SUPREME COURT. A NUMBER OF OPINIONS RECEIVED YESTERDAY. A Question of Boundary Lines Settled—A Railroad Suit to Be Retried—A Case Involving Churoh Property. Clerk Aehmore of the supreme court yesterday recorded the following opin ions in local cases considered by that court: W. W. Whitney, appellant, vs. Robert Kelly et al., respondent—This was an appeal from a judgment dismissing an action, a demurrer to the complaint having been sustained, and the plaintiff declining to amend. In September, 1886, some of the defendants and the grantors of others claiming title to the land involved in this suit, brought an action against the grantors of plaintiff to establish by judicial decree the true boundary line between the lands of the respective parties to that suit. The judgment therein rendered deter mined tue boundary line and adjudged the plaintiffs to be the owners of the tract of land involved in the present ac tion. Plaintiff as grantee of the defend ants in that action now Sled his com plaint to set aside that judgment upon theground that it was procured through certain frauds practiced upon the de fendants therein, the plaintiffs grantois. The judgment of the lower court was affirmed. M. Wilson, appellant, vs. California Central Railroad company, respondent —Action to recover from defendant the value of certain household furniture which, it was alleged, the defendant as a common carrier by railroad, in con sideration of a certain sum paid it by ' plaintiff, as freightage pro rata itincais, agreed safely to carry from Indianapo lis, Ind., to Lob Angeles, Cal., and to deliver to the plaintiff, or order, at the latter place, but failed and refused to do so, according to eaid agreement, where by said furniture was wholly lost to said plaintiff, to her damage in the sum of $4000. A verdict and judgment fixiug the damages at $4000 was rendered in the lower court. The railroad company asked for a new trial, and the supreme court in a lengthy opinion granted it. S. C. Martin et al., respondents, vs. Lewis M. Lloyd et al., appellants—This was an action to quiet title. Judgment went for plaintiffs, and defendants ap pealed from the judgment and from an order denying a new trial. Judgment and order denying a new trial affirmed. First National bank of San Diego, re pondent, vs. Joseph Falkenhan and Coronado Beach company, appellant— This was an appeal by the defendant corporation from that part of the judg ment which authorizes judgment against that defendant. The action was brought upon a promissory note executed by the other defendant to the appellant, and is notnegotiable because it contains a stip ulation for an attorney's fees. The court found in regard to the assignment of the note and waiver of protest as charged in the complaint, and that no part of the principal or interest bad been paid to plaintiff; and also that the other defendant had paid the appellant the amount due on the note prior to its maturity or assignment. Judgment of the tower court affirmed. Mosgrove, appellant, vs. Harris, re spondent—Action to recover the posses sion of certain personal property. The lower court held that defendant was en titled to $020.50 from the plaintiff, who appealed. Judgment and order af firmed. Willamette company, respondent, vs. Union company, appellant—The com plaint contains two counts—one for the value of certain posts and lumber al leged tD have been sold by plaintiff to defendant aud delivered at Burwell, in Los Angelea county, and the other for certain other lumber sold and delivered by plaintiff to defendant to be used in the Normal school building. The court found defendant was indebted to plain tiff $1437.82, and rendered judgment ac cordingly. Defendant appealed. Judg ment and order of the lower court affirmed. George A. B'.akeslee, bishop of the Re-organized Church of Jesus Christ of Latter-Day Saints, appellant, vs. H. C. Hall and Whitworth et al., intorvenors, respondents—This was an action of ejectment against defendaut Hall to re eovt.'i' certain land in the city of Los An geles. Whitworth and others iiiter vened. Judgment was rendered against plaintiff aud he appealed from the judg ment aud order denying a new trial. The court below found that a deed of conveyance had been procured from Lydia Rebbeck, who was sick at the time with an incurable disease from which she afterward died, by the undue influence of one Mills, who was her pastor and spiritual adviser, both being members of said re-orgauized church, and also found that there was no corpo ration sole or otherwise to which the deed was made. After giving a full re view of the points involved in the case, the supreme court dismisses the appeal with a stay of remittitur for thirty days. SANTA BARBARA. The Meeks Family Start for River side—Notes. The Meeks family, who arrived in this city Sunday evening, were last night arrested for vagrancy. When searched in the county jail, two watches, a gold and silver one, were found on them, be sides many small articles of lesser value. The silver watch was identified by Eu gene Hunt of this place. They were up in Judge Wheaton's court this afternoon and given fifty minutes to get out of town; in case they should leave no further charge would be placed against them. The afternoon train was about to leave aud mamma and papa Meeks and the little Meeks got aboard, !eaving this city for good. They will take in the inland towns. Riverside is their next stopping place. Two inches of rain fell here last night. Showers have continued throughout the day. J. O'Canahan, the book agent, was sentenced to four days in jail this morn ing by Judge Wheaton. SANTA MONICA. News Notes and Personals From the City by the Sea. Seaside