of State shall be printed on the back thereof. Seo. 5. The secretary of State shall keep in bis office a full registry of all bonds whiuh shall be issued according to this act. Sko. 6. This act shall take effect from its passage. Approved, November 26, 1802. No, 45. AN ACT making provision for the support of Government. It is hereby enacted Sfc.: Seo. 1. A tax of eighty cents on the dollar is assessed on the list of the polls and ratable estate of the inhabitants of of this State, for the year one thousand eight hundred and sixty-two, to be paid j into the treasury by the first day of June next, in money, certificates or notes issued by the treasurer or orders drawn on the i treasurer, by authority of law. Seo. 2. ; The sum of ninety thousand , Senate and Uoum of Reprcsontatiw the contingent expenses of the Gcnoral As- sembly, and such salaries as are provided by law, and such sums as are directed to be paid by the treasurer by special aoU of the Legislature. Seo. 3. The sum of one hundred and thirty thousand dollars is appropriated for the purpose of paying such demands against the State as may be allowed by the Auditor of Accounts, and such drafts as may be drawn by tho County Clerks as provided by law. Sec. 4. The sum of ninety thousand dollars is appropriated for the purpose of paying the interest upon tho bonds an4 debt of the State. Seo. 5. Tho sum of fifteen thousand dollars Is appropriated to pay such war rants as may he drawn to pay the contin gent and incidental expenses of the exec utive and treasury departments. Sec. 6. The sum of four hundred thousand dollars is appropriated to pay such expenses as may be incurred under the militia lay. Seo. 7. The treasurer of the State is hereby authorized to borrow a sum not exceeding four hundred and fifty thousand dollars for the purpose of defraying the expenses of the Government and paying such appropriations as are or may be made. Seo. 8. Instead of the credit men tioned in section fifty-seven of chapter eighty-ono of the Compiled statutes, th treasurer shall credit the several consta bles one fortieth part of the wholo sum contained in the warrant by him issued for the collection of this tax, to each cov stable who shall be accountable to theif respective towns for so much of said for tieth part so credited, as is not allowed by way of abatement to such constables ; and this section shall not apply to any other tax but that assessed by this act. B, Sawyer, of the First Vermont Cavalry, somo time since deprived of his command in consequence of alleged misdemean ors, hai been restored, and is now iu com mand of his regiment again. This act of the War Department of course fully vin dicates Col. Sawyer, and gives the lie to those allegations by which his removal was procured. B. F. Times. 43" The Washington Star asserts that the rebel leaders have already detached a considerable portion of their force opposed to the army of Gen. Burnside on Saturday, to make a dash upon Foster's army, now threatening their southeastern railroad connection.
