After full and mature consideration of nil tho testimony beforo It, tho court finds as follows: First That tho United States battle ship Molno orrlvcd In tho harbor of Havana, Cuba, on Jan. 25, 181W, and was taken to buoy No. I, In from live and o holt to six fathoms of water, by tho regu lar government pilot. Tho United Htutos consul goncral at Havana had notliled tho authorities nt that point, the previous evening, of the Intended arrival of tho Maine. Second The state of discipline on board tho Maine was excellent, and all orders and regulations in regard to tho euro and safety of the ship wero strictly carried out. CAPT. Nothing was stowed In any ono of tho magazines or shell rooms which was not permitted to be stowed there. Proper Precautions Obseneil. The magazines and shell rooms wero always locked after having been opened; and after tho destruction of tho Maluo the keys were found In their proper place in the capt tin's cabin, everything having been reported secure thut evening nt 8 p. m. The temperatures of the magazines nnd shell rooms were taken dally and reported. The only mngulno which had an undue amount of heat was the after 10-iuch magazine, and that did not cxplodo at the tlmo thu Maine was destroyed. The torpedo war lieadsvero all stowed In Iho after part of tho ship under the ward room, and neither caused nor participated in tho destruction of tho Maine. Tho dry gun cotton primers and detona tors wero stowed in tho cabin aft and re mote from tho scene of the explosion. Waste was carefully looked after on board tho Maine to obviate danger. Spec ial orders In regard to tills had been given by tho commanding olllcer. Varnishes, dryers, alcohol and other combustibles of tills nature were stowed on or above tho main deck and could not havo had anything to do wltii tho destruc tion of tho Malno. No Dangerous Stores Mowed Near. Tho medical stores wore stowed aft under tlio wardroom and remote from tho scono of tho explosion. No dnngorou's stores of any kind wore stowed below In any of tho other btoro rooins. The conl bunkers were Inspected dally. Of those bunkers ndjucent to tho forward magazines and hellroom, four wero empty; namolyt "II 3, H I, H B, B 0." "A 15" had boon used that day, and "A 10" was full of New ltlver coal. This coal had been corcfullj Inspected beforo receiving It on board. The bunker In which it was stowed was accessible on thrco sides nt all times, nnd tho fourth sldo nt this tlmo on account of bunkers "U 4" and "H 0" being empty. This bunker, "A 10," had beon Inspected that day by tho engineer officer on duty. Tho ovidenco bearing upon this being principally obtained from dlvors, did not enable tho court to form n doflnlto conclu sion as to tho condition of tho wreck, although it was established that tho after part ot tho ship was practicnlly intact, and sank in that condition a very few minutes after tho destruction of the forward part.
