County Court Proceedings It was ordered that Justices of the Peace who have copies of the West Vir ginia Code, and whose terms of office expired with the old year, shall turn over such books to their successors in office. The newly elected Justices are having difficulty in getting their prede cessors to turn over the codes to them, the same being public property except in cases where J ustices bought them out right, paying for them with their own good money. Fines due from collection of the sev eral Justices of the Peace of the Coun ty were reported and turned into the county treasury as follows for the year 1908: C. F. Gallaher, $55.85; H. H. Pendleton, $35.00; Chas. H. Briggs, $27. 00; Vincent G. Moore, $25.00. Miscellaneous orders amounting to $1366.15 were accepted from the sheriff Orders on account of free turnpikes were accepted, amounting to $694.80, and parish orders for $124.67. There were also in the list of orders accepted a large number from the various road surveyors of the county, aggregating several thousand dollars. Former Sheriff Gardner reported a number of small estates taken in charge by him as committee administrator. The balance of funds in his hands he de sired to turn over to the court for his successor. The amount of these bal ances was $255.35. The information came to the know ledge of the court that the Court House is protected by insurance poli cies amounting to only $11,000.00. it was ordered that additional insurance to the amount of $5,000 be taken out, and the policies for the same be pre pared by Messrs. Moore & Moore, in surance agents. On Monday the court resumed the taking of testimony in the matter of the application for a franchise on the part of the Winchester and Washing-1 ton City Railway Company. Most of the day was occupied by witnesses for or against the granting of the franchise, and be court reserved its decision in the case until Wednesday. Much interest centered in the order of the Court in connection with the granting of the power franchise Wed nesday morning. The order of the court had been held over from Monday, pend ing a study of the subject matter are the part of the commissioners. Both the •Jefferson County Telephone Company and the Winchester and Washington City Railway Company were dissatisfied with the court's decision when a vote was finally taken, resulting in the re jection of that part of the franchise, providing for the privilege of erecting power poles and stringing electric wins along the road from Charles Town out the Flowing Spring road to Shenandoah Junction, and granting the franchise for the same right on the county road from Shenandoah Junction to the Berkeley county line by way of Kearneysville. The electric company will, it is said, either ask for a franchise over another road to the Junction, or buy a right of way through the farms between the lat ter place and Charles Town. To grant the franchise, as the court did, for a part of the road between Charles Town and Kearneysville, will leave the tele phone company almost as much disabled in its service as though the entire ap plication had been granted The tele phone people are said to be preparing an appeal to the Circuit Court to pre vent the electric company from putting its power wires on any portion of the county road parallelling their wires. State’s Attorney George D. Moore was in court looking after the legal end of the county’s interest in the application, and earnestly advised against granting it. His objection was based on a con i viction that the enabling act under which the court is empowered to grant such franchises is clearly unconstitu tional. In response to a petition from the people of Bakerton, the court appointed C. D. Carter, a constable for that sec j tion of the county. It was shown to the court that at times Bakerton has a miniature riot, and those who take part in it get away before they can be ap prehended because there is no officer residing there to make an arrest. 3 la the matter of the proposed change • in the Roper mill road, it was ordered that the new road be laid out by the res j idence of Miss Bettie Sublette, and con : nect with the Sbannondale road at the dwelling on the farm of Roper brothers. | Miss Sublett was allowed $25 in damages The estimated cost of the county roads in the several road districts of the county was discussed, and the following appro p iations made tor their maintenance fci the coming year.
