Section 2 That said grant eo herein
agrees that when said line of railroad as
herein described crosses any Improved;
street that It will rentore said streets to
their former condition and ucfulness, and
at all crossing, grantee will plank be

Section 3. That whenever, In this ordU
nance, said line of railroad crosses any .of
the streots herein named by an overhead
bridge, said grantee herein agrees to con.
struct and maintain said overhead bridge
as follows The superstructure shall ba
constructed of Iron or steel. The sub
structure shall bo constructed of stone or
concrete, nnd In case granteo should de
sire, with the consent of tho board of city
commissioners, tf construct steel columns
or posts to support said bridge, said
struts or posts shall be located and con
structed at the curb Hum of said streets.
Plans of said bridge shall be approved
by the board of city commissioners.
Said grantee shall make all necoseary
aproaches or fills required at each over
Section 4. That said line of the rail
rond herein designated shall bn construct
cd within two (2) years from and after
the passage of this, ordinance, unless
otherwise prevented by unavoidable acci
dent or litigation commenced and prose,
cuted In good faith.
Section 6. Within fifteen (15) day after
the passago of this ordinance, the Akron
& Barberton Belt Ballroart company, its
successors or assigns shall give to tho
olty of Akron a good nnd sumdent bond,
or file, a certified check, to the approval
of the board of city commissioners. In tha
sum of five thousand dollars (S.O00), con
ditioned to pay all costs and expenses, of
advertising all ordinances and othtr mat
ter In connection therewith: and further
conditioned, that said lino of railway
shall bt constructed within the. time here
in designated, or that the remainder of
nald sum shall be retained by SI1. City
as liquidated damages.
Section 6. This ordinance shall take ef
fect nnd bo In force from and after Its
pussaso and legal publication.
