In according with the follow ^^ing terms and prvlsions. to-Wit: Thatthe defendants promised and^agreed to pay to the plaintiffs the ma^of four dollars |^er head for each Indiiin^whlcN the plaintiffs could induce to^come to Anaconda for the purpose of^participating In said carnival. And in^addition thereto the defendants agreed^to allow plaintiffs provisions for all of^sui'h Indians as plaintiffs could bring^In r . three weeks' provisions: and lo^addition thereto OM ox for Chief^Isaac^, one Of the plalntffs In this ac^^tion. Thatthese plaintiffs collected and In^^duced to come to Anaconda for the^purpose of participating in suid carni^^val, one hundred and nine Indians, nr.d^said carnival was held, and large^sums of money were collected by the^^defendants charged as admission fee to^guodry and divers persons who attend^^ed said, carnival. Thatplaintiffs have duly performed^r. 11 the conditions of said agreement^and contract upon their part to be per.^formed: but the defendants have fail^^ed, neglected and refused, and still re-^fuae, to perform the conditions of said^agreement upon their part to b^ per^^formed, and have paid no part of said^sum so agreed to be paid by them. eg-^tept as hereinafter stated.
