Until thsrs was a House of Representatives, there was ao Congress; and until there was a Con gress, there was no legislative power. - Mr Hunter said he had not examined the question very thoroughly, but be was inclined to concur With the Senator from Maine. He supposed the House of Representatives was a House, even without a Speaker, and he saw no objection to tbe passage of bills by the Sen ate lathe present state of afTairs. \et he did not suppose tbere would be any great gam by so doingTand the only effect might be to em barrass the House nnd perhaps give offence to Mr! Fessenden remarked that the President had sent his annual message to the Senate nnd Houseof Representatives, thus recognizing the fact that Congress was in session, lie evi dently considers it a House, so far as that he could recognize it as a b_ty. There would be mnny difficulties in taking theopposite ground, in not considering it a House for some pur poses, nnd not considering Congress in session. jlr. Clarke said the Constitution provides that Congress shall assemble on the first Mon day in December. Unless Congress is now in session, therefore, the Constitution has uot been carried out. Mr. Benjamin stated tbat tbe Constitution further provides that tbe House of Represen tatives shall choose iv officers. Tbey are hence clearly a House before officers are chosen. After some further debate, Mr. lKle with drew bis motion. The Senate went into executive session, and soon after adjourned. In the House of Representatives, Mr. Me- Rae was entitled to the floor, but yielded it to Mr. Clopton, who was about to address the House, when Mr. washburne, of Maine, interrupted, by calling for tbe vote on Mr. Hutchins' resolu tion for the adoption of the plurality rule. He insisted tbat they were obliged by law to pro ceed to vote for a Speaker without debate and delay, M>. Craige, of North Carolina, raised a point oforder on Mr, Washburne, when tbe latter repeated that the motion lor the adoption ot the plurality rule had been heretofore acted on at all times, uo matter what propositions were before tbe House. It was a question ol high privilege. Mr. Mcßae said that Mr. Washburne bad usurped the floor. Mr. Washburne—lf tbe gentleman will Mr. Mcßae—l will not wait. Mr. Washburne—l suppose I have thefloor ? Mr. Mcßae—You have no right to it. Mr. Washburne—No gentleman has a rlgbt to it, to debate a point of order or anything else, because the Constitution and parliamen tary law require tbe House to proceed to the election of a Speaker, without debate and de lay. Tne Clerk decided tbat Mr. Washburne could not deprive Mr. Clopton of the floor. The point of order was further discussed. Mr. Washburne insisting tbat the Clerk should execute the law aud put the question. Mr. Houston protested against Air. Wash burse's interference and interruptions. Tbe Clerk said be knew of no Pnrliamenta ry practice which would warrant Mr. Wash burne in taking tbe floor troin Mr. Clopton. Mr. Washburne replied that he did uot take tbe floor from him. Mr. Morebead appealed from the Clem's de cision. [There was much confusion throughout these proceedings.] Mr. Phelps expressed his astonishment at tbe factious conduct on tbe Republicau side, nnd asked whether tbeir conduct was tour- Mr. Washburne and others rose to speak. Mr. Craige, of North Carolina, called thum Mr. Burnett Insisted that the Clerk enforce his decision. Mr. Kellogg suggested that Mr. Clopton pro ceed with his remarks, and that when he shall hays concluded his remarks tbe House proceed to vote for n Speaker. Many on the Democratic side objected to this. and finally, after more noisy proceedings nnd points of ordsr Mr. Clopton commenced his remarks. Tbe fam ily of Mr. Guthrie, constating of a wife and three children, had made extensive arrange ments for the accommodation of ths friends of the deceased at the funeral. A large num ber of carriages and n numerous assembly of mourners were present, when tbe undertaker, Mr. Berry, arrived with tbe hearse. About the same time, another carriage, containing a woman richly nnd fashionably dressed, wm driven to the door. Tbe woman alighted and entered tbe house. To thesstonlsbment of the assembly, to all of whom she was a total stranger, she greeted tbe children of Untbne as ber own, and tbey, in turn, addressed her as tbetr mother, mauifesting tbe greatest joy mingled with surprise at seeing her. The wife, on the other band, was confounded.— She Knew not what to say, nor what to think of this sudden nnd strange appearance of one whoelaimed also to be the wtfeof the deceaced, and who was addressed by bis children ns their mother. She knew herself to be tbeir step-mother, having been married to tbeir father in dne legal torm, and in the full con fidence that his first wifu was dead. This supposition being now dterthrowd by tbe sudden appearance of one claiming to be that deceased wife, the other wife began to upbraid tbe children tor not telling ber that tbeir mo ther was living. The real mother (for such the stranger was) assured ber tbat tbe chil dren were not to blame, as they, as well as their father, had reason to believe her dead.— She had deserted her husband in tbe city of St. Louis, where tbey lived and shortly after ward caused an announcement of her death to ,be published in the newspaper** of that city. Hut she was not dead. Leaving St. Louis, she had lived in Chicago, not knowing that her husband was here until she saw the aec.uat of his death published in the papers yesterday m ruing. She had come to reclaim her chil- I dren and to behold for ihe last time o.i earth, I the form of their father. The appearance of the stranger indicated that she was one of that numerous cla-is ol abandoned women who sail along our side walks and attract the gaze of Useniiuus meu by the gaudy trappings of tbeir trade. ,It may be well supposed that "a scene" fol lowed the announcement of her relation to tbe deceased iv that funeral assemblage. The friends who" had congregated to pay the last rites to the dead, suddenly changed tbeir minds and refused to follow the hearse to the cemetery. They also declared that the wife (she whom they supposed to be the only wife) should not do so. The stranger offered to pay the carriage expenses of the family, but the friends would not permit it. In the midst ol considerable confusion, the stranger invited the three children into ber carriage. They obeyed,and tin-carriage was driven away.