The temporary agreement, or modus
Vivendi, between the United States nnd
Urear Itrltaln regarding the rights of
American fishermen In Newfoundland
waters has stirred up couxldcrablu op

Umpire. The preeent Liberal govern-
tueut In London has agreed that tho
American iNhcrmcu tuny ti"c purne
seines, and may employ Newfoundland
crews although both of these thlugx
are forbidden by the local lawn of the
colony. The agreement In to continue
until nu uiidcrMnnding can ho reached
as to the rights guaranteed to Ameri
can llshermeit by the treaty of 1S1
and does not grant any right which
that treaty does not nppenr to protect.
The peoplo of Newfoundland charge the
Urltlsh government with betraying the
interest of the colony. In Natal the
arrangement Is regarded ax a blow at
the xyxtem of colonial autonomy. It In
urged that tho affair of a Kelf-goveru-lug
colony should not lie discussed with
a foreign state until the Imperial gov
ernment has the concurrence of the
colony interested. In Loudon the oppo
sition condemns the government for
what It calls "a complete surrender to
America." Tho Impartial observer will
consult the treaties before forming uu
opinion on these partisan charges. The
tlshlng rights of Americans In Cana
dian waters wero recognized by the
Urltlsh at tho name time that they
recognized the Independence of the Con
tinental colonies. The revolutionists
llcccxxfully contended that tho llsherkM
of the. wholo Atlantic ccast were a
vnluablo asset of tho territory which
liml won Its Independence. After the
war of 1S12 tho Ililtlsh claimed that
the previous treaty was nullliled by the
hostilities, but tho American commis
sioners refused to admit Ihat conten
tion, and insisted that the recognition
of our rights In tho llsherles was as
Irrevocable as the recognition of the
Independence of tho colonies. Tho con-
iHUoiis, wider which the rights might
bo enjoyed were slightly modified In
tho treaty of ISIS, still in force. Other
and temporary agreements, have been
miulo, but when they expired the old
treaty again becanio active. Tho early
rights, which were conceded In the
llrst peace treaty between tho mother
country and tho colonies have been
imiillllod hi many times that the New

Americans have come to think that
they aro not rights at nil, but privi
