But with Mr. Cassidv, or Mr. Richmond,* or ' Mr. Cnggcr, as such, we have nothing to do.? ! Ptrnfinully, their conduct is of little imporI tance, and none of our business. It is in their representative position as prominent members j of the Democratic party that they should be i held to the severest accountability in all mati ters affecting its welfare and good name. A scandal has been sent forth, through their agency, involving the deepest injury to the party throughout the Union?an impassable breach has been made between the Democracy | of Virginia and New York. A shameful assault has been aimed at the character and position of one of the ablest, most faithful and influential statesmen of the country, whose fame and reputation are dear to the whole South, where lie is recognized as their fearless, truthful, unconquerable champion? feuds have been engendered which must be carried into the National Convention, and, it may be, from the National Convention to the people; and the party in this State, upon the threshold of a happy reunion, have again been disunited, and no one can foretell the consequences. These disastrous results have been accomplished by the perfidy which first caused to be written, then surreptitiously obtained i and finally fraudulently used, the Wise letter, j I The authors of that infamy are responsible, not aione to Gov. Vorh iMily -Vctr* THE NATURALIZATION QUESTION. < This may be briefly stated as follows: If a person leaves a foreign country, of which tl he is a native, and comes to the L'nited States, n and is naturalized by our laws, and then rt- t< turns for a temporary occasion to his own land, 1 a ? r-- _ -a 1 t can lie ne suojecteu 10 niiinury service in mai i i land? Secondly, if he is so suhjected, without! d his own consent, what duty devolves, by rca- v son of this act, upon the United Slates, ofjli which he had become a naturalized citizen V t The oflicial opinions pronounced on this sub- a ject have not, perhaps, been wholly consistent c with each other; and as it is quite evident that ti the public mind is keenly aiive to the discus- 1 sion, which is taking place in all sections of the country, we do not hesitate to recur to ! the topic. I .? It is hardly necessary to argue the propo-i- : (ion which lies at tiie hn-e ol all inquiry on 1 this subject. V'attel, to whom a general appeal is uiude. expresses a very clear opinion: ' s erv uian is born frc-e, and the son of a citizen, t' when come to \ cars of discretion, may exam- ; i.ic whether it i.s convenient for him to join the t society for which he was destined by his birth, f If he does not find it advantageous to r<-m tie t in it, he is at liberty to quit, on making it a i 1. compensation for what it has done in his fa- ; t vor." If we -tart with tin- j plain declaration ol the light ?>f a citizen hi a our minds, we shall have no dillieulty in arriving at a just anil logical conclusion. For what- I ever force we may ascribe to the theory of a ( social contract existing hetwem the citizen and I J the State, vvc are certainly obliged to construe ' f the operation <>i that contract by the ordinar\ rules of law. t 'I here is no contract that may not hotvrtisiua- ' tell by tiie a sent <u both parties, and (bat as- r si.ii'. may be w.-?l proved by ui?cuiiiv;atici> | (t a- by |M?sitivc iieclaniliu.i. Anil this was t undoubtedly the common law. After its i,a- j t tura'.izJtion tile highest ollicts in Kogland were ]' opened to the naturalized subject. It needed j! a statute, passed in the twelfth year of the 1 * re;g:i of William the Third, to pi. vent an alien j < so naturalized from being a member of the 1 s privy council, or of parliament, or from holding I office* or grants. 1- it suppo-gibie, under tiie i theory of the Inundation of the public law to which we have alluded, that the common law ( which allowed the oath of allegiance to be im- | posed on the coii?eietu e of an alien born, did so in subjection to the obligation of that alien J to the prince from whose territories he had re- , moved ? It i>, on the contrary, perfectly evi- j ib.ni that the tltcorv of the Krialish law was i , that the alien might <lk?'?|ve his primal con(net, an 1 become responsible only ami altogether to a n"w allegiance. It is perfectly true that the practice of the English court-, has no: been consistent with j this conclusion. Fur while they have rccog-! nized that a man might become a Hritisli sul?- j ject by naturalization, or by serving two years j in time of war on board a king's ship, without j other ceremony, vet they have maintained the I theory that no Englishman can abrogate his idle-1 giance to the mother country, l?y being nntu- . ralized in a foreign State. In the case of .McDonald, who was horn in England, but entered I into French service at an early a;;., anil was taken prisoner in the Scotch icbellion of 1743 by the English, there was, we believe, no proof of his naturalization in France, but Chief Justice I.ee decided that he was punishable as a traitor, saying that "it was not in the power of an}- private subject to shake oil' his allegiance, and to transfer it to a foreign prince. Nor was it in the power of any lorcign prince, by naturalizing or employing a subject of tireat llritain, to dissolve the bond of allegiance between that subject and the crown." This decision, often <junted and relied on in discussions upon this subject, leads f I., ..,.r...|.icicn tclif.ii %%..,,,.Ifr.^l it I . with the common ami statute law of England. ! That conclusion is that the English accord t<? ] the fact <*f naturalization hy their l.aw a force which they give to the law of no other country. j I< it jKissi'iio t<> imagine that England would s'.'hmit. as a nation, to the punishment as a Itattor of a sraiirm horn in France who had: scrveil two years in lier navy iti ti ue of war j with France, aid lad lints he n n ituraiizc i <1 j frclo hy the provision of tie statute of Its (Jtore* 'he .1. if iw tv.v taken |i isoiur I he ti c i rcneii? tt e kftow veiy w, ii that .?he ! wciihl maintain hy retaliation, at l a-', the' integrity of the statutory ptivihge given m tho-e wlm had rendered this s-tvI e on the j faith of her 'aw. I fi The question i- no longer what the rights of i ji the foreign State may be over the emigrant ' ] from its shore, hut it. is what this government 1 n has obliged itself to perform when it received j p the foreigner as a citizen. We say, that hnv- j p ing naturalized him, and having placed him by j p a voluntary act, done under the provisions of a ], public law, on the footing of its own citizens, t it is hound to protect him, wherever he may (_ lawfully have journeyed, as if he were horn in s this land. This duty results from the contract p of our government made with him on his nntu- } ralization. To what protection is he entitled as p our citizen? We cannot protect him from the 'I obligation of debts contracted in a foreign land, v if he return there, or from punishment for a crimes-committed in that land if he is found J within its jurisdiction. These are liabilities s which do not depend on citizenship. They grow p out of penal and personal laws, which attach in (. all lands to citizens and strangers alike. While wo may have had no t light to break the ancient ties of allegiance, we . v have recognized, and indeed exacted their rup-11, lure. We are bound, therefore, as a nation, < not for the sake of this naturalized citizen, hut for the sake of our own honor, to upheld the c validity of the contract we have made, and the j privilege we have accorded.
