Garbage disposal Is Just now a live topic at the District building, the neces sity for a provi&ion for ways and means, for the increase of rucilities is rorced upon the Commissionertj by the approach of the heated season. Sixty-five tons of refuse were received at the crematory, and it is evident that at that rate a plant that is only fitted for the consumption of sixty tons in ten hours will not be equal to the demand for space. Contractor "Warfield, his attorney, Mr. H. E. Davis, and his assistant, Mr. S. P. -Baley, were iu consultaUon with the Com missioners, Auditor Petty and Health Officer Woodward jesterday afternoon for two hours discussing the situation. No conclusion was icached, and the ques tion will be again canvassed today, -when there will probably Le a decision made. Another point raised for determination by the Commissioners is upon a difierence of opinion as to the method adopted by the health officer to enforce compliance with the garbage regulations. Mr. War field objects to the rigid rule of fining for violations. 11K. WARFIELD'S POINT. His contention Is that the collections from the 45,000 houses iu the Dibtrict cannot be made without an occasional omission, and that when there are but few com plaints the health officer should not en force a fine; or, in other words, where there might be but a dozen or flitecn com plaints in any twenty-four hour", the service should be rated as satisfactory. Dr. Woodward would not agree to this, lie said the object of the law was to exact as nearly a perfect service as possible, and that the collection of a fine for each violation was a means to that end. He contended that the absence of charges was not conclusive evidence of a faithful discharge of duty upon the part of the contractor, and that to ignore even a Mngle Justcomplalntmightbe to excuse a flagrant violation. Mr. Warfield further claims that where the police court has Jurisdiction of a case It is not proper, nor Just, for the health officers to exercise the prerogative of a judicial officer and Inflict a penalty. There was but a single case, the imposition of a fine of $10, brought to the attention of the board, but upon that the test will be made. RECOMMEND ADVERSE ACTION. The Commissioners recommended adverse action, yesterday, in two communications to Chairman Babcock, of the House Dis trict Committee, upon bills for the separate extension of two city thoroughfares one being House bill 8113, applying to New Jersey avenue, between Brlghtwood and Whitney avenues; the other, House bill 811. for the extension of Eleventh street from Florida .avenue to New Jersey avenue. The legislation asked for is for the bene fit of the Eekington nnd Soldiers' Home and the Brlghtwood Railway Companies, re spectively, whose officials are seeking an outlet to the Zoo. The Commissioners have submitted to Congress a bill conferring the right of extension upon each of theseeompanles, and It is the purpose of their attorneys to get a bill through to establish the streets In order that the right of way may be ascertained and located. By way of comment upon each of these measures the Commissioners say that the policy contemplated in the act referred to the highway act was the outcome of many years of experience of the municipal au thorities of this District and of Congress In dealing with the subject of street ex tension, and was decided upon as the only practical way to secure harmonious and economical results In that direction. To depart from that policy would be a retro grade step, which would reopen the whole question and involve a repetition of the costly and embarrassing complications which led to its-adoption. PREFER HIGHWAY ACT. They also reiterate their opinion that the measure providing for general ex tensions, as amended, is the best solution of the whole matter, and say they propose to discourage legislation not consistent with that plan. Prof. S. P. Langlcy of the Smithsonian Institution, whose adverse opinion of the Mount Pleasant and Zoo Gravity Railway was filed several days ago, has written a second letter to the Commissioners, In which he speaks in highest terms of their proposition for the extension of existing roads in the direction of the park. He regards that plan as the one which will better than any other enable the people to reach the Zoo. The Commis sioners forwarded a copy of the letter to Senator McMillan, chairman of the Sen ate District Committee," and to Chairman Babcock of the House Committee. Building permits were issued yesterday as follows: W. J. Dantz, two dwellings. Nos. 532 and 534 Third street southeast, $1,800; Mary E. Hartigan. two dwell ings, Nos. G3-t and C3G M street south east, $1,800; Cleveland Park Company, dwelling, No. 3322 Newark street. $3,500. Childress, in dicted under the oleomargarine law, went to the jury in Judge Cole's court shortly before 3 o'clock jesterday .afternoon and having faile.l to reach a verdict at 9 o'clock last night, the court ordered the juiors locked up until 10 o'clock this morning. The fo'lowing gentlemen constitute the panel- Messrs. Christian Greener, James W. McKec, E. D. Donnell, J. T Simpson, James G. Livingston, I. N- Runvan, Louis B. Graves, William H. Burch, George Thomas, Jaires Coleman, W. H. H- Gould, and Bernard F.Joy. The jury came in at 8:30 o'clock'last night and asked for Instruction on a point or law. When they returned to the iury room it was the iirpression a verdict would be readied in five or ten minutes.