lodge, 1.0. O. F., continues to receive new members within the fold. At the last meeting two new candidates were initiated into the mysteries of the initiatory degree. I. A. Twichell celebrated his 68th birthday recently, and received a handsome remembrance of the day from Judge Van Dyke, who rendered a decis ion in the case of Gray Bros. vs.Twichell against the plaintiff. , Old Pluviusgaveus'another downpour yesterday, which greatly pleased the farmers in the vicinity. Paddy's big wind also put in an appearance, much to the disgust of all. Railroad news of a newsy character is a scarce article. Both roads (the South ern Pacific and Santa Fe) are straining their utmost to secure vantage ground for tbe coming season and the boom which will follow their progressive de velopment. Perhaps those who are standing out for si stake on the right-of way question will likely get left. More about thiß later on. LETTER BAG. Colonel Itussell and the Seventh. EniTous Hkkalu : I fear neither the people nor Governor Markham really understands the true condition of the Seventh infantry, first brigade, N. G. C, in placing Colonel Russell in command of it. Is Governor Markham really aware of the demoralizing and damaging effect his acts are causing? For such the Seventh is becoming by reason of orders placing Colonel Russell in command of the regiment. They strike at the very corner stone of military organization and discipline. Demoralized soldiers don't make good fighters, neither do they even make good runners. The best disciplined, equipped and drilled battalion on the Pacific divide is the oue here in Los Angeles, brought to that state under the watchful eye and immediate care of Colonel Schreiber, will inevitably scatter like quail before the huntsman upon the advent of Colonel Russeil. Personally or as an officer the com pany don't like him; neither does he like them. They are not on speaking terms. The enlisted men are nearly in the same position. Military discipline requires that men and officers shall sa lute and treat with respect a man whom they disrespect and for whom they have a profound contempt. The surest and best, and the to attain disci pline is to have a good understanding between the meu and officers, and more especially between company and field officers. One must have confidence in tbe other, both as men aud soldiers. The enlisted man must have confidence iv and respect for lub commander. More especially the iion-commissiontd offi cers, who are also enlisted men, must have confidence; otherwise, confußion, insubordination and demoralization follow. I fear that if the Seventh, or any part of it, were to be called out at this time suddenly for active duty, it would make a melancholy appearance, aud if brought to face an enemy the Mower of Angelic youth would diegrace themselves by re treat and rout. The men will not staud fire under Colonel Russell; they have had experience with and know the man. Moreover, under him, they will not come to drill. The property belong ing to the regiment and state, valuable as it is, amounting to thousands of dol lars, will fall into irresponsible hands and will be dissipated, which can be done in various ways. The armory here in Los Angeles, which alone has cost the state thousands of dollars to equip, and for which there is paid a montiily rental alone of $300 of state funds, will be come the domicile of the owl and bat, fit subjects for Colonel Russell's troops. If he be allowed to remain in command one month, that splendid bod> of young men which appeared at Armory hall on the 23d inst., and which was reviewed by Lieutenant Collins and other regular army officers, who so highly compli mented their splendid, soldierly apoear auce as well as their knowledge of the drill, will have disappeared. The com pany officers will resign. The enlisted men cannot resign under the law. The result will be that state property be longing to the regiment will be dam aged to the extent of not less than $5000. Why all this waste of state property and the demoralization of the infantry that Ruasell may be foisted on it? Politics! Russell is a Union league man, hence he must hold an office. It is a case of rule or ruin. It goes without saying that potential power petitioned the philanthropic governor lor Russell's reinstatement, and the consequent order followed with the same regularity that a atone being thrown in air comes down again, without consult ing the best interests of the regiment. It is sufficient to make the statement that there were more ways than one to keep Russell out of command of the regiment, honorably and justly, under Judge Clark's interpretation of the status of the colonelcy, but lack of space here prevents a discussion of those ways. I will cloEe by saying aB a national guardsman, that he cannot muster a corporal's guard in the regiment at the end of his term. PRIVATE Co. C. Los Angeles, March 30th. ANITA'S RETURN. Young Baldwin and His Bride in San Francisco. George Baldwin and his handsome young bride, Anita Baldwin, returned to the city yesterday, Bays the San Fran cieco Chronicle of Tuesday, and at once proceeded to the residence of a particu lar mutual friend in the city, where they will remain pending developments. George appeared among his old asso ciates at the Baldwin yesterday alter noon and had a very royal reception. "He is as white a little fellow us I ever knew," said one of the gentlemen con nected with the house, "and there is not a man here but is for him and his pretty young wife. They have long been lovers and the fact could not have escaped the knowledge of the old man. If he has been too Blow that is his fault. It was not due to his ignorance.
