Application for the Pardon of Rollin A.
Leet.
Vrtta. Editors. Tou are aware that an ap-
plication in bfbalf of Rolliii A., licet for rwron
faaa been presented to the Gut-mor, and for the
information of those friends who f.-l an interest
in the matter, allow me to gtatc that the papers
jrre put into the hamU of the Governor, lust
week and be read them with much care, eee
ially the entire testimony in the case, which
was presented with Hie papers. An impression
has gone abroad and beliered by many, that
Itollin is dead, but he is living and well, and
tie seems to be in as good spirits as any one sim
ularly situated . yet lie is vcty anxious that exe
cutive elemcuey sheuld ba exercised in his be
half. The very best of pm-rs wore got up in his
behalf at Culumhus.anJ I think I can safely say
that the officer of the penitentiary would be
yery glad to see liim pardoned. Kehaseondue
ted himself to the entire satisfaction of the of5
eers of the prison, and in fact, bis case is look
ed upon as an exception to all general rules.
The Chaplain", in his lAters to the Governor,
aid he would rather see him pardoned than any
convict in the Ohio Penitentiary." The VrJen
aid "he was one of the very bestof convicts, and
had never been guilty of any violation of the rules
f theprison . But the good conduct of a prisoner
there does Dot have any weight with the Goror
per, from the tact that the Legislature of 185G
pissed a law shortening the teim cf service, in
consideration of good conduct while in the pen
itentiary, tlins taking thatpoweroutof the hands
of the Governor, or at least the Governor does
not wish to interfere with the operation of that
law, (extraordinary casts excepted.) I trust the
time is not far distant when this prisoner may
be restored to society, and become a useful and
valuable citizen. It is the impressiou of all
connected as officers of the Ohio Penitentiary,
that young Leet should be pardoned by the Ex-
Keutive. Tb, vjnrors did not request his par
don on the ground ihi: t they considered their
Terdiet against the evidence.but on the ground of
his reformation ard detenuiut.t'un to live a law-
abiding life, although there is a doubt whether
fhe same testimony trotu the same source would
note convict. Through the politeness of the
Ajovernor 1 was permtUed to copy from the exe
cution records the reasons for not at that time
granting a pardon, and for the better informa
tion of Kollin's friends, I herewith transmit the
same to you for publication is your aKT.

Lct. The prisoner was convicted, alter a fair
trial, and able defence, of the atrocious crime of
iiaving prepared poison with intent to dcslroy
the lileof his own lather, which xion was ac
tually taken by his sister, aud resulted m her
death. The i'rosecuUug Attorney now declines
to express any opinion as to the correctness of
the verdict, or the propriety of a purdon; but
transmits notes of the testimony on the trial, lor
the better information of the executive as to all
the circumstances of the case.
These notes I have read, and cannot say that
the verdict was not warraute J by the evidence.
Jt is doubtless possible that the poison may
jiot have been procured with a criminal intent,
W purposely mixed witR Uie bitters ordinarily
vised aa a ntedicen by the father, and opon the
fatal occasion, unhappily given by him to his
daughter; but the weight of evidence seems to in
cline theotherway.and in tbcabseace of Lis per
sonal knowledge jiosscssed by the jury, of the
characters of the witnesses, and of Uie respective
degree of credence due to them, it would be re
soming too far to say that their finding was er
rooeous. Ten of the Jury now request his pardon, hut
distinctly intimate that they have not '"changed
taeir opinion upon the issue submitted to them
onthetrial." The able Judce ho
the sentence, savs: "1 aaiten.! him T :
justly, to the extreme of the law. fifteen rears."
and in the conclusion of his letter, adds, -uoth-
ing new has come to my knowledge since the
twial." IVith those expressions from the judge,
the jurors, and the prosecutor, I cannot think it
would be a reasonable and just exercise of the
power of pardon, to discharge this prisoner from
the Penitentiary. It would be a qualification lo !
me to feel myself warranted in -i.d,Jin,. n, I
request ot the many respected citizens who in-1
terfere in his beholf, and esjiecially t the so
licitation, of the nfirtunato foil.
