In reference to the license far shows and exhibi tions, tne committee beg leave to suggest, in lieu of adopting the proposed ordinance referred to them, the adoption of the following amendments to Chan. XXIV of Kevised Ordinances : Amend Sec. S, referring to etrenses, so as to in crease the liceuae from 25 to S0, and the penalty far violating the ordinance to 1"0 instead of fid, as now; also, Ameud Sec. 4. referring to caravans, menageries or collections ef animals, so as in like manner to increase the license to fV., and the penalty to 10U. Also the following report : The committee on laws aud ordinances, to whom was referred a communication from the Board of hducation in relerenco to the levy of taxes for the support nf the public schools for the year b7u, re spectfully report : In said communication the liohrd of Kducation "instruct" and "require" of this council, that they levy, for the support of the public schools of the city, for the current year. 1. A tax of ,0(X) to maintain said schools ; A tax of 1.500 to make up au alleged deticieucy in the taxes that were re quired by law to be levied last year for the support ol the public schools of the city : and S. A tax of 2 mills on each dollar of the assessed valuation of the taxable property of the city for the year 170. to pay arreari of mdebteducs of suid Board of Education. Your committee are constrained to advise the council not to accede to these "instructions" and "requirements ' of the Board of Education. The statute under which the Board seem to imagine they are authorized to make these requirements of the city council is the act of March 30, 1 S6f, enti tled "An act to amend an act entitled 'An act to establish tree schools in the city of Ottawa' and the acts amendatory thereof." ' JJr that statute, this council was directed to levy the following taxes for the use of the Board of Education: i For the year 164 and succeeding years, "such a. tax, not exceeding fuM.O'ti, as the said Board of Kducation of said city shall decide to be necessary and proper" to maintain th public schools of said city; 2. A special tax of five mills on the dollar on the value ot all the taxable property in said city in the year '.', to be upplied by said Board to the paymeut of the then ( March 30, iMi'.i) indebtedness of said Board; and 3. A further tax of two mills on the dollar on the value of all the taxable prop erty in said city in the year lb70, in case the pro ceeds of the five mill tax directed to be levied as above should not be tuthcicot to pay the then (March L s6'J) indebtedness of said Board of Ed ucation. This act was passed by the legislature at the in stance and request of sundry meetings of the citi icns of Ottawa, held in February and March before the assessment for that year had been made, and when it was supposed the assessment for city and school purposes would be about the same it had been for the preceding year, in round num bers, !2.50O,Ctf. The Board of Education was then supposed to be in debt some tH.OoO. A tax of 0 mills en the assumed assessment ef $2,SoO,0"0 would not yield enough to pay this indebtedness ; therefore the provision far i mills additional ia 170 was made to wipe out all the then indebted ness of the Board. But when, in June l0y, the assessment was made, it w as found to foot up some $3,iiu0,000. An assessment of 5 mills on the dol lar on this sum would yield some $17,500, while the Board of Education had otlicia.il y reported us indebtedness on March '.'fib, 1S6S, the day before the act of the legislature above alluded to was ap proved by the Governor, at i4,G0S.3i. When the Board of Education banded in their requisition up on the council for taxes to be levied for school purposes for ISC9, they asked for the "highest rate per cent, authorized bv said law," (meaning the act of March SO, 16CJ.) That law specified the highest sum to maintain the schools fur the year to be $i.',0'.'u and the highest sum to puy the "present" (March 00, l;y) indebtedness of the Board, to be $14,'0S.r.4, the two sums amounting to $o4,6('S,31. The city council thereupon directed a tax of ten mills on the dollar of the assessed val uation ef tlie taxable property of the city to be levied for the support ot the public schools and the payment of the indebtedness of the Board of Edu cation a levy which it was believed would yield at least the re'quired (34,608.44, and which actually yielded U.itXJ to 11500 more. It is true, if tho letter of the statute of March 80, IStiy, is to be followed, und not the spirit of the law, us well as the clearly expressed intention both of the citi.ens meetings in fiuming, aud of the legislature in passing the act, the city couu cil, in the levy of but 5 mills on the dollar in lSCi!) to maintain the sellouts, fell short some t'-'.iOO of the $S0.0(H asked for by the Board of Ed ucation. But in giving the Board some $17,500 with which to pay its then indebtedness, the council exceeded the requisition of the Board some $3,000, lor which sum, us the Board under the statute in question hud no power to make uuv other use of it than to pay its then indebtedness, it would become the duty of the city council, if tlio literal interpretation given to the statute by the Board is to be adhered to, to demand of the Board that it shall account to the council. But instead of proposing to account to the council for this excess, winch, il' tin- interpretation put upon the statute by the Board is correct, they acknowledge to have re ceived in excess of their requisition of lHi',', and in excess of what they were authorized to receive by the statute, the Board make upon this council the extraordinary requisition thai it levy a two mill tax in 170, to pay urrcurs of an indebtedness, less by $-J,J.M tliistt they acknowledge to have ul ready received lor tho specitiu und sole purpose of paying that indebtedness! The Board have seen lit'to charge this council with a want of "courtesy ." Your ci'iiiinUtee would not be lucking in material for it suitable retort in view of such u refreshing piece of vlirontory. I'tidertho considerations thus presented, your committee, therefore, recommend that tho city e'erk bo directed to inform the Board of Education, in response to their comiiiunicittion uf the 3th inst., that, in tho view tho city council is constrained to take of the truo intent ntid meaning of tho law of March 30, ISC'., referred to in tlio communication from snid Board, this council has no authority, and must therefore decline, to levy upon the peo ple of Ottawa, for the aso of the public schools of sam city tor tne year i7U, aay ot tne taxea re quired and instructed to be levied by said Board of Education, save only the 120,000 directed to be levied bj aaid law for the snata tenants of the pub lic schools ef the city for the year IS7. The Chair appointed Fiske and Vette tellers to assist in canvassing the vote. Informal ballot for Marshal George Alden had 5votos: A.Anderson had 2 votes: Peter Mever had 4 votes ; II. U. Hintz had 2 votes ; Prosper Tisler had 1 vote. Formal ballot for Marshal George Alden had 8 votes , Peter Mever had 5 votes ; Blsnk had 1 vote. On motion of liutton, George Alden was declared auiy elected city marsnai tor tlie unexpired term of municipal year. Informal ballot for Collector Daniel S. Blake bad I votes; Jesse Dickey had 2 votes; Jas. Gra ham bad Z votes; Scattering had 2 votes. Formal ballet tor Collector Daniel S. Blake had 9 votes; Jas. Graham bad 3 votes; Jesse Dickey had 2 votes. On motion of Burke, Daniel S. Blake was declar ed duly elected city collector for the municipal year ending March 20, 1871. Soran moved to proceed te elect a city attorney for the present municipal year. Motion of Osman to postpone election for citr 1 attorney indefinitely, was carried. On motion of Bosserman, ordered, that the com mittee on sewerage have full power to act in the matter of necessary ordinary repairs to sewers, culverts and drains. On motion ef Lynch, a vote of thanks was ten dered to Justus Harris for his very satisfactory and efficient services as city marshal during his several successive terms of otlice.
