EIEHPTIOS-WBAT IS RE«ITIBED. There aro now two or threo propositions before Congress, looking to a modification of tho general bankrupt' law, so that it shall not operate as unequally and unjustly as it now docs in Virginia. The difficulty In this State arises from the construction given to our own exemption laws in con nection with the bankrupt act, and, as the matter now stands, relief can only be had at the hands of Congress. With a proper understanding of the law, and its operation under the decision of our local courts, there ought to be no difficulty in reaching the relief asked. The facts are these: The general bank rupt law, including amendments, allows tiie di.ciiarge of the honest bankrupt from all debts contracted beforo 1809, without showing one dollar of assets, but will not discharge him from debts contracted since that time, unless he can show assets to the ninount of fity cents on the dollar upon his indebtedness. The Virginia Court of Appeals allows the Homestead exemption (State law) in the case of recent debts, but not as against debts contracted prior to 1869. What we need in this State is such legis lation on the part of Congress a3 will cor rect this anomaly ; for the greatest injustice is now done under this ruling of our Court of Appeals, No bankrupt, in our judg ment, should be deprived, as he now is, of his exemption, because some creditor bas been sharp enough to obtain a d.creo or judgment of a court against him belore the Cling of his petition for relief. Bank rapt exemptions should ba good against old as well as new debts, and tgafoat those in the form of a decree or judgment as well as others. In fact, nothing but a sale by a public officer, made before the filing of a petition in bankruptcy, or a voluntary pledge by mortgage or deed of trust, should defeat tho objects of tho exemption law. Bui. an old debt will now do it, and so will a sharp creditor who has an eye to grabbing the last dollar of an insolvent creditor, while every other creditor may whittle for a sight of personal assets. Relief from this anom alous state of things is now demanded, and let the action of Congress bo such as effec tually to reach it. aMNHbU. VS. ■■__-__. I.EOISEA TIOX. Tho State of Illinois is a conspicuous example of a well governed commonwealth. Tor many years she prospered with a brief session of her legislature orce in two years. With her vast increase in popula tion and wealth, and the growing complica tion of her business interests, she found a new constitution necessary, and elected har best men to form one a fuw years since. T.iis instrument made radical changes to v my parti.ular.l, and required a com plete revision of former legislation. Tho first legislature elected under it, held au adjourned session, and two extra sessions wero called, extending its entire sitting through a period of ten months. During thief time a vast amount of labor was per formed and a body of laws passed which were well matured, judicious and salu tary, but so condensed and general that they were published in a book of 490 pages. Njw t'ue secret of this successful legis lation was, that the constitution prohibits the grant of special charters. All rights an 1 privileges aro common ta every citizen alike. That is true republicanism. In tho legitimate expression of this beoi flc.nt principle is found the spirit of that mighty State whose material and social * progress is nowhere surpassed in the worldl There is the generous welcome, the helpfu. and fraternal hand to all new comers, tho broad and liberal platform of perlect equality and free competition, which invites and holds capital, enterprise, skill und intellect, by offering a fair field, equal protection, and free competition to all who ».t_ it for a home or wbo enter its domains to carry forward the great enterprises of civilization. Here is a commanding exam ple for Virginia. She is the newest of all the states, and she must look for prece dents, not to old communities lhat have died, but to new ones that are in the full vigor of growth and brilliant achievement. A lIESOLCTION was ottered in the House yesterday by Mr. Brown, of Charlotte, calling on the Secretary of the Common, wealth for information relating to illegal returns by election officers, and the num ber of votes not counted by reason of errors or negligence of election officers. It is well known that many districts were intiicly thrown out at the late election, and such lias been the case at almost every election. These officers are appointed by tho county courts, more generally in con .- d. ration of their political standing than their competency. Now would it not be more advantageous, and would not tho people be better served, were these officers elected from each party on the board to do the duties required. There would then always be parties enough interested to see that the returns were properly made. Either giio us such a system that ballots wheucatii will bo properly counted aud returned, or abolish the ballot and permit the coun'y court to appoint all officers, state and national All we ask is that Totes cast Bhall be hon»Btly and intelligently counted, lhat this has not boon done heretofore, uone will protend to deny. Of courso something has got to be done this session ou the oyster tax question. Tho anomaly of levying a tax which costs fifty per cent, of the pros* proceeds to col. loct, is such an outrage on common sense, to say nothing of the elementary principles of political economy familiar to every tyro, that it is safe to say something will l. done, if it only be to increase tbe muddle which seems fated ever to surround that patient mollusc when brought into the halls of legislation. Weventuroto suggest a few points for the consideration of our law-makers. In tho Brst place, shore