Report Of The Legal Counsellor To The Delegates Of The Ninth Quadrennial Convention, Supreme Board And Members Of The Croatian Fraternal l7nion Of America My Dear Brothers And Sisters Of The Croatian Fraternal Union Of America.: This report submitted by your General Counsel will of necessity, cover two periods the first period of some three years and three months during which your General Counsel was Thomas R.. Balaban, and the sccond period covering six months during which your General Counsel was the law firm of Smith, Marion and Balaban. The gains of the Croatian Fraternal Union during the past four yeai's have been great and many. These gains were not accomplished without some sacrifice on the part of your officers, a sacrificc which involved a great deal of time and effort. As General Counsel we are pleased to state that in all of these we counseled with your officers and with the members generally, and for the cooperation we received we wish to express our most heartfelt thanks. The problem first facing us following the conclusion of the 1951 Convention held in Los Angeles was the matter of having the Zajedničar, our official organ, removed from the list of subversive publications, as contained in a publication of the House Un-Amcrican Activities Committee. Through the help of your editors and the united cooperation of all the officers, this feat was accomplished in March, 1952. Another matter facing the Croatian Fraternal Union members before you embark on deal of time had been expended in preparation for trial and a great deal of study was made as to the law involved and -n the various ramifications which necessarily surround any law suit of this type and nature, lhat we were successful in our study and planning is evidenced by the fact that we were able to dispose of this law suit at a figure which we consider well within reason and justified under the ciicum-. stances. The result has been recognized in the relationship that now exists between all the members of the Cioatian Fraternal Union with regard to a project which when com- thereafter. pleted will no doubt be an enhancement to the people of the Croatian descent. The matter of obtaining licenses in the various states in which the Croatian Fraternal Union had great member ship but had never been licensed was of great concern to all of you during the 1951 Convention. Immediate steps were taken to file in the various states mentioned. Here, too, much time was involved in personal calls, correspondence, telephone calls and the like. Today we are licensed in every state in which we have any desire to be licensed, with the exception of New York. We report to you at this time and will stand ready to amplify this report at the Convention, that the matter of being licensed in New York is well on its way. members of those states will strive for a greater member-' ship for there is nothing which should prevent such an ac- complishmcnt now that thc legal lequiremcnts have been, rica was declared to be tax exempt as were all of its subor dinate lodges. Further, regarding any charities conducted by thc Croatian Fraternal Union of America, donations to said charities by individuals, would be deductible for tax purposes. Thc net result of this hearing was that thc Cro- tion and Nationality Act of 1951, commonly known as thc McCarran-Walters Act, and that membership in thc Cro atian Fraternal Union of America was not, in and of itself,! cause sufficient for denial of citizenship. It is worthy of note that this situation was not followed closely only by your General Counsel and thc Supreme Of ficers of thc Croatian Fraternal Union, but in Cleveland, Ohio one Brother Cerezin, in representing a member who had immigration and naturalization difficulties was able to ascertain from the Department of Justice findings and facts which have been of great benefit to our members. Similar questions as to the status of the Croatian Fra ternal Union of America arose regarding employment, edu cation, military service, etc. We are proud to state that in every instance we contacted the proper authorities and were CliUA'l 1AA DAY at Kennywood Park fea tured members of the McKeesport Junior Tamburit/.ans in their rendition of the Rou of America and of great concern to your General Counsel Several law suits are pending in the various courts in requested to attend the next was the libel action of Dr. Francis R. This relationship has been a very friendly one and at great benefit to all parties and that the newly elected General Counsel will find but a small amount of work left undone. It is our sincere hope that the 1955 Convention, which looks very promising, will conclude its stay having put in to effect matters of great benefit to the Croatian Fraternal Union. We will endeavor to be present at as many sessions as possible for the purpose of discussing any parts of our Cleveland Nest 55 In Regular Monthly Meet bers, if revenge was exacted the means were justified.
