Hovey, a tcachiTofthew lioolat Dill's bakery, charged with unlawfully assaulting and whip ping a little white boy named Samuel Hot/.e, was brought before the Mayor yesterday. This case resulted in the infliction of a cow hiding upon Hovey by a brother of young Hot/.e on Friday. A warrant wits gotten out for the arrest of Hot/.e. The case of Hovey was first examined. Young Hot/.e testified that he was playing with a little negro boy, and a difficulty ensued between them. He was caught by two negro women, carried into the school, and whipped -everelv by Hovey with a strap. A witness testified that he examined young Hotze, ami found several marks ujhjii hi- body, which showed that he had been severely whipped. A bevy of witnesses for the defence were called up. A colored woman, an inmate of the Indus trial School,testified that she saw Hotze strike a little colored boy in front of the school. ."Miss Foster ran out to interfere, and Hot/.e rushed at her with a knife, threatening to stab her. He was caught and carried into Hovey's room by Miss Foster and two colored women. Delia Pate, one of the teachers, testified that she saw the white boy advance upon the ne gro boy with a knife. The negro boy pushed him off. Miss Foster ran out to interfere, and the boy turned upon her as if trying to stab her. Julius Ellis, the negro boy about whom the ditliculty commenced, testified thai Hotze struck him and drew a knife on him in front of the school About a dozen other witnesses were ex amined in this case, and the case of Hotze was called up. J \V Hovey stated that on Saturday he was informed that Miss Hotze had sent him word that Mr. Hot/.e wanted to see him. He went down to the post-office, and on Ins re turn he called at Mr Hotze's. He rang the door-bell t wo or three times, and 110 one re plying, he started off. In a few moments he saw Mr. Hotze and a young man following him at a rapid rate. They overtook him, and Hotze asked litm what he wanted. He stated that sotne one had informed flint that he (llotze)wished to see him. Hotze said, "That i- a lie." " You published a statement 111 the Krmniuer this morning which is false." llotze struck Dim with his list, which cut hi? lip quite badly. He then drew some weapon similar to a rattan, and struck him repeatedly with it. Policeman No. 3 testified that he was at the school on Thursday evening, and while there a gentleman came to ask if a warrant had been served on Hovey. I'pon the witness reply ing in the affirmative, the gentleman replied that he was glad of it. as he came to get satis faction. "Witness, in conversation with Hotze, had heard him say that Ins little brother was a little devil, but that he didn't intend to let any Yankee whip lnm. Witness advised him not to take any forcible measure, as he had heard Hovey say that lie was willing to abide t?y the law. Several other witnesses were examined, but nothing new was elicited. His Honor decided that llovey had been guilty of a breach of peace in whipping the boy, which he had 110 right to do. Neither did Hotze have any right to attack Hovey as re taliation. He sent both parties on to answer indii tinent. requiring bail of each in the sum ot and of Hotze fc.VXi to keep the peace. Judge Gregory appeared as counsel for Hovey, and ColonelT. J. Mosiuy Mi?Kxixii.?Lewis and Gordon Rosen thal were arraigned for assaultingand beating Mark Hern-teni, and Hernstein, in lus turn, was arraigned for assaulting and beating Lewis Rosenthal. Sr. It appeared that Hem stein had a ditliculty with old Mr Rosenthal and hi- wife, and that he had knocked the old man down. The young Kosenthals went after him about it. and a row ensued. Heinsieiu testified in a manner something like this: "Rosenthal corned in mine shop, and al'orc I could say von vord luit him, he knocked me dowu and he shoked me, and he ruiined through mine back door 111 the vront, and be trew two children down seven bairs of steps, and he trew seven children over de house, and lie trew a man out of de lot, and he siiumpcd over de close line, and he tried to cut mine troat mit vou razor, and lie knocked down de close lme and struck me over de head taitjthe pole, and runst avay." From tins 11 appeared that Hernstein was a used-up man, but the evidence 011 the other side rather refuted lus statement. This threw him Into a perfect fever, and he called in about a dozen witnesses. One of them walked up to the book, and when her name was asked, Hernstein said excitedly : '? Dat witness haiut got no name, yer Honor ! She say so, but she aint." Tin* witness proved that she did have a name, however, and gave her evidence. After the thirty or forty witnesses in the case were examined, his lienor required all the parties to give surety fi>r their future good behavior in the sum of J.iau, and sent them on to answer indictment before the grand jury. i 'n ilies .Mnitb, an old offender,charged with being drunk and disorderly on the street, was committed in default of $:>oo surety. Longinotti and a negro boy were ar raigned for lighting 111 the street, and were told to go about their business. Ellen Watkius, negress, was arraigned for assaulting and abusing Jane Semmes. A venerable old negro man came in 111 a stately manner, and alter bestowing a passionate and loud sounding kiss 011 the Good Hook, testi lied that Jane had used some very " waygum words" towards Ella, and he ordered her re peatedly to go away: "1 ordered her once," I ordered her de * <???</ tint?, and," said be, bringing hi- hand down upon the stand with a vim. The report says The pecuniary condition ot the works is a source of congratulation, bnt the committee regret to add tuat never since this organiza tion have complaints been so numerous and so serious. The chief cause of complaint .arises from excessive gas bills, and while each com plaint, when brought to the attention of the committee, has been anxiously investigated, yet they ha v been unable in a large majority of cases to afford relief, and can only account for llie size of the bills upon the hypothesis that the gas lias been consumed. The meter regulates the How of gas, and if the meter is in good order, and properly taken, there can be no mistake. The officers of the works have invariably been instructed to examine every meter complained of. and if found detieient to replace it with another; and quite recently tin Superintendent has been directed to have every meter in the city thoroughly examined, and this examination to he made by ail oilicer who has nothing to do with taking the quar terly state of the meters. As not a farthing passes through the hands of the Inspector or his assistants, it is impossible to conceive motive which would prompt litem to tamper with the meters. The truth is. gas is a great luxury : and it is so convenient that a great many persons indulge in a '? Hood of light," regardless of the fact that a little attention to their meters and burners would afford them an ample supply, and the hills would not be so large. While this remark applies to a great many cases that have been submitted to the committee, there nre others to whom it does not apply, ami they can only frankly confess their inability to fathom the difficulty, and must content themselves with expressing their determination to correct any and all abuses they may discover. Another subject has given the committee a good deal of concern : From a statement made by the Auditor, he has returned to the City Collector delinquent tax bills amounting to $22,527,09. If this statement is correct, the Council will see that the works will be enti tled to another large credit. These bills will either be collected or a large reduction in the number of consumers will be the consequence. But 1 his statement cannot be correct, for there is not a corresponding diminution in tin-quan tity of gas consumed ; in fact, the numle-rof consumers has increased. The accounts with the gas works on the Auditor's books have been so kept that the committee must again confess their inability to unravel it. It is pro per to say that the present Auditor has pur sued the plan lie found existing when lie took charge of the ollice. The attention of the Council is directed to the large amount of gas consumed in the City Hall and the alms-house, with the hope that more economy will be ex ereised by the committees having charge of these buildings. The Superintendent again urges the committee to erect another holder, and to make other improvements regarded by him ns essential; but tin- committee would suggest to the Council that it is tin* he.-t policy to take all possible care of the works as they are, without spending another dollar until the finances of the city are in a more promising condition.
