ADA STREET CHURCH. The Trustees Called upon to Appear Ju Court Monday. Wonderful Statements of the Peti tion Filed by Garland. Continuation of the Brown Trial. TOT QtTO WARRANTO GRANTED. At tbo Instanoo of O. J. Doatty, Esq., attorney for Obarlos Garland, an ox-Tnistoo of tbo Ada Street Methodist Ohurcb, tbo Btoto’e Attorney yesterday filed a petition In tbo Criminal Court for a writ of quo warranto against tbo present Board of Trustees, and tbo unpleasant imbroglio will, In all probability, bo Investigated la the courts, Tbo following 1b a full abstract of THE PETITION: . Tbo potltionor roproaonlo that bo Is a member In good standing of tbo Ada Street Methodist Episcopal Church, and bas been for tbo loot nineteen years, and oubjoot tw tbo discipline and local jurisdiction tboroof, and that .said oburoh is, and bas boon for tbo last ton years, a corporation croSlcd by tko authority of the State of Illinois, and having a.Board of Trustees and other officer*, pursuant to tbo provisions of itbe statute In such eases mado and provided. Tbo petition further avers that tho office of Trustee in said cbnroh is one of GREAT TRUST AND PROMINENCE, touching tho government and affairs of said cor poration, and tho administration of tho temporal and financial concerns of tho said church. Ho further states that, a vacancy having oc curred In said Board of Trustees, and It having become necessary to fill sold vacancy, and oleot a Trustee for that purpose, tho relator was, on or about tho Ist day of August, 1670, LAWFULLY ELECTED AND QUALIFIED as one of tho Trustees of tho church, and, as a member of cald Board of Trustees, tho relator accepted, and held, and executed said office up to the present time, and has never bean in any manner legally or properly removed from said office, and that ho has not resigned or forfeited tho same, and ho is now, as bo verily believes, lawfully entitled to use and exorcise said office, and in tho duo and'propor exorcise of tho aamo. He further avers that, according to tho rules,' regulations, customs, and usages of said church, there is, and of right ought to bo, AN ANNUAL ELECTION for members of the Hoard of Trustees, in tbo month of March of each year, and if no Board la elected in March then tbo members of tho acting Board hold over for another year and retain their respective ofllooa respectively, until tho month of March next following, and until their succoßHors oro olootod and qualified. Ho assorts that there was no election of True* tees held In tho church in March, 1874, and that the noting Trustees hold over, and wore entitled to retain their positions for the ensuing year, and that according to tho rales, regulations, on a customs of said church, tho ofßco of Trustee is only an annual one, and no person can bo law fully elected for more than ono yoar, and that tho discipline and laws of said church expressly provide that tho Trustees shall bo oicoto'd in tho samo manner as State and comity officers. Under tho rules of tho church each Trustee shall bo NOMINATED S7 A MALE MEUDED of the church, and elected by ballot by tbo male members, ana tho female members cannot, and are not allowed, to voto for said Trustees, or for any other officer of said church, and that men only are allowed to vote for any purpose.*, By the law and discipline of the church, not more than nine nor loss than throe Trustees shall bo elected, to servo for ono year, or until (heir successors are elected and qualified. Tho petitioner avers that on the 27th of May. last ono \V. 0, Bandy, whom 000 IN Ills INSCnUTABLE WISDOM has permitted to ourso said church with his ministration os pastor thereof since Sep tember, 1873, called a mooting of his parti sans to assemble at tho church, and caused himself to bo made , chairman of said mooting, and said Bandy then arbitrarily and unlawfully appointed a committee of five persona to select duo Trustees, and said Bandy, regardless of tho laws and usages of the church, then and thoro Instructed said Committee in a sort of political speech to select nine Trustees for tho church, throe of them to servo for tbo period of throe years, throe for two years, ana throe for one year. Tho said Committee, being so wrongfully and wickedly instructed, did then and there select Mine Trustees, ns follows i Absalom B. Moore, Henry Crippen, andEbonozor Jomiiuga to servo for throe years; John Braldwood, James X*. Pattison, and J. B. Fulton to serve for two years; and Charles Palmer, Jesse Graven, and Samuel Brown for ono year, and upon such selection being made by the said Committee, the sold Bandy also falsely and wrongfully INSTRUCTED THE WOMEN and female members present to vole -for said niuo persons so selected, and stated that they were tho persons to bo voted for os Trustees, and thereupon all the fomalo members thou present voted for tho said persons, as instmoled so to do by Dandy, and ho, Dandy, then declared said nine poisons duly olootod as Trustees of tho ohuroh, and no written or printed notice of said election was given, posted or published. THE PETITIONER FURTHER AVERS that tho*aotious and conduct of said Dandy ut terly prevented a fair ami free oloolion of Trus tees at said mooting, and caused to bo selected partisans and admirers of himself, who would tie in favor of retaualngthim another Confotonco- Sear as pastor of said church, and jat Lis conduct iu the promises was diroctod to that end, and for that purpose, and was and la destructive of good morals, order, and dcoonoy iu the church. The petitioner states that there wore only four vacancies in tbo Board of Trustees on tho 27th of May last, when said PRETENDED ELECTION AND DISGUSTING TIIOOEED- wore bold by said Dandy and his partisans, and that uo legal election could be hold for moro than four Trustoos.uutil March, 1875, as no gen eral election could bo hold until that time. Ho declares that tho election of nino Trustees was fraudulent and illegal, and a grievous fraud and oppression upon tho rights and interests of the members of said church, and that said elec tion, engineered and conducted iu tho manner aforesaid, was, and is, utterly Illegal and void, and that said nine persons wore voted for by women and elected by female votes. Tho petitioner