Judge Brockenbrough was born in 1800 and graduated at the University of Virginia. He was well known here in Wheeling, where he held a term of court regularly once a year, nearly always bringing with him a lot of his law-students as jurors, who, by the way, constituted quite a feature in Wheeling social circles during the sitting of the court. The Judge was not only able as a jurist, but able (so they used to say) to take a lively hand at draw poker by the way of sociol recreation. Senate Bill No. 51, to authorize Samuel George to remove the remains of the dead trom a certain lot of land in Brooke county. Senate Bill No. 04, concerning transportation ot passengers and freight on railroads. Senate Bill No. 34, in relation to enforcing decrees and oriftrs, docketing judgments, and other liens of the like nature, the effect of such liens and the limitations of proceedings on judgments. House Bill No. 192, tne appropriation bill was panned as amended."" House Bill No. 139, to amend the school law of the State, was recommitted to the Judiciary Committee. The following bills were read a third time and passed: Senate Bill No. 27, to dcclarc void all contracts and assurances heretofore made, -directly or indirectly,for the loan or forbearance of money or other thing, at a greater rate of interest than six percent per annum, except where such greater rate is allowed by law; and prescribing pleadings and proceedings in an action upon any such contract and assurance, and providing for the recovery of money paid upon Any such contract and assurance in excess of the legal rate of interest, and providing remedies and proceedings in a court of equity, for relief touching any such contract and assurance, and touching any conveyance of property t secure the payment of n sum of mone or other thing borrowed at usurious interest. Senate Bill No. 100, in relation to referring causes to commissioners during vacation of circuit courts, was read a tirst time and ordered to a second reading. Senate Bill No. 4S, making it a misdemeanor for sheriffs or other collectors of taxes to misapply the same, wax ordered to a third reading. Senate Hill No. 100, which waa pending at the hour of adjournment, waa then taken up and put upon its passage. Senate Hill No. 100, legalizing certain writings in the countr of Preston, waa read a second time and ordered to a third reading. Senate Bill No. 35, providing for compulsory education, was read a second time and laid on the table. Senate Bill No.| 107, creating an Independent School district for New Creek, in the county of Mineral, was read a first time, and the rules were suspended and the bill put upon its passage. On motion^ the Senate agreed to the name and the bill as amended was named. .Senate Bill No. 24, authorizing the formation of companies for the purpose of constructing booms and dams, tor the purpose ot stopping and securing boats, logs, raft.-*, masts, spars, &c., was communicated to the Senate with the amendment of the House. ' On motion the Senate agreed to the same and the hill-as amended passed. House Bill No. 100, authorizing the county court to construct roads on petition of a majority of the resident land owners along and adjacent to the line of said road, the vote by which the bill was Jejected was reconsidered-. It was moved to insert the county of Marshall. The motion not prevailing the bill was lost. House Bill No. 77, providing for the construction of a road from Helvetia^ in Randolph county, to some convenient point on the Staunton and Parkersburg I'urnjiike Koad in said county, and appropriating money from the Treasurv to aid therein, was read a first time and ordered to a second rending. House Bill No. 143, prescribing the duties and fixing the compensation of Presidents of the countv courts, was read a first time and rejected. House Bill No. 50, to carry into eflect section 48 of article 0 of the Constitution of the State, in relation to homesteads, was read a first time and ordered to a second reading. Houbc Bill No. 24, to regulate pleadings in actions on policies of insurance, was read a second time anif ordered to a third reading. Ilouse Bill No. 159, amending an act incorporating the city of Huntington, was read a first time and the rules were suspended and the bill put upon its passage. Yarnall, whom I had charged with being a thief. Tills committee was raised at the session of the Legislature of 1809, and the report of said committee was made in February, 1870. This committee was composed of J. M. Phelps (chairman), B. F. Harrison, of Jefferson countr, (who was absent a greater portion of the time during the sitting of the committee); Mr. Dills, of Purkersburg, who was also-absent'a greater portion of the time. Barney Rollins, a man of large proportions (lacking the brains), was also a member of that committee, as was also Hon. Wm. Price, of Monongalia county. Now as to the report and how it was gotten up. One B. T. Bowers acted as clerk for said committee, and in writing out the testimony he testified that what he had written was the evidence in effect, not the aclual evidence. J. M. Phelps, the chairman, was drunk almost every hour of the fitting of said committee, and the sitting lasted twenty-three days. Pete YarnalT, the main witness, waa drunk during that time. I charged Peter with being u thief, for which charge he sued me in the Circuit Court of Marshall county for $T>,000, and I was compelled to nrove it, which 1 did, and Peter lit out and has never paid the costs of his suit. B. F. Harrison signed the report from a remote standpoint. He was at home in JefYerson county during the sitting of the committee, Tho report as prepared by B. T. Bowers was sent to him and he signed it without seeing the testimony. One or two others of the committee did the same thing. It was a fight against tho Republicans, as the Hon. B. W.Price and other members of the Democra! tic party have told me. They did not believe that I had ever wronged the State out of a single dime. I was tho objective point of Ike Republican party which they hurled their thiev- . ing, lying witnesses at. It is enough to say at this time that I was persecuted not I for "riqhteousncss sake," but to break me down financially, socially and politically.
