Clark, one of the above named defendants, will take notice that the said plain lifT, Batcheller Town Company, filed a petition in eaid District Court, in said county of Riley, on the 30ih day of December, A. D. 180:2, ngaingt him, the said Charles E. Clark, and the Baid Jennie Clark, defendants, setting forth that on the Cth of June, 189, the said defend nnt, Charles E. Clark, gave his thirty-two (32) promissory notes in writ:ng, of that date, for the sum of Eixty two dollars and .50 each, with interest thereon from the date of said prom issory notes, payable to the said Batchellor Town Company, or Bearer, iu the following manner : Five of said promissory notes, for the sum of Eixty-tvio dollars and fifty cents each, payable on the first day of October, A. D. one thousand eight hundred and sixty (18G0); also five more of said promissory notes for the sum of sixty-two dollars and ,50 each, payable on the first day of October, 18G1 ; also six more of said promissory notes for ths sum of cixtV'two dollars and .50 each, payable on the first day of October, I8G2 ; also five more of Eaid promissory notes for the sum of sixty two dollars and 50 each, payable on the first day of June, 18G0, in oak, Cottonwood and walnut lumber; also five more of said promis sory notes for the sum of sixty-two dollars and .50 each, payable on the first day of June, 1801, in oak, eottonwood and walnut lumber; also six more of said promissory notes for the sum of sixtytwo dollars and .50 each, payable in oak, eottonwood and walnut lumber, on the first day of June, I8G2. In consideration whereof, and for the better securing of the aforesaid sums of money, the said Charles E. Clark and Jennie Clark, by tteir deed of mort gage given under their hands and seals, and recorded in the office for the recording of deeds. in Kilcy county aforesaid, on the I8th day of December, 1800, granted and conveyed untj the said Batcheller Town Company, a certain pieceof Iand,andteam sawmill thereon erected. iu the town of Batcheller, and county of Riley aiorcsaid, containing three acres and thirty two perches, more or less ; and that the afore said sums of money have not been paid the plaintiff therefore sks judgment against said defendants, on said promissory notes, for the sum of two thovsand dollars ($2,000), with interest at 10 per cent per annum, from June Cth, 1859; and that the eaid mortgage be foreclosed, and that the said real estate therein described be appraised and sold, and the pro ceeds thereof be applied to the payment of plaintiff's claim. And the said Charles K, Clark is further notified that he is required to answer or demur to said petition in this cause, in the above mentioned court, on or before the 8th day of March, 18G3. In politics, wc shall pursue that course which we believe justified by principles of Right and Justice, and which tends to Iluman Progress, Universal Liberty, and the freo pursuit of Happiness by all mankind. The importance of having a full and com plete local department we would not under estimate, and we ore again impelled to ask our riends to aid us in this matter give us information of any thing "transpiring in your neighborhood. We desire the Union to be a perfect history of this locality. It is the only town between Junction City and Salina, and is located midway being twenty five miles from each. The country around Abilene is the most fertile and beautiful that can be found in the State its character being an intermixture of timber and prairie, pecu liarly adapted to agricultural purposes. Tho fertility of the soil, the excellence of the water, the healthfulness of the location, and the abun dance of timber and building stone, are induce ments of no ordinary character; while in addition, the rich mineral resources of this portion of the State, the Salt Springs, and extensive Coal Fields west of us on the Smoky Hill, insuring the early completion of a Rail Road from the Missouri Riven, makes it one of the best natural business points in the State. The town was laid'but six months ago, since which time over one hundred lots have been sold, and it now contains a store, blacksmith shop hotel, Post Office, and several families.
