Judge Billings, of the United n States District Court, in a lone decision, dismissed the petition for an injunction restraining Jumcl from acting as Auditor and nays: The petitioner ban not alleged that he was deprived of any election, but retained his office four months. That the attempt to deprive him was defeated I. by the Keturning Board. Thus he ha* secured the election and has been deprived of an oflice to which he was electy ed and declared elected not bv the exclusion of votes for any reason but by revolution. The statute limit* the jurisdic* n tion to the sole question arising out of the denial of the right to vote. Its scope extends from the tirst act to the final canvass. It' tho preliminary exclusion of votes has been prevented or the result declared without discrim* 3 ination or exclusion by the proper State authorities, the atatuto closet) the doorway on the jurisdiction of this court. The defeat must be accomplished by the machinery of an election. An election free from enclusion the plaintiff alleges 0 has been accomplished and the result ar* rived at under the statutes.
