With investigations relating to the dis-oases of cattle and other domestic animals, and shall publish and distribute, from time to time, circulars of information relative to any contagions diseases of stock, and shall have power in such cases to quarantine infected animals, and to regulate the transportation of stock in this State or from one section of it to mother, and any person wilfully violating such regu- itions shall be gunty ot a misde meanor. 3rd. With the enforcement and supervision of the laws and regula tions which are, or may be, enact ed in this State for the sale of com mercial fertilizers and seeds. Sec. 8. That no manipulated guano, superphosphate, or other commercial fertilizers, shall be sole' or offered for sale in this State until tire manufacturer or person importing the same shall first ob tain a license therefor from the Treasurer of the State, for. which shall be paid a privilege tax of $500 per annum for each separate brand or quality, and he shall also pay a tax of fifty cents per ton for every ton sold. Any person, corporation or company who shall violate the provisions of this act, or who shall sell, or offer for sale, any such fertilizer, contrary to the provisions above set forth, shall be guilty of a misdemeanor, and upon conviction shall be fined and. imprisoned at the discretion of tho court. Sec. 9. And every hag, barrel, or other package of such fertilizer, as above designated, offered for sale in this State, shall have thereon a plainly printed label or stump, which shall truly set. forth the name, location and trade-mark of the manufacturer, also the chemical composition of the contents of such package, and the real per centage of an of the following ingredients asserted to be present, to wit : soluble and precipitated phosphoric acid, soluble potassa, ammonia, or us equivalent in nitrogen, to gether with the date of its analyz i tion, and that the privilege tax pro vided for in section eight has been paid ; and any such fertilizer as shall be ascertained bv analysis not to contain the iiiirredients and per cenfae set forth as above provided. slnill be liable to seizure and con demnation, and vhen condemned shall be scld by the Board of Agri culture for the exclusive use and benefit of the Department of agri culture. An' merchant, trader manufacturer or azent. who shall sell, or offer for sale, any commer cial fertilizer without having such labels and stamps, us hereinbefore, attached thereto shall be liable to a fine of ten dollars for each separate bag or barrel or package sold or offered for sale, to be sued for before any Justice of the Peace, ai d to be collected bv the sheriff" by .distress or otherwise, one half less the cost to go to the party suing, and the other half to the Department, and it any such fertilizer shall be con demned, as herein provided, it shall be the duty ot the Department to have an analysis made ot the same, and cause printed tags or labels, expressing the true chemical ingre dients of the Eame, put upon each bag or barrel or package, and shall fix the value thereof, at which it mav be sold. And anv person who shall sell, or offer for sale, any such fertilizer, m viola'ion of the pro vision of this section, shall be "guilty of a misdemeanor. Sec. 10. Thc' Department of Ag culture ehall have power and authority, at all times, to, , have collected samples ot any commercial fertilizers offered for sale in this State, and have the same analyzed; and such samples ' shall be '; taken froiii at'least ten per cenr; of the lot irom wLicu they may oe se lected. ! f . .., ; , - : , '. ,Sec, 11. It shall bo lawful , for the Department of Agriculture, to require the. officers, - agents, ..or nianKgers of any railroad," or 'steam boat company, transporting -t'ertifi zers ; in '1:this - State, to. ' furnish monthly statements of the "quantity of fertilizers, 'with the name of the consent r( or , consignee, .delivered on their respective liues,,'.at i", any and all oints, within .this State. And said ; Department ,. is Jiere4,y employed to compel ; said - officers, -agentsj or managers, to submit their books ' for-" examination : it found expedient so to 'do; and- any 'sneli agents, offfcers,or managers failing or . refusing" !to -comply';, shall ' be deemed, guilty of a misdemeanor. . Sec 12., The . Department of AgricuHiiKe shall establish, Ju cpn nection with the Chemical ; Lab- atory: of the! University at Chapel Hill, an Agricti.ltural, ; Kxperiment and Fertilizer' GentfalStatiunV and the Board of Trustees of the' lTni-' versity, with t he- approval of the Department of Agriculture shall employ an Analyst skilled Hi ari- c Utitral chemistry. ; '"' , ; ' - .Lb ciiMii ueiue amy oi 6ain chemist to Analyze such fertilizers and products' as. inay "be required iiy the Departtne.iit Agriculture and. to' aid so tar as practicable ui suppres sing fraud in the sale of commer cial .fertilizers. , lie shall also, under tho direc tion of said Department, carry on experiments on - the nutrition and growth of plants, with a view to ascertain -what fertilizers- are best suited to the various crops of - this State; and whether other crops may not be ; advantageously grown on its soils, and shall carry on 6Uch other investigations as the ; said 'department may direct. lie shall make regnlar reports to the sait Department of a I analysis and experiments made, which shall be furnished, when deeiiied useful, to such newspapers as will publish the sanie. Said chemist shall be 6nl-ject to the rules and regulations of the University Laboratory ,and the other rules and regulations of the TJni versity, and his salary shall be paid out of the funds ot the Department of Agriculture. ': - Sec. 13. Tlie Geological Survey is ncreoy made and constituted a co-operative department with the Department of Agriculture, and the Geological Museum and the collections therein, shall, at ' all times, be accessible to the said De partment. Tho Geologist shall, as tar as practicable, prepare illustra tions of the agricultural industries, products and resources of the State, ar.d arrange and care for such col lections as tho said Department may make for this purpose. lit shall also prepare abstracts of tlie Suivey, from time to time, as mav be required for the use of the De partment, in their hand bock, and circulars fur publication, in illustra tion of the advantages ot this State and in promotion of the general purposes of immigration. In return for such service I he State Geologist may have all his samples ot mails, soil?, minerals, and other products, analyzed bv the chemist, at tht Laboratory Experiment Station,free of charge. Sec. 14. Sec. 20. Any farmer, trae'er or other person who shall haul or bring into this State any commercial fertil i jer, in violation or evasion of section 8 of this net, shall be deemed guilty of a misdemeanor, and upon convic tion, shall be fined not less than ten dollars or imprisoned for not moiv than , thirty days for oach oflense ; and any farmer or other person who may buy without the State any com mercial fertilizer on which the privi lege tax of five hundred dollars, as provided in section 8 (it this act, has been paid, shall be required to report all such purchases to the Register of Deed- for his county, and pay the privilege tax of fifty cents per ton, as reqtiiied of dealers, or be subject to the same pains an l penalties as herein iipposed upon dealers in fertil izers : Provided, That no county, town, or other corpora' ion shall be allowed to tax any of the privileges or subjects herein taxed by the State: Provided, That the provisions of this section and section 17 of this act shall not apply to any of the, counties in this State est of the IJIuc Ridge. Sec. 21- It is hereby made the duty of the said Dcpartmtnt of Agricul ture to receive from any manufacturer or dealer in fertilizers any specimen quantities, not less than a fourth of a ton, contributed bv such party, and have the same sent to different sec lions ot I he Mate lor actual experi ment by practical .farmers; ' and the person so experimenting shall be re quired to make a careful report of the results, which shall be registered m tho olfice of sai l Department, and a certified copy of the same shall be transmitted 1o the contributor. Sec. 22.
