Murray^are having more trouble between thum.^Some months ago the water company^arbitrarily refused to furnifh water to^one of Mr. Murray's tenants because^Murray would n ^t be personally re^^sponsible for the water rent although^the tenant tendered the rent in ad^^vance. Mr. Murray took the matter^into court on an application for a writ^of mandate and won the case and the^tenant, got his water. The company ap^^pealed to the supreme court where the^case Is now pending. In the meantime^Mr. Murray has been talking about or^^ganizing a new water company and his^relations with the present and only^water company have not increased In^amicability. Mr. Murray and Silas F.^King are owners of the Avalon build-^ins .n Main street. The building Is di^^vided into three separate apartments^and the basement, saloon and lodging^house are rented separately and as far^as renting Is eoneerninl are three seva-^rate buildings and the different ten^^ants have had a great deal of trouble^over the payment over their appor-^tlonate share of the water rent so Mr.^Murray asked the water company to^put In a water meter for each floor, of^^fering to pay for therm, according to the^statement of Mr. Murray's attorney,^but the company's superintendent was^not Inclined to have It that way and^Mr. Murray would have It n^^ other^way; so on the 11th of this month the^company turned the water off from the^building entirely. The company was^willing to put in one meter for the^whole building and let the tenants fight^U out among themselves; but Mr. Mur^^ray could not have three meters al^^though he made another demand for^them on Monday and tendered the^money for them in advance. To-day^Mr. Murray and Mr. King applied to^Judge Mediation for another alterna^^tive writ of mandate to compel the^water company to put In the meters^and furnish water for the building in^accordance with the terms of their^franchise. Judge Mi ll itton Issued the^writ and set the matter for hearing at^10 o'clock Saturday morning. In their^petition the relators claim that In the^present condition the building is un^^tenantable and that they can not rent^It, and are therefore suffering great in-^OoavsnJMOO and loss and that they^have no plain, speedy or adequate rem^^edy In the ordinary course of law.^^ 'harles O' II. ^nnill is attorney for Mur^^ray and King. stillIn .lull-^Attorney Pan Yancey made a hard^fight to Ket Karl Krnest Lelschke and^Simon Yeen out of Jail on a habeas^corpus, but was unsuccessful in his ef^^forts. The men were held to the dis^^trict court under SI.ihhi bond each on^the charge of burglary and their attor^^ney thought there had been no rea^^sonable cause shown. The habeas cor^^pus proceedings were heard this after-^no in before Judge Mr Hut t. m at cham^^bers and the testimony showed that^while a stock of goods were under at^^tachment and In the custody of the^sheriff l.els'hke and Veen, who had^been the alleged owners of It. tried to^cart aw ly some of the stuff which had In stored la I has. merit adjoining thestore building. TfcSJf were caught^In the act and arrested for burglary.^Their defense was that the stuff in the^basement was not included In the levy^and thai n the preliminary trial the^state failed to prove that It had been^attached or that it was a portion of^the attached stork. Judge afcHsttOa^satil the question was one of fact on^which a jury would have to pass and^that it was SO) for him to try the rase.^The committing magistrate found that^there was a r easonable and probable^cause ami his finding would be inter^^fered with it would have to be shown^that he das entirely wrong, which had^not been done. It was evident from^the testimony that it was the purpose^of the defendants to deprive the plaint^^iff of the property and to profit by^their act. The men were ordered re^^turned to Jail. TheLeischke family evidently finally^got itself Into serious trouble. For^some time a boot and shoe business^has been carried on In a small room on^Kast I'ark street In the name of Mrs.^LtlSehlM and her husband was clerk^^ing f t her. After she got goods on^credit for about lio.ooo from various^wholesale houses she suddenly sold out^to the man Veen and took a trip to^Kurope and her husband kept on clerk^^ing for Veen, but Mrs. Lel*chke*s cred^^itors saw a scheme to defraud and at^^tached the stock in spi'e of the pre^^tended sale, and It was wHe the stock^was In the possession of the sheriff^that the alleged burglary was commit^^ted. Wanta Division.^The Independent District Telegraph^company to-day commenced an action^against Seth B. Smith, W. C. Morgan^and H P, Kmise for a sale and parti^^tion of the proceeds of the Hutte Parcel^delivery franchise. The complaint In^the case recites that the plaintiff and^defendants are owners In common of^the franchise, each party owning a half^Interest. The complaint does not state^why the ownership In common is not^desirable and simply asks for a parti^^tion ^^f the property by sale and di^^vision of the proceeds according to the^respective rights of the parties. Iloskins, members ol^the board of school trustees, an I^County Attorney Wines and his assist^^ant, ft S. Booth, met this evening la^rhe county commissioners' rooms to^consider the school tax ^iuest|on, for^which the new laws make no provision^Mr. Wines explained the law and gave^It as his opinion that the county could^not legally include the school tai la^the levy for general county purposes^and that the only remedy for the exist^^ing trouble would be for the school^trustees to call an election to vote a^special tax. under that provision of^the law which empowers school trus^^tees to call an election to vote a tax^for building, repairs and other pur^^poses. Mr. Booth concurred In this^opinion and the commissioners agreed thatthey could not Include the nHis Inthe county levy, although It would^come within the II mill levy. Last^year the levy for county purposes was^only 12'j mills, instead of HI mills, as^previously stated.
