lection of a grocery bill, Justice Mc-;
Donald yesterday rendered verdict in i

Case Continued The hearing of
Harvey Nash, charged with stealing a
watch from a room of a brewery lodg
ing house, was yesterday postponed by
Justice McDonald on request of Coun
cil Monday afternoon at 2 o'clock.

son Co. yesterday sold to Charles K.
Smith the W. H. Harris cottage and
three lots in Tombstone canyon. The
property is a very desirable one. Mr.
Smith recently came here from Port
land. He has concluded to make the
city his future headquarters and will
engago in business in the town.

Dangerous Place Railroad street
below the E. V& S. W., is in a dan
perous condition at several points on
the side overhanging the yard tracks
of the railroad. At one place a cave
of earth has occurred which has left
a hole that a horse could go through
without difficulty. Pedestrians are
obliged to use this side of the road,
and are liable to fall through the hole
that exists there. In view of the
traffic that crowds the thoroughfare
daily it is only question of time until
Eerious accident grows from the condi
tion of the street on the railroad side
unless repairs are jnade.

Brought Rattlers Dave Moffett,
while out doing some assessment work
near the South Bisbec mine, captured
two large rattle snakes, and sent them
In to Ed Prenty. They are now on
exhibition in the window of a saloon

ginia June Bagby, who arrived here
recently from Los Angeles, is well
known in that city as one of the lead-
trs in musical circles, and has won or
herself quite a reputation in concert
work there, as well as In other cities
of Southern California. Having stud
ied under the very best teachers, Miss
Bagby's technique and interpretation
is splendid, and she will doubtless be
quite an acquisition to the musical
circles of this city.

the latter fled.

Sebastopol. Russia, Sept. 8. The
court martial which is to try the cases
of the mutinous crews of the Russian
warships Knaiz Potemkin and Georgi
Piobedonoszeff convened here this
morning and began with the hearing
of witnesses. It Is generally believed
that the court marMal will deal se
verely w,fi the mutineers, particu
larly with the leaders of the mutiny,
but that the emperor will mitigate the
severity of their sentence.

board traveled the streets of the city
yesterday afternoon to announce open
ing of the new place of McCarty &
Harris at Lowell. A large number
went down to the opening from this
city. It was the biggest event of the
kind that Low-ell ever had.

Still Under Treatment W. S. Davis,
the popular barkeeper with the Legal
Tender at Lowell, was in town yester
day to have a wound In his head, sus
tained over a week ago, dressed. The
injury was sustained by Mr. Davis in
a leap for life down an embankment
on the E. P. & S. W. hill track to es
cape a train that came up behind him
without warning.

Good Order at Lowell Kurt Von
Stauffen, clerk in the court of Justice
Hogan at Lowell, was in the city last
evening. Mr. Von Stauffen states that
the office cf the Justice in the suburb
has recently been free from civil or
criminal actions, the town being appa
rently bent on demonstrating itself
the best ordered in the Territory.

New Jail Delivered Contractor
Moore, of the Douglas Cast Stone Co.,
yesterday turned over to the authori
ties the new Jail at Lowell. This
structure is now ready to receive pris
oners and no more of the latter will be
brought from Lowell to Bisbee for con
finement. The Jail will be a decided
convenience to the officers In the low
er precinct, and will cut off a good
deal of expense that has heretofore
been entailed in the transporting of
prisoners between the city and the suburb.
Trainmaster C. A. Brown, of the E.
P. & S. V,'., was in the city last even
ing enroute to Douglas from a trip
of inspection over the west end of th
line. Mr. Brown stated that he had
found conditions good, and that every
thing was now in satisfactory order on
the road. Traffic on the main line
continues to be a trifle light, but all
the rolling stock of the road is never
theless employed. It 5s not being forc
ed to the limit, as was the case dur
ing the rush earlier in the year, bin
It is having enough to do to justify its
operation. In about thirty days it is
expected that traffic will again press
the road to its limit with present
equipment.

LOWELL'S PIONEER STORE
"Washington, Sept. S. The criminal
prosecution of Morris Busch, con
tractor, and Robetr Charlton, in
spector, was ordered today by Acting
Secretary of War Oliver. Busch holds
contracts with the quartermaster's de
partment to furnish fur caps and
gauntlets to be delivered at Schuylkill
arsenel, Philadelphia. The order for
prosecution is based on a report re
cently made by Major F. S. Strong of
the artillery corps, acting inspector
general, in w"h"icfi It 1s shown that a
conspiracy to defraud the government
exists between Busch and Charlton.

Justice McDonald yesterday set the
case of L. S. Medigovich, charged with
maintaining a nuisance, for hearing
next Wednesday morning at 10 o'clock.
Medigovich is the man who is alleged
to have been making a dumping
ground of Tombstone canyon for all
sorts of vile refuse during the last
several months. The complaint was
filed against him by neighbors follow
ing an appeal to County Health Offi
cer Greene, who directed Supervisor
Bowen to have the nuisance abated
over a week ago. Medigovich will
attempt defense.
