The Judge of the io-mer Town Court was a.so, wnat literaiy translated, is called ‘"Writer’’ which cor responds to our clerk us the Couurt; these two positions were independent, the **Writer’’ being avppointed by the King, the same as the Judge, but for financial reasons the two offices wer= uaited in one person Now the ‘''recording’’ as we call it, according to the Danish Laws cunsisted in two acts, one ot which was publishing in open court the documents submitted, in a condensed so-m, which was a julicial act performed by the judge as such, and the other act was the “‘recording’’, that is the entering in ex tenso in a bk all the documents pub lished in Court, this was a ministerial act performed by the ‘"Writer’’ as such, and for which this latter alone had the responsibility, and this was aiso the opin ion.of the Ministry of Justice, (Attorney General)in an opinion given by the same. Now, the lown Courts were held weekly a' fixed days and hours and the time and place of the publishing of the drcuments were therefore known Qo the coumiuyg into force of the Code the Court was no longer heid at any fixed day and hour, and therefore the publishing of the docu ments ceased and only the ‘recording’’ was done., Os course it nould from the b-ginning nave been more in conformcy with the existing laws, that the puoisn ing and recording had been transferred to the Police Court, which held sessions at fixed days and hours, but this was oot done, and accordingly the one part of the law was done away with; either the Da nish laws exist and must then be follow ed, or they do not exist, and then a new lhw shou!d be made. With regard to the Judge being Brand Major, I have never heard that before, | have known the Collecor of Customs, mercnants and the Police Assistant 10 be. Os course, it 1s not expected that thegJudee of the Dis trict Court should know these_tbhings, but it is right that when you want Informa tion on Danish questions you shouid go to a man who knows the conditions. | ccnsider that the same as the Police Judge who has been acting as Vendue Director and he has no authority to it the same as the Clerk of the Court has been acting as Recorder without any real au-, thority. It is a mistake to say that the ‘Distriet Judge acts as Recorder. Ihe Judges of the Danish Town Court acted as Clerk of the Court tut their commission mentioned the various offices. Ihe Judge
