ORDINANCE NO. 105. AN ORDINANCE PROVIDING FOR THE REGULATION AND SUPER VISION CERTAIN BUSI-! OK NESSES IN THE VILLAGE OK MULLAN; PRESCRIBING DUT 1ES OF THE POLICEMAN OF SAID VILLAGE IN RELATION TO SUCH REGULATION AND SUP ERVISION; PROVIDING FOR THE LICENSING OF SUCH BUSI NESSES AND PRESCRIBING THE LICENSE FEES TO BE PAID FOR SUCH LICENSES AND 'RE SCRIBING HOW SUCH LICENSE FEES SHALL BE USED: CREAT ING A FUND TO BE KNOWN AS THE "POLICE FUND" AND PRO VIDING THAT ALL LICENSES COLLECTED UNDER THIS OR DINANCE SHALL BE PAID INTO USED PAY SAID "POLICE FUND." AND PROVIDING THAT SUCH "PO-(the I.TCE FUND" SHALL BE EXCLUSIVELY FOR THE ING OF POLICEMEN'S SALARY AND TOWARD DEFRAYING THE EXPENSES OF THE POLICE DE PARTMENT OF S AID VILLAGE; PENALTIES PROVIDING FOR FOR THE VIOLATION PROVISIONS OF THIS ANCE AND FOR THE OOLLEC TION OF SAID LICENSE MONEY. I I Ol TIIK ORPIN BE IT ORDAINED BY THE CHAIR MAN AND BOARD OF TRUSTEES OF THE VILLAGE OF MULLAN: Section 1. Unless It appears from the context of this ordinance other wise, the word "person" when used in this ordinance, shall also include "per sons"; the word "day" shall he con «trued to mean the period of time from midnight to midnight or any part, of that period; the word "month' shall be construed to mean a calendar month and "monthly" shall refer to a calendar month: the word ''quarterly" shall mean that period of time included within the time begin ning with January first and ending with March thirty-first; beginning with with April first nnd ending June thlr tieth; beginning July first nnd ending with September thirtieth, and begin ning with October first and ending with December thirty-first. and "quarterly" shall refer to such per iods of time. The word "year" shall mean the period of time beginning ■ with January first and ending with December thirty-first, and "yearly" shall refer to that period of time. Sec. 2. All businesses, professions and callings conducted within the cor porate limits of the village of Mullun shall be regulated and conducted in accordance with all of the luws of congress, the state of Idaho, and the ordinances of the village of Mullun, nnd ln accordance with the régula tions of all departments of said gov ernments, including the health de purtments of the state of Idaho, the county of Shoshone, and of the villas each policeman of the said village to see that all persons, co-partnerships. or corporations prosecuting or carry ing on any trade, business, profession or calling within the limits of said village, comply with all such laws and regulations, and to report and com plain to the proper authorities of the violation of any such laws or régula j Sec. 3. No person, firm, company I or corporation shall be engaged in. prosecute, and carry on any trade. [ business, profession or calling within the limits of the village of Mullan. | for which a license may be required j by this ordinance, until he or they or it shall have obtained such a license, y of tions. Sec. 4. Every person, co-partner-j ship or corporation required by this ordinance to obtain a license to en gage in any trade, business, profes sion or calling for which a license required, shall pay to the village clerk the sum or sums required by this or dinance to be paid therefor. Upon receipt of such payment, the village clerk shall issue a license to the par ties applying therefor upon the com pliance of the applicant with the pro visions of the ordinance relating obtaining licenses for the business, trade, profession or calling for which such license is required. Sec. 5. Sec. 6. In every case where more than one of the pursuits, ments, occupations, business or call > employ ing for which a license is required. shall be pursued or carried on in the same place by the same person at the same time, license must be taken out for each according to the rate sever ally prescribed, except as provided by Section 10 of this ordinance. Sec. 7. When a yearly license is provided for and the same is taken out after the first day of any year, said ! license shall expire on the 31st day of |December following, and the licensee shall be required to pay a full year's | license therefor, it taken out in Jan uary; if taken out In February, eleven twelfths of such license; If in March, ten-twelfths, and shall be reduced ; one-twelfth for each succeeding month! during" the year; when a quarterly li j cense is issued and the same is issued! Each travelling merchant, [hawker or peddler who carries a pack [and vends goods, shall pay to the clerk the sum of $5.00 per day if travelling on foot, but if using a wagon, horse, horses, or automobile, ^5.00 per day; PROVIDFID. Each keeper of a hotel or lodging house, restaurant or public eating house, or stand, shall pay to the clerk the sum of $3.00 per quarter. Sec. 27. Each person, co-partner ship or corporation engaged in tin. laundry business shall pay to the clerk the sum of $3.00 per quarter. Sec. 28. Each person, co-partner ship or corporation operating a bar ber shop shall pay to the clerk the sum of $1.50 p* r quarter. Sec. 29. In case of parties conduct ing or doing a business for which a license is required by this ordinance [nnd such parties not having such li cense. the act of conducting such bus iness for each day shall be considered a separate offense. Sec. 34. If any person or persons, Ition transact any business, trade, oc jcupation or profession for which a [license is required by the ordinances of the village of Mullan without pro curing such license, there shall be due ,ccmp * from such persons, company, co-part nership or corporation to the village of Mullan, the amount of the license required for the transaction of the business, trade or profession so en gaged in, conducted or carried on; and the village of Mullan, by civil action, may enforce the collection of the same. Sec. 35. All moneys collected for licenses under this ordinance shall be paid into a special fund to be known |as the "Police Fund" and shall be used {exclusively for the payment of the salary of policemen and for the ex penses in connection with the opera tion ? and conducting of the Police Court and the Police epartment of the village of Mullan. Sec. 36. Aii ordinances and parts of ordinances in conflict with this or dinance are repealed by this ordin ance; PROVIDED, HOWEVER, this not in anywise be {ordinance shall retro-active or ex post facto and shall not relieve any person from punisl ment for the violation of any ordin ance heretofore in force in said vil lage and shall not relieve any person, co-partnership or corporation from any liability that he. they or it may have heretofore incurred on any bond given pursuant to the provisions of Ordinance No. 103 of the village of Mullan, passed on the 6th day of September, 1922. Sec. 37.