— The hearse left the house shortly afterwards, bearing the remains of the deceased, but not a single mourner to follow it. On arriving at the cemetery it was rejoined by the carriage containing the new-found mother aud her children, who, with the sexton and undertak er, alone witnessed its burial. Then the chil dren were conveyed by their mother to a new home—where we know not, and would that WS could suppose it to be a better one than that irom which they were so strangely and unex pectedly taken. _ The Campaign is Mexico—We learn by) Mexican gentlemen direct irom Vera Cruz, and the capital of the neighboring republic, j that the fears entertained at the former city, | of another visit from Miramon the present winter, is not without some degree of founda tion. The so-called campaign of the North is defluitively closed by the total dispersion ol Ihe Constitutional forces,aad no excuse now remains to the President why he should not at once undertake the long-threatened expedition. He sides, he is sadly in want of money, and the only way in which his party friends can be in duced to replenish the empty treasury is to yield t j their wishes in another crusade against their only outstanding and rather insolent enemies onthecoast. Hy so doing it is believed that the President would at once command a mil lion of dollars, which would be sufficient to support himself aud his staff for six mouths to come. At all events we are assured that these are the expectations entertained at Vera Cruz, and in consequence thereof the Constitutional Governments preparing lor the worst. Not only are the defences of the city being put in a better state of repair, but everything is being done that can be done towards the efficient re organization of the army. And in this con nection we learn that the Constitutionalists i will not, as the last winter, await the enemy's I uopearauce before the walls oi the city ot Vera I Cruz, but confident in Urn support of the peo ple and their own strength, will meet the in vaders on the c.-tiliues of ibe Stale, there to give a decisive battle thst is, decisive for the Miramon Government, Which, supported by bayonets, it is believed would not outlive aj reverse, while the Constitutional Government making common cause with the people, would hardly lose in any event.— N. Picayune, Uth. i A CniLD Roasted Alive.—One of the most harrowing incidents we have ever recorded occurred a few days ago In the household oi one of our most respectable Creole iamilies, the relation of whicb makes us shudder. A lady, Mme. Franke, (a daughter of that well known citizen l>r. Laiidraux, who lost his life some years ago, by an accident on tbe railroad,) having occasion to leave her house for a short time, intrusted i.er two young children—one an Infant and the other two and a half years old—to two nurses; the nurses doubtless thinking the children were safe from harm, on account of the fire-place being pro tected by a high lender, which was fastened to the mantlepiece, locked the room in whicb they were and went out ou the street. The child two and a half years old,. left to itself, attempted tor limb up on the fender for the purpose of taking something off the mantle,, and iv doing so, fell inside between the fender and fire, and was thus roasted alive. The cook heard the cries of Hie child, but having just seen the nurse? In tbe room, concluded that it was nothing serious j and thus the poor lit tle creature was left exposed to a severe tire, which soon reduced its body to a crisp.—A. O. Delia. _ Tbagedt in New Oblean .—An affray oc curred in the office of the St. Charles Hotel, New Orleans, on the 13th inst., between Hr. W. H. Peck and Charles 11. Harris, Iwo re spectable planters, which resulted in the death of the latter. There was an animosity be tween them, and while Harris was settling his bill, Peck entered,some words ensued,and both drew iheir weapons. Dr. Peck, being quicker, tired first. They exchanged shots rapidly, until both revolvers were discharged, when Harris ran into the private bar-room, jumping over the counter, fell on the floor be hind. Peck had dropped his pistol, and draw ing his bowie-knife, billowed Harris closely. He leaped over the counter, and lulling upon his prostrate foe, seized him and stabbed him repeatedly. Harris wax mortally wounded and expired shortly after. He had received seven wounds—three shots taking effect in the right shoulder, in the left side between the seventh and eighth ribs, penetrating the liver; and in the breast, between tbe first and second ribs. The stab wounds were, two in the left shoulder, one in the left arm, and one in the leftside, between the fifth and sixth ribs, pen etratiug the lungs. Peck was not wounded.— He remained iv the hotel until the police ar rived when he surrendered, and was impri soned. "Vessel BruNT.—The steamer Louisiana, Capt. Russell, on her way down the bay from Baltimore to Norfolk, on Monday night, saw a vessel on lire and sent a boat to afford relief. The vessel proved to be the British brig Sylph, from Trinidad de Cuba, loaded with sugar aud tobacco and bound to Baltimore. The lire was discovered at 11J£ o'clcck, A. M., on Monday, having broken out in the bold, when the brig was off Plum Point; and continuing to in crease rapidly, the vessel came to an anchor In six fathoms water. The schr. Lizzie Rus sell, which came up soon after, assistance she could, aud received ou board ihe officers aud crew, with what clothing they could save. Frozen.—On Sunday night week, says the Tappahaunock Southerner, as two valuable negro meu, belonging to Hon. R. L. T. Beale, of Weetmorelaud co, were attempting to cross Nominy Creek in an open boat, they were be set with ice and in consequence of the expo sure were frozen to death. Col. Black well, in attempting to go to their rescue was also I caught lv the ice and barely escaped the same melancholy fete—he reached shore, however, having bis bands and feet frozen. Death or a Veteran.—Col. Alexander R. Givens, aged 79, died in Augusta county, Va., on tbe 20th nit. In the war with Great Brit ain be was one of the first to start as a com mander of nn Augusta company to serve bis country in the tented field, and from his ear liest manhood down to bis last hour he was an active, useful nnd public spirited citizen of the eonnty. _ Suicide.—Dr. KaufTman, a practising phy sician of Algiers, near New Orleans, and en joying a good reputation amoug all wbo knew nira, committed suicide lately by shooting himself iv tbs breast with a pocket pistol.— The motives which prompted this act are un known.
