DECISION OF JUDGE THOMPSON OF PENN SYLVANIA, IN THE COZENS CASE !u the Cozens case at Philadelphia Judge Thtmpson fined Col. Wink 110 for contempt of coart, and then rendered hia decision In the case of the relator, Cozens, as follows: The petition seta forth many grievances. This man wa« arrested, taken to the Old Capitol Pri son, deprived of money and property belonging to him. notified through newspapers that he was to lie died, and that he was tried, and that there hud been some finding somewhere. All that la outside of the cnse. I have nothing to do with it here, lint there is something for me to con sider, and i have acted upeu it. He states that he is nut guilty ot a criminal alienee, and that he hus been deprived of his liberty. Upon that this teturu is made. Ou this return I am to judge, and on nothing else The return to this writ of habeas corpus is that the relator, us a private citizen, was arrested and held under the authority ot the President of the United .States. The return is in accordance with the act ot Congress of March 3, 1863, that when ever the privilege of the writ of habeas corpus is suspended by the President, under the'authority of the act. no officer shall be compelled to pro duce the body of a person in custody, bat upon certificate under oatli that the person is detained under the authority of thfe President, proceedings under the writ shall stay. The section authorizes the President daring the present rebellion, when ever the public safety requires it, to suspend t:.e writ of habeas corpus as it is provided, and that suspension remain iu force so long as the rebellion continues. Ou this return arises the important question whether, on the 29th of June last the re bellion continued or not. This question 1 am to determine. It is a fact to be judicially deter mined like any other tact that comes under judi cial cognizance. The privilege of the writ of habeas corpus is the sacred right of every citizen, and we are to ob serve the strictest scrutiny of any act that threat^ ens to deprive him of it. We have plainly be to nr us the (act that the power of suspension is granted only for the continuance of rebellion. U ceases with the rebellion, and 1 think I shall so decide, that the courts are bound to give the citizen bis right under the privilege. Then there is one tinng to deride. Toe abundance of evidence was then set forth tersely and clearly by the judge, concluding with the asseition, -1 cannot donbt the fact, we all know it, and thank the good Providence that there is no war in the land.” Why, then should the right of the citizen, limited and controlled by the existence of the war, be limited and con trolled when the war has ceased? This being so, the authority of the President merely waiving all other considerations that bear upon the subject, in not a sufficient warrant for the arrest of a citizen. And when a warrant is issued for the arrest or search of any person or place for probable cause, it must be supported by oath or affirmation, and there being no oath or affirmation here charging the crime or offense, nor warrant pursuant to it to authorize the arrest, the warrant in this case, therefore, is unauthorized, and the relator is en titled to be discharged. The decision is not one that conflicts as be tween the civil and military authority of the country, it is an important clause for constitu tion and right that the military shall, in all casea and at ail times, be in strict subservience to the civil power, and it will doubtless be as agreeable to the military authorities that there should be a return to the normal condition iu this respect, as peace happily returns, as to the civil authorities themselves. On this simple fad, considering the return, and no more, i discharge this claimant. I do not go into the question whether Congress has the right to put into the army contractors or othera. it is not necesaary to this decision. I must discard all considerations that have been suggested arising out of the fact ttiat Air. Cozens has been tiled by a military tribunal, it would have presented a differed question had it been returned Lere that he was in execution nnder the Undiug of that court. I hope, however, most earnestly hope, that at the eud of the long terrible war we have just passed through, the Preaident of the United States will do speedily what I think he ought to do, refuse his sanction to all trial ol oflences that ere not purely milita ry, and let the citizen again be returned to the tribunals to which he is accustomed to answer, and there to receive the punishment of what he should lie found to be guilty. I make uo deci sion on this question, for the question of trial is not returned as the reason tor the arrest, nor would it therefore be proper for me to notice it. The return is based simply on the power of the President to order the arres’, nnder the authority of the writ of habeas corpus. Therefore, the de cision iu one great qnestiou must, in my judg ment, decide ail questions of this kind; that is to Bay, the time allowed the President to exercise this power is at an end. The bow of peace spans the whole country, and that was tobethesigu that ail should be secured iu their rights hereaf ter. i have, 1 believe, nothing farther that it is necessary to add. 1 have thought with a great deal of care on this subject I have approved of the calm and dispasiionate manner of the discus sion that was becoming the gentlemen engaged an both sides. 1 am obliged, therefore, to order the release of the relator Cozens was accoidingly discharged, and the case thus ended.
