Ot McCormack officiating, were married Miss Jessie Thayer, formerly of Abilene, and Mr. Joseph Spettigue, chief gas inspector of the Kansas City. Mo., Gas Co. The bride and groom came to' Abilene on the evening train and are the guests of Abilene relatives for a ,few days. Many friends of the bride extend to them hearty congratulations. Following the ceremony yesterday was an elaborate course luncheon at the Hotel Colonial, the tables being decorated with American beauties and bride's roses. , Then came a box party at the theatre given by the groom to the weaaing psny. u cue had been given the actors and they played to the bride and groom throughout the performance. The young crowd saw the bridal party off with a hilarious demonstration at the stttlon and decorated the cab with white streamers.- Abilene guests were Dr. and Mrs. J. L. Thayer, Mrs. Maude Weyant, Miss Blanche Edwards, Mrs. W. B. Glelssner. - All came home with the bridal party last evening. .... CAN THEY MARRY NOW? Enterprise Girl Has Trouble Over Her Wedding. Topeka, Jan. 13. Can a paroled prisoner from the penitentiary legally marry? , This question has arisen to embarrass not only the state author!' ties, but also a young woman at En terprise, Kan., and her family, Hat Murphy was convicted of for gery in Geary county In 1806 and sen tenced to a maximum of ten years in the penitentiary. In 1008 he was pa roled. 'He has never been given his citizenship, papers. On Jan. 5, last, he took out a license in Topeka. to marry Miss Oakley B. Conant of En terprise, Kan. He gave his age as 24 He made oath that there were no le gal-obstacles in the way of the mar riage. The couple were married the same day by Rev. James Delk, a mis sion preacher of Topeka. It la the first wedding ceremony Mr. Delk ever performed In this country. The pro bate Judge questioned his right to per form such ceremonies, but he declared that he was a regular preacher and had that authority. So the probate judge let the matter drop. It has now developed that Murphy is a paroled convict. When a person goes to the penitentiary he , loses his citizenship. That must be restored to him by a pardon from the governor. No citizenship pardon has ever been granted him. .Not being a citizen, the authorities say It is a question wnetn er he could legally enter into mar riage contract or any other kind of a contract. The bride saye she knew that Mur phy was out on parole when she mar ried him and that she ,'tooK him for better or worse." She wants to let the marriage stand as legal. There are two ways to cure the trouble: Either go Into court and an nul the marriage, or have the gover nor issue a citizenship pardon and let the couple be remarried. The authori ties claim that Murphy can be prose cuted for perjury on account of bis osth given when he secured the mar riage certificate. There Is no law or rule on the pa role board which prevents a paroled prisoner from marrying. Still, the general law In regard to marriage re quires an applicant to make oath that there are no legal obstacles and In this case. It Is claimed, there were legal obstacles because Murphy could not enter Into legal contract. The governor, upon bis own motion can annul the parole and send Mur phy back to prison.
