pulaioa of Mr. Wigfall, Senator from Texas, was taken
up.
Mr Foster advocated it* passage, not aa a pereooal
matter, but aa a duty—the Senator having announced
bunselj a foreigner, and having denied that be owes alle
giance to this Government.
i Mr. F. made a long speech, but it was without particu
lar point, except that be deuied the right of accession.
Mr. Clin groan followed. He thought Mr. Foster had
m ide a bad poiut. If the resolution were adopted, it
would acknowledge T. xaa to be no longer a State of the
l uion W hy not expel Jefferson Davis, the head of a
Sovereign Republic? Why should the Senator from
Texas be singled out * If Texas is not out of tho Union,
he ia still entitled to a seat here.
Mr. Ma*ou remarked that the resolution called for the
expuls on ol Mr. Wigfall for what he had said on C-e
tioor of the Senate. The Constitution empowers the he
nate to protect itself by conferring the power of expul
sion by a two-thirds vote for disorderly conduct, but
not, as iu this case, lor asserting a constitutional truth.
This is not a punuhablo < ffjnce. Mr. Mason said that
he, himselt, owned that he recognised no allegiance to
this Government—noce whatever! And here he took
his posi iou alongside of the Senator from Texas. He
owed h:s allegiance to Virginia. He knew no sovereign
but hi- State I the Senator from Connecticut vields
I U allegiance to the Federal Government, it vitiates his
alleeiance to the State. All, however, owed obedience
t® the Laws and the Constitution. We are sworn to sup
port the Constitution, not the Government.
Mr. Hunter said be regarded the resolution as intended
to be a vote of censure foe a mere expression of opin
u>n, to puni-h a aerator for differing ftom the majority,
it one is to be expelled, why not all who have with
[ drawn. Mr. H. argued lurther in maintenance of this
po-itiou.
