cases that taxation cannot be imposed by a corporation except for corporate purposes, and that the bonds issued in this instance were not ior a corporate purpose. A muni oipal corporation cannot incur a liability and levy and collect taxes on the property of a citizen to aid in the development of mere private enterprises. Whether the proposed improvement would or would not have been of great benefit to Ottawa and its citizens was a matter of no moment, if the debt was not created for a corporate purpose. The city had no power to incur the debt and issue the bonds. reojile ex rel. Richard J, Fulleron v. Hiram T. Gilbert, County Judge, etc. Affirmed Opinion by Judge Sheldon. This was a pe tition filed in the Circuit Court of this coun ty for a writ of mandamus to Judge Gilbert to allow the relator, Richard J. Fullerton, an appeal to the Circuit Court of this county from a finding that the latter was insane in a proceeding had in the County Court. The sole question here presented is whether the right of appeal from the finding and order in the County Court exists in this proceeding to enquire into the alleged insanity of a per eon. The proceeding is an inquest as to the state of one's mind to enquire whether or not he is insane. It is true that notwith standing the contrary finding of the jury, the alleged insane person might be sane ; but if the appeal lies, it lies in all cases equally, whether the person be a raving ma niac or mildly nfllicted with insanity, or be in fact sane. There can be no distinction. The finding of the jury and the order of the court, at least, must be taken as presumptive evidence that the person alleged to be insane is insane, and that his case renders proper his immediate commitment to the state hos pital for the insane. It is provided that when any patient committed to the hospital shall be restored to reason he shall be dis charged, and that if he be detained afterward contrary to his wishes he shall have the privilege of a writ of habeas corpus at all times, and herein lies the remedy. Circuit Court. The county court was occupied yesterday by the trial of the People v. Linsbeck, of West Ottawa, charged with assault with a deadly weapon. On the night of Sept. 30th last he threw a stone through the window of the residence of Valentine Stohr, striking his wife on the head and knocking her sense less. The jury brought in a verdict of guilty at 9 o'clock last night. A. Steinke, who was indicted for the firing the Exclmnge Hotel in this city, is out on bail. The indicted saloonists of this city plead guilty to two counts each of their indictments and a general nol pros followed. The criminal docket will be taken up on Monday. Thera are some well known cases to be tried. On Wednesday the petition of Sarah A. Niles of Marseilles for a divorce was denied, and after a hearing the case was dismissed. Henry Mayo, attorney for the defendants, Gentleman, Fowler, etc., appeared before Judge Stipp on Monday and moved to quash the circular indictments. In reply his Hon or said that during his experience, 20 years as a lawyer and six years as judge, he had never known of a similar case, and he would prefer to. thoroughly examine the matter be fore taking it up. He also stated that the matter would probably be tried before Judge Blanchard. County Court. W.W. O'Brien of La Salle plead guilty to theft and got 10 days in jail. Upwards of 40 cases were disposed of in this court during the week. The following criminal cases were heard : David Shaw, Frank McGraw, Wm. John son, riot, plea of guilty ; Shaw fiped ?13, McGraw, 525, Johnson $ 10 and Shaw sen tenced to 30 days in jail. Indictment vs. David Shaw, John Shaw and Wm. Johnson, aiding prisoner to escape, nol pros as to David Shaw and Johnson. John Shaw 30 days in jail. Frank Wyatt, larceny, five days in jail. Hoag, riot, fined $10. II. S. Gil more, larceny, six moth in jail. Fred Bauer, larcyny, jury trial, guilty, 4 tnonhtein jail. Liquor fines. Adam Harper, $20 on each of 20 counts, for selling without a license ; Fischer, $20 ; Betting, $80 ; Reichert, $80 ; Dorfner, $80; Futtererrt al, Mclntyre et al., Scherer, Baumer, Fry, Holmes, White, Fis cher, Maher, Mueller, $40 each, with costs in all cases. The court has been engaged the past two days hearing the case of George W. Mathias, Kllswoith Crumley, and Arthur Cunningham charged with disturbing religious services at the South Ottawa church. Over 50 wit nesses were subpoenaed for the defense, but none were called. The evidence showed that there had been scandalous performances, but the jury found these persons not guilty. Probate Court. Superintendent Lelghton announces that the Illinois and Michigan Canal will be closed for navigation from Lockport to La Salle on Wednesday, Nov. 25th. The day before the writer saw him in the Gennania Bank at Mendota making negotiations to purchase some city proper ty from Geo. Madden.
