Notice is hereby given that taxes on real and personal property for the year 1907, are now due and payable at the office of the county treasurer, in the city of Lewistown, Fergus county, Montana. Department of the Interior, United States Land Office, Lewistown, Mon tana, October 24, 1907. A sufficient contest affidavit having been filed in this office by JANE BARRIE, contestant, against desert land claim No. 453, made February 13, 1896, for unsurveyed lots 1, 2 and 3, and the ne 1-4 sw 1-4, se 1-4 nw 1-4, Sec. 7, Tp. 16 n., R. 19 e., M. M„ by Mar gret Devivier, contestee, in which it is alleged that said entry and final proof was fraudulent and illegal for the reason that the land embraced thereby is non-desert in character; that it will produce a paying agri cultural crop, one year with another, without irrigation; that it is a fact well known and demonstrated beyond a doubt that the same kind of land in the immediate vicinity has produced a paying agricultural crop for several years last past without irrigation; that said land has never been irrigated from any permanent water supply; that there is no available water to ir rigate said land, and that there are no indications of same having ever been irrigated; and to the best of af fiants knowledge, information and be lief, said land has never been irrigat ed. Said parties are hereby notified to appear, respond and ofifer evidence touching said allegation at 10 o'clock a. m., December 5, 1907, before the Register and Receiver at the United States land office in Lewistown, Montana. The said contestant having, in a proper affidavit, filed October 24, 1907, set forth facts which show that after due diligence personal service of this notice can not be made, it is hereby ordered and directed that such notice be eiven by due and proper publication. Said proposals to include the entire cost of feeding, clothing and nursing the sick, poor and infirm and the burial expense thereof.