fishermen—including | oyster-catchers—all the world over, have ever foimed the poorost communities of their respective countries ; enjoying fewer | comforts of life than any other class, and the least able to bear a direct tax on , their labor. This results from its dan- . gerous and precarious character and tho perishable nature of the products. So generally recognized is this fact, that it bas been the practice of all enlightened gov ernments to encourage their fishermen by bounties, instead of crushing them with taxes. Such has specially been the policy of the United States with the deep sea fishermen of New England. The object was to raise up a hardy class of watermen, to furnish sailors for tho navy and the merchant marine. But as to the oysters themselves. We are told by naturalists that the capacity of the oyster for reproduction, under favora blu circumstances, is practically unlimited. And it is proved by experience that the more tho natural rocks or breeding places of the oyster aro worked, the more rapidly does it multiply. It is with the oyster as with weeds in a garden—every stirring of the soil starts a fresh crop. The removal of one but makes room for a successor. But to get the oyster in its prime it must be taken from its native bed—like tobacco or cabbage—and planted on a congenial spot, where it will have ample room and verge enough to grow and to be supplied with suitable food. Here it must remain two or three years. These planting grounds are the shallsw waters of rivers and creeks, and are the property of the State. Ilero is the whole ease in a nut -shell. Tne legislation required is simply this: Abolish [all taxes on the shipping or caic ling of ' oysters. Confine tho tight to dredge to vessels owned and officered by citizen* «f the State—giving them authority to arrest interlopers. Lease out all the planting ground—withdrawing all protection frum oysters not oo leased ground. It is estimated that a revenue of from fifty to oi.o hundred thousand dollars a year could be obta ned from the leased grounds, at a cost of collection not exceed ing five per cent. These views are furnished us by a gen ili-uian wiio has paid much attention to the subject, and who professes to under stand it, practically aud theoretically, iv ,iH its details. BAIXBOAD OGRES. The terror that some men have of " Railroad Kings, " as Tom Scott and some othors aro called, and their imperious sway in this country, is amusing enough when we consider tht reserved power of thu states which may bo brought at any tune to settle the question of their kingship. We havo yet to learn that tilt present Vice- President of tho Pennsylvania Central is such a railread ogre as to frighten a Vir ginia legislature out of its seven senses, (if legislative bodies havo that number,) or out of all dignity and gravity in its sittings. What Mr. Scott has sought to do in New Jersey is precisely what we want to see done in Virginia. He has sought to break tho backbone of a most rascally monopoly in that State ; and we want, by the passage I of a general railroad law, to break ibe | power of monopoly in this Stato. If Tom I Scott stall be the first to furnish the money to do it with, let him come. There is no inherent viciousness in his money that wo may dread or that any other man may dread. ■-*— -— =-- PAUPER Italian immigrants are arriving at New York in such numbers as to give rise to a well-grounded suspicion that tha Italian government is systematically ship ping its lazzaroni to this country. Those who have landed are reported almost desti tute) of all things, to look half-starved, and are generally in such condition as to suggest doubts as to thoir having paid their own passage. Tho Italian Consul, in response to inquiries, states that all of them havo passports, and imparts the further com forting assurance' that none of them are brigauds. But whatever may have been theit condition at home, they arrive hero paupers and consequently become a public charge at once, lv view of this, applica tion has been made to the State Depart ment to interpose and stop further immi gration of this class. We are pleased to learn that the Post Office committee in Congress haa almost unanimously agreed to report favorably on the bill introduced some days a'4o by Mr. Representative Porter, of this State, to so niodily and reconcile the sections of the postal law in regtrj to double postago as to abate tbe evil now so generally and widely a subject of complaint. It seems that the Postmaster-General has persist ently fought this measure of public justice, whilo Mr. Porter has just as persistently fought in its favor, and has now a fair pros pect to win. It is idle to deny the very I great ability of the author. It shows itself 1 in every page of his work. He grapple, with facts as one conscious of bis entire ability to handle them, and he makos everything bend to oertain great cardinal principles wbteb he lays ] down as shaping the currents of human j bi.tory in all ages. According to Mr. j Froude, the natural right of liberty belongs Eist except as the ability oiists to resist suc cessfully. A liberty that is not achieved— that is not actually won and held in defi ance of the tyranny tbat would crush it— is no liberty that would clevato a peoplo into independent nationality. This is a lesson, as Mr. Froudo claims, that all his tory teaches, and Irish history in espe cial. It can be seen how strong a plea enters here for the right of England to rule Ireland. Whether his position be true or false, the American mind is not prepared to accept such a theory of government ju-aat this timo. It will take a more subtle analy sis than he brings to tho elucidation of history to make tho average American mind accept tho propositions on which ho grounds Irish history.
