Montana Dry Farming Is Recognized Abroad Member of the London Geological Society Writes a Book on Sub ject of Dry Land Farming ONTANA has received signal recognition and is given val uable publicity in a book which has just been issued by the Cen tury company under the title, "Dry Farming," written by Dr. William Macdonald, M. S. Agr., Sc. D., Ph. D., Fellow of the Royal Society of Edin burgh and the Geological Society of London and vice president and corre sponding secretary for South Africa of the Dry Farming congress. Dr. Macdonald is editor of the Ag ricultural Journal and is agronomist of the department of agriculture of The Transvaal. He came to the Unit ed States about a year ago to study the dry land agriculture of this coun try and, by direction of his govern ment, attended the third Dry Farming congress at Cheyenne, as delegate from The Transvasl: He traveled ex tensively in this country and spent some time in Montana, visiting the various experiment stations and dem onstration farms and the Montana Ag ricultural college, obtaining much in formation about the methods used and the conditions prevailing this state. The results of his travels are seen in his book, 13 of the 37 illustrations in the volume being Montana dry farm scenes. A number of them show the results of the Forsyth experiment farm. Dr. Macdonald has written a re markably clear and concise exposition of the principles of dry farming. Be ginning with the agriculture of the prehistoric peoples who raised crops without irrigation in regions of lim ited rainfall, he has traced the devel opment of this important branch of science to the present day. Out of the teachings of Jethro Tull, the founder of a system of scientific agri culture in the seventeenth century, and those of the founders of the later systems and practical farmers who are bringing dry farming to its more complete development in the present day, Dr. MacDonald has culled the fundamental principles which have been established as basis elements in the ultimate science of agriculture. Tillage, seed selection and develop ment, crop rotation, farm machinery and farm economics are treated in masterly manner in this volume, but without the ponderous verbiage of a scientific textbook. The book is illustrated with 32 full page and five smaller halftone repro ductions of farm scenes, elucidating the text with ocular proof of results obtained from dry farming methods. This is the most pretentious contri bution to the permanent literature of the world, dealing with a subject of vital importance to many thousands JURY IN ALLEN CASE DISAGREES After Deliberating for 24 Hours, Re ports Inability to Give Verdict. STOOD EIGHT TO FOUR Third Trial Is Held at Miles City and Is Attended by Large Number of. Witnesses from Billings.-Judge Presided. After deliberating for 24 hours, the jury in the case of Lne state vs Dr. W. A Allen of 'this city reported that it ha.. failed to agree and was accord ingly discharged at 6 o'clock Friday! night. It is said that the jury took* frequent ballots which ranged all the way from a tie to a 10 to 2 vote for acquittal. When the last ballot was taken the vote was 8 to 4 for ac qui ttal. This was the third time the case has been brought before a court. It was first tried before Judge Fox in this city and resulted in a disagree ment, the jury staying out three days. The trial was then shifted to Miles City and was given a second hearing ,before Judge 'Lord. The jury re turned a verdict of guilty, but Judge Lord overruled the verdict on the ground that sufficient evidence had not been introduced to warrant con viction. The third trial, which has just ended, was -before Judge 'Henry of Livingston, sitting for Judge San ner of IMiles City who 'was dfsquali fled on account of his having assist ed in the defense at the second trial. The prosecution in all three trials has been conducted by County Attor ney Harry Wilson, while O. F. God dard has represented the defense. In the last trial 'Mayor George W. Farr of Miles City assisted in the defense. PEARY IS WILLING. Wants Geographical Society to Look Over His Data. WASHINGTON, Oct. 16.-In re sponse to the suggestion of the Na tion Geographical society that he submit to it his data regarding his discovery of the north pole, Comman der Peary sent the following telegram to the society, addressed to Prof. Wil Its L. Moore, its president. "Will have material in Washington by Wednesday that I trust will serve the society's purposes. (Signed) "PEARY. "Eagle Island, Me." of people. In the western United States alone there are 200,000,000 acres of arable land awaiting devel opment by dry farning methods. There are millions of acres in other lands that potentially are areas of great productivity. Dr. Macdonald has given the world a story of instructive value, as well as of fascinating liter ary merit. It is a book that will be appreciated by the general reader as well as by those directly interested in the study of agricultural problems. This is not the first book written on dry farming, Prof. B. C. Buffum of Worland, Wyo., judge of cereals of the International Dry Farming expo sition, having issued a volume entitled "Arid Agriculture" early in the pres ent year. But. Professor Buffum's books is designed to be used as a text book and deals more in detail with the technical phases of the science. LOSEKAMP WINS OIL LAND SUIT Retains Property Having Three Re. sponsive Wells and a Sue eessful Refinery. IMPERFECT CONTRACT Alleged by Rancher Jones That the Lease He Gave Did not Contain a Homestead Clause, but This Failed to Win Suit. Millions of dollars in prospective profits for residents of Billings, Miles City and Wyoming points hung in the balance at IBasin, Wyo., during two days of the week passed until Judge C. H. Parmalee handed down a de cision Friday in *favor of John D. Losekamp et al in the suit brought ,by J. Jones to have a lease on oil lands given by him declared null and void. Mr. Losekamp leased the Jones ranch which was transferred by him to the (Montana and Wyoming Oil com pany. The company spent $35,000 to '$40,000 in drilling and in the erection of a refinery. Three of the five wells are responsive and the refinery is outputting the several products of petroleum. The lease obtained by Mr. Lose kamp did not contain the homestead clause which the law of 'Wyoming re quires and on this ground the at tack was made, but fruitlessly, it hav ing been conclusively shown that the agreement was 'made in good faith and without intent of evasion by eith er party to it. The array of counsel was formid able, that of Losekamp including T. J. Walsh of Helena, Judge 'Metz of Sheridan, 'Mr. West of 'Basin, and William Johnston of this city; that of Mr. Jones including Judge Neus ,baumer of Oakland, ex-Governor Chat terton of Cheyenne and E. E. Enter line of ISheridan. With a fortress of books 'banked up Ibefore them the plaintiff's attorneys spent a day and a half in making a case; the argu ment of the defense occupied less than two hours. Wm. M. Fitzhugh, who has asked for lease the Jones property, is quoted as having said he would in spire an appeal 'but Jones and his wife seem to feel satisfied with the result; also, it is understood that Fitzhugh thinks of bringing suits on ten other 'properties held by the oil company under like agreement. None of these properties has been exploit ed. Among the officers of the Montana & Wyoming Oil company are John D. Losekamp, president; C. O. Gruwell, vice president and J. W. Vaughn, secretary, while among the stock holders are William Linton, W. B. George, Charles F. Stocker, George (Crosby, Colonel Malone, A. W.
