the long confinement has left tho pris
oners spirit absolutely unbroken
But Thaw has always looked defiantly
fiantly at the shadowy fearsome pres
ence of death constantly at his elbow

could never claim him as its victim
for tho tragic death of Stanford White
And so it was not a whitefaced and I
withered Thaw that I saw in the
Tombs today The man was smiling I

derstand Mr Delmas is returning to
New York but this has no connection
whatever with my case 1 regard him
very highly But he voluntarily step
lIed out of the case and after conver
satlon with Mr OKeilly and Mr Pea
body 1 have made the selection of
Mr Littleton as my chief counsel Mr
Hartridge and Mr Gleason are out of
the case The entire slate of the last
trial has been wiped clean In prepa
ration for the new trial to come
I 4f wish the new trial was at hand
It will not take so long this time We
will put the evidence In more concise
form 1 do not fear the outcome of
the trial when it does take place
IfAs the case will be presented
this time I am sure every one of the
twelve men will be convinced that I
was crazed beyond reason whenwhen

dictments against Caleb Powers Dave
Gushing an exconvict Howard M
Benton a Newport attorney and Jen
nie Gentry of Lexington charging
them with procuring fellow prisoner
of Henry Yotscy to make false writ
Ings purporting to contain an admis
slon from Youtsey that he and nol
Jim Howard fired the shot that kill
ed Governor Goebel The matter has
been under Investigation for some <
time but nothing pertaining to it ever
leaked until after the Indictments weJt
returned John Rodgerson and James
Stevenson Kenton county convicts
arc the men said to have made the
false writings
The story will not be fully brought
out probably until one of tin parties
accused is pat on trial Maneuvers
to secure such a writing have been
going on it is said since January

Rodgerson one of the convicts who
was before the grand jury sas that
shortly before Dave Gushing left the
penitentiary he suggested to him and
Stevenson that they could procure

statement that Youtsey killed Goebel
Acting upon this suggestion they en
tend upon the work After some
feellers had been put out the Ontrv i
woman appeared in the prison with
a note from Caleb Powers offering

that Judge Shaw and Commonwealths