further sots forth that THE SAID NINE PERSONS above named have unlawfully taken upon them selves the duties of Trustees, and have unlaw fully usurped and intruded into said office, and now unlawfully aad fraudulently exorcise the functions aud duties of tho same, and now un lawfully hold and execute said office,!and un lawfully proclaim themselves as tho Board of Trustees. Tboroforo, tbo potiiloner, at tho instanoo of 4 tbo relator, prays that tho said Henry Cribbou, Absalom B. Mooro, Ebouczor Jonniugs, John Braldwood, James L, PatUson, J. 8. Fulton. Charles Palmer, Josso Craven, and Samuel Brown, bo made defendants heroin, and that Ilia Honor will grant leave to tbo petitioner to flio an information iq tho uaturo of a quo warranto, in tho namo of "tho Pooplo of theßtato oi Illinois, against said defendants, and that process Issue out of tho Court to com pel said defendants to answer by plea or other* wise, by a short day, to bo fixed by his Honor* Judge Foxwoll ontorod TJIK FOLLOWINQ ORDER immediately after thoroadlug of tho petition *, People ox roJ, Thomaa 0. The trial of Ira Brown, Trustee of the Ada Btroot Methodist Church, charged with offences against his pastor and people; was continued lost evening. There ms a good audlouoa lu attendance, tho proportion being about two to ouo in favor of tho ladies. Thoro was some delay because of the absence of a member, but tho Chairman finally made tho tiding that, as a majority of tho Oommittoo would decide tho ease, a majority was competent to hoar it, so tho trial prooeoded. To the Editor of The Chicago Tribune ; Sm : I am a victim of a soulless institution, and if I can sayanything to prevent others from a Him wretched state permit mo to do so. While X, la common with others, enjoy some benefit from that institution known as “ Tho Chicago City Ballway,” I have yot somo charges to make against it, which seem to mo are well founded. At this season of tho year, and particularly ia such hot weather, tho only comfortable car the Company offers us is an open one, but this, I venture to assort, is made disagreeable and almost intolerable to a largo portion of passen gers by allowing the other passengers to smoko. By a custom which scorns to mo to bo infamous passengers are permitted to smoko on tho throe hook seats. Now it so happens that half tho time tho wind Is in such a direction as to carry tho smoko of those fifteen to thirty smokers into tho faces of tho other passengers, which, to those who do not smoko, is certainly very disagreeable, to soy tho least. Tho liberty granted by tho Company is taken advantage of too many times, and passengers not unfroquent- Jy sit in any part of the car and smoko, and my observations havo generally boon that men who take advantage of this liberty are not very par ticular* as to tho quality of their cigars, which are generally of the worst manufacture. For Coo, 1 think that smoking on stroot-cars is an Imposition on tho part of passengers, and a dis regard of people's rights on the part of the man agers of tho Company. Thorn ore other defects in tho management of this institution that wo aro obliged to overlook at present, one of which is worthy of note, and that is in using balky horses. There is not a day but what tho streets become blockaded to some extent from tho use of thoao balky horses, and mot (infrequently aro they the moans of accidents lu our crowd ed thoroughfares, I was riding yesterday in a State and Madison street car which, in passing another car to which was attached one of tboso bailey teams, managed in somo way to run tho tongue of one cor into tho window of tho one I was sitting in. IVo managed to got out without broken tlimba, but,lmd somo badly bruised, and it was no fault of tho drivers or balky horses that wo wore not more severely hurt. Louis Hadley. OmoAGo, July 8. GAB-WELLS. To the Editor of The Chicago 'J'ribune: Bm j I naw by Sundav’s Tribune that gas had been discovered by boring at South Chicago, why may not tho city bo supplied with natural gas from beneath, that is bettor than anything we now have, as well as other places, Frodonio has been &o supplied from one of these under ground reservoirs for tho pant lifty years. It was first discovered thoro by William A. Hart in digging a well, and horo Is a reminiscence showing what tho Company know about gas. They wore to supply tho Dunkirk lighthouse with itt after 2 miles of pipe had been laid to thot oud, U was sug gested by some cautious one to atop and test the enterprise, and eoo if it would burn that far away, which idea was 'considered safe, and so noted upon by lotting tho gas in tho pipo ; but disappointment was the result, for, after tho burning of rubbish all of one day at the ond of tho pipe, they failed to discover tho presence of any gas, or oven the atnoll of it. Now, It was down hill all tho way from Fro doeia to Dunkirk, and why tho gas did not run that way, was a mystery so atunuiog in its effect os to stop tho work until sorao scientist could bo consulted in tho interest of tho work. Subao cmoutly,' however, when the Company learned that gas was so unlike water ns to require a pressure to make it run down hill, the light house enterprise was abandoned, but tho ditch remained. After this tbo gas was supplied to consumers at $4 a year for oaoh light, while the supply ia ns good now as it over was. Tbo gas is odorless, and corresponds with the description of that first alluded to, and is also one of tho natural won ders that is Hoon'oud talked about by all strangers when visiting that beautiful Tillage* . 0. Cuioioo, July 9,1874. To the Editor of The Chicago Tribune: Sni: In your issue of the Oth a correspond ent suggests that my former article is "a little fanciful, 1 ’ because tho article roads that gas has boon used for fuel for the manufacture of salt iu Ohio for thousands of years. Idld not write Ohio, but* I did write Oxiina. Hue and other writers are sufficient authority as to the correct ness of tho statement. It Is a very easy matter for a person accustomed to reading manuscript to understand how a printer, working on strongo copy, should make the mistake, and a moment's thought, to a thinking person, ought to bo suffi cient to detect tho error.
