The said action Is brought to fore close that certain mortgage, dated March 7th, 1921, made, executed and delivered by the above named defend ants, Stanley Niamiac and Salomea Niamiac, to said plaintiff, which said mortgage covers and is a lien upon the following described land situated in the Town of Bridger, County of Car bon, No. Two and Four (2 and 4) Section Thirty, Township Seven South, Range Twenty Three East, M. P. M. contain Forty three and twenty four hundredths acres: Also a right of way six feet in width running over and across the Southeast Quarter of the Northeast Quarter of Section Thirty (30) Township Seven South Range Twenty Three East; together with all and singular the tenements, hereditaments and appurtenances thereunto belonging or in anywise ap pertaining; and for the further pur pose of securing judgment upon and enforcing payment of that certain debtedness secured by said mortgage. That said action is brought for the purpose of foreclosing a certain mort gage deed, made, executed, and deiiv ered, by said defendants, Mrs. E. J. Dailey, formerly Hildegarde A. Alm in, on the 12th day of April, 1920, to the Columbus State Bank, a corporat ion, and recorded on the 14th day of April, 1920, in the office of the County Clerk and Recorder of Carbon County, Montana, in which county said mort gaged premises are situated, in Book 32 of Mortgages at page 21 thereof. The lands described in said mortgage being: the Southeast The East Half of quarter ( E Mi SE M ) of Section Thirty three; and the Southwest quarter (SW ^4) and the South Half of the North west Quarter (S% NW 1 /*) of Section Thirty-four (34) Township Four (4) South, Range Nineteen (19) East, con taining three hundred twenty (320) acres, more or less. Said mortgage thereafter, on the 26th day of June, 1920, having been sold, assigned, and delivered to the said plaintiff, Montana Life Insurance Company, said assignment being re corded on the 28th day of June, 1920, P .. _. , ,, „ in the office of the County Clerk and Recorder of Carbon County, Montana, in Book 3 of Assignments of Mort gages, at page 61 thereof. That said mortgage was given to secure the payment of a certain first mortgage note, or promissory note, of the said defendant, Mrs. E. J. Dailey, formerly Hildegarde A. Almin, for the sura of Seventeen Hundred and no-100 Dol lars ($1730.00), due and payable on the 1st day of December, 1924, with interest thereon after maturity at the rate of ten per cent, per annum, and five interest coupon notes, one for Sixty-six and 02-100 Dollars ($66.02), due December 1, 1920, and the others each for One Hundred Two and no-100 Dollars ($102.00), due respectively on the 1st day of December, 1921, 1st day of December, 1922, 1st day of December, 1923, and 1st day of Dec ember, 1924, together with interest on the principal of each of said coup on notes from the date of maturity of each of said coupon notes, at the rate of ten per cent per annum, together with taxes, insurance premiums and costs of continuing abstract paid by said plaintiff, and for the sum of Two Hundred a reasonable attorney's fee, and costs, and to bar and foreclose the right, title, interest and claim which said de fendants Mrs. E. J. Dailey, formerly Hildegarde A. Almin, E. J. Dailey, her husband, Ed M. Davis and Columbus State Bank, may have, or claim to have in, to, or upon said mortgaged premises subsequent to the execution and delivery of said mortgage deed, all of which more fully appears and is more particularly set forth in said plaintiff's complaint on file herein, to which reference is hereby made.
